Insurance firm penalised for rejecting claim
Chandigarh, March 13 The District Consumer Disputes Redressal Forum has directed the company to refund Rs 2 lakh, along with interest, paid by the complainant for purchasing a medical policy. Further, the insurer has been told to pay Rs 15,000 as compensation for the mental agony caused to the complainant. Ruhi Sharma, the complainant, said her father Par Brahm Sharma had obtained a Happy Family Floater Policy from the company for an assured sum of Rs 2 lakh. On November 28, 2011, Ruhi’s father complained of chest pain and was admitted to the PGI. At the time of admission, acute chest pain was reported to the doctor on duty. He died while undergoing treatment on December 6, 2011. The complainant claimed that her father died due to pneumonias refractory cardiogenic shock. However, the company rejected the complainant's claim vide letter dated April 30, 2012, with the observation that her father suffered from refractive cardiogenic shock, aspired pneumonia, hypertension and diabetes mellitus type-II. It was also mentioned that the deceased was a known case of diabetes mellitus for two years and the policy was nine months old. Hypertension and diabetes mellitus were confirmed risk factors for coronary artery disease. Hence, the claim was not payable as per the clauses. “In the instant case, the firm has failed to produce any such medical record, which could show that the deceased was suffering from pre-existing diseases of hypertension and diabetes mellitus type-II at the time of taking the policy. There is no evidence that the insured had the knowledge of symptoms of the two diseases then. Hence, in the absence of any definite evidence of pre-existing disease at the time of filling the proposal form for the policy, we feel that the claim could not be repudiated by the company,” the forum ruled. |
