HC rap for Chandigarh Admn
Chandigarh, January 13 The Bench of Chief Justice Sanjay Kishan Kaul and Justice Arun Palli also reprimanded the administration for not holding the meeting of the State Advisory Council every two months. The previous meeting was held in November last. As the matter came up for hearing, the Chandigarh Administration said the Union Ministry of Home Affairs (MHA) had lifted the ban on the creation of additional posts for government schoolteachers. The MHA had earlier expressed its inability to allow creation of more posts. Taking a note of the developments, the Bench gave the Ministry of Home Affairs one and half months to accord sanction to the UT Administration’s demand for the creation of additional posts for teachers for complying with the provisions of the Right to Education Act. The administration was also directed to complete the process of filling up additional posts, within three months, after the Centre gave its sanction. Already, the High Court has asked the Chandigarh Administration to form a committee to look into the implementation of the Right to Education Act in city schools. Earlier, senior standing counsel for the UT Administration Sanjay Kaushal had contended that the quality of education in the city government schools was satisfactory and they were performing well. Quoting the example of Government Model Senior Secondary School-16, the counsel said it was one of the most reputed schools in the city. The counsel further said just a few schools were not performing well. The High Court had earlier directed all schools in Chandigarh, Punjab and Haryana to get themselves registered with the state governments. The Act makes it mandatory for each school to get itself registered with the Education Department of the state. According to the procedure, the school has to make a self declaration before the Education Department confirming the compliance of the specified conditions. The Act also provides that the Education Department could withdraw recognition after following prescribed procedure in case a school is not complying with the condition. |
