HC stays authority of AFT in insurance cases
Tribune News Service

Chandigarh, April 25
A Division Bench of the Punjab and Haryana High Court has stayed an order passed by the Chandigarh Bench of the Armed Forces Tribunal (AFT) that had earlier ruled that the jurisdiction to hear matters pertaining to the Army Group Insurance Fund (AGIF) lay with the Tribunal and not with the civil courts.

Taking up a petition that contended that the AGIF was a private society and that the Army had no control over it, the High Court’s Bench comprising Justice Hemant Gupta and Justice Fatehdeep Singh has fixed July 15 as the next date of hearing.

Consequently, legal experts said civil courts would hear AGIF matters. A Full Bench of the Tribunal comprising Justice Rajesh Chandra, Justice VK Ahuja and lt Gen NS Brar in February held that since subscription to the AGIF by armed forces personnel are compulsorily deducted from their salaries under relevant provisions of the Army Act and Army Rules, it comes under the definition of “service matters” as provided for under the AFT Act.

Described as a registered society, AGIF provides insurance cover to armed forces personnel in case of death, injury or disability, disburses loans and other financial benefits and welfare schemes.

Chandigarh Bench’s order overruled

At a dawn ceremony here at the historic Delhi War Cemetery, Australian and New Zealand communities in India paid tribute to war veterans and those who have laid down their lives in the service of their nation.

April 25 each year is termed as Anzac Day. Among those who attended the service included official representatives from a range of nations and from the three Indian Military Services. Buglers from the Indian Army played “The Last Post” and “Reveille” at the service.

“Anzac Day commemorates the landing of thousands of Australian and New Zealand troops on the shores of Gallipoli on April 25, 1915, beginning a long hard-fought campaign,” said Australia’s High Commissioner to India, Patrick Suckling. — TNS
