HC orders vigilance probe into illegal mining

The Punjab and Haryana High Court has ordered a vigilance probe into “mining mafia” operating in parts  of Haryana. Issuing the directions, the Bench of Chief Justice Sanjay Kishan Kaul and Justice Augustine Georga Masih made it clear that the matter was being handed over to the vigilance, and not the Central Bureau of Investigation (CBI) as it was already over burdened.

Dead rats found in mid-day meal at Government School, Hedli Lal, Gurgaon, on Monday. Two dead rats were found in mid-day meal at a government school in Hedli Lal village of Sohna subdivision. Schoolteachers said when they opened the food containers, they found two dead rats in them. The food is supplied by ISCON, a local firm.

Husband booked for dowry death

The police has registered a case of dowry death against Yogesh and two others after his wife Lavina committed suicide at Mahavir Colony here last night. Sources said after Lavina consumed some poisonous substance, her husband took her to a private hospital where doctors declared her brought dead.

VAT slashed on textile products

Chief Minister Bhupinder Singh Hooda today reduced VAT on textile products and carpets, druggets, woollens, durries, cotton floor durries and rugs from 12.5 per cent to 5 per cent. This would benefit the traders to the tune of about Rs 150 crore.

HC orders vigilance probe into illegal mining

The Punjab and Haryana High Court has ordered a vigilance probe into “mining mafia” operating in parts  of Haryana.
Issuing the directions, the Bench of Chief Justice Sanjay Kishan Kaul and Justice Augustine Georga Masih made it clear that the matter was being handed over to the vigilance, and not the Central Bureau of Investigation (CBI) as it was already over burdened.

“Taking into consideration the nature of the matter and keeping in mind the burden already on the CBI, let the Vigilance branch of the State of Haryana further investigate into the matter,'' the Bench asserted.

The directions came on an appeal filed by transporter Joginder against the State of Haryana and other respondents. He was seeking directions to the respondents to allow his vehicles, transporting minor minerals from leased area in Uttar Pradesh, to enter the state. Directions were also sought to the respondents not to cause “hindrance in the transportation of minor minerals''.

His petition was initially disposed of by a Single Judge in April last year after holding that the respondents were very well within their rights to stop the vehicles carrying minerals or other consignments in an unauthorised manner. Aggrieved by the order, he moved the High Court again.

As the matter came up for hearing, the Division Bench observed: “We may notice that on May 2, counsel appearing for the appellant gave no objection if an FIR was registered against the appellant as well as qua the allegations made by him against mining mafia, which may be re-investigated by the CBI.

“The court directed that the FIR be registered and the allegation and counter-allegation of illegal mining may be investigated by a Central agency.” Advocate General, Haryana, states that the matter has been examined at the level of Additional Chief Secretary and thereafter by the Principal Secretary and the State is of the opinion that the state police and investigation apparatus is competent to handle the case but if this court decides to entrust the investigation of the case to the CBI, assistance of the state police would be assured.

The Bench concluded: “Though, we have been informed that the challan has been filed in the court, if some other material is found the same be placed before the trial court.''

The case will now come up on January 16, 2014, for the Vigilance Department to produce the result of investigation and file a compliance and status report before the court.

Two dead rats found in mid-day meal

Two dead rats were found in mid-day meal at a government school in Hedli Lal village of Sohna subdivision.
Schoolteachers said when they opened the food containers, they found two dead rats in them. The food is supplied by ISCON, a local firm.

On hearing about the incident, residents of the village thronged the school fearing well-being of their children.

The school principal said the transport vehicle of the mid-day meal had come early today and the driver had left in haste even before they could check the containers.

Taking strong note of the incident, the village panchayat decided to boycott the meal.

“Several times we have informed officials the Education Department to stop sending food as quality of the food was not good. Our children will not eat it till things take a better turn,” said a panchayat member.

Blaming the school for callousness, an official of ISCON, said the food was fine till it reached the school and it was only there that rats fell in it.

“We get signature of the school authorities when they receive the meal to confirm its condition and timely delivery. In this case, they have signed expressing satisfaction, so it’s their fault. There is no proper storage or dining space in the school,” said the official.

Husband booked for dowry death

The police has registered a case of dowry death against Yogesh and two others after his wife Lavina committed suicide at Mahavir Colony here last night.
Sources said after Lavina consumed some poisonous substance, her husband took her to a private hospital where doctors declared her brought dead.

Yogesh informed her parents about the incident. After reaching the hospital, Lavina’s father Prakash Taneja, a resident the same locality, informed the police. The police took her body to the Civil Hospital here for post-mortem examination.

In his complaint to the police, Taneja alleged that soon after her marriage on February6, 2010, she was tortured and beaten for dowry by her husband, mother-in-law Satyavati and sister-in-law Poonam.

Deputy Superintendent of Police Satish Kumar said a case of dowry death had been registered against three persons and they would be arrested soon.

HC notice to ex-CPS Fouji in job scam

Taking cognizance of allegations levelled by a "whisteblower" in a recruitment rip-off in Haryana, the Punjab and Haryana High Court today issued notice to former Chief Parliamentary Secretary Ram Kishan Fouji. Notice has also been issued to the SPs of Yamunanagar and Bhiwani.

The notice came after Anand Kumar of Yamunanagar alleged threat to his life and liberty from Fouji. In his petition, Kumar alleged he was being pressured to withdraw the complaint against Fouji.

Describing himself as `whistleblower'' , Kumar claimed since he dared to unearth the job-for-cash scam in Haryana, he was receiving threats from unknown persons.

Kumar alleged Fouji had demanded and accepted a bribe of Rs 5 lakh to offer the job of a JBT teacher to him. "The petitioner met Fouji who assured of help subject to the fact that he should be given Rs 5 lakh ", the petition added.

Kumar added he borrowed money from his relatives and family friends to pay the bribe for the recruitment, which took place in 2010. Two years later, he "out of guilt" decided to "expose" the recruitment scam.

Farmers seek award under new acquisition Bill

Demanding a copy of the report of the one-man Justice Iqbal Singh inquiry commission submitted to the Haryana Government on the Rewari violence over land acquisition in July last year, the Bhoomi Adhigrahan Virodh Samiti, Rewari, today also sought the withdrawal of criminal cases registered against villagers.

The samiti made this demand before a committee headed by Industries Minister Randeep Singh Surjewala to resolve the land acquisition issues in Rewari.

Sources said the samiti had also rejected the award for land acquisition under the existing provisions, proposing that the award must be given as per the new Land acquisition Bill. “The demand for withdrawal of criminal cases and compensation as per the new legislation have already been conveyed to the government at today’s meetings,” a member of the samiti delegation said.

Sources said the committee would now ask the Home Department to provide the report to the samiti.

The Inquiry Commission had in its report said that the protest against land acquisition proceedings in Rewari where a farmer-police clash left many injured was the handiwork of “outsiders with vested interests”.

They had mingled with farmers and ignited passions, leading to blocking of the highway and policemen being held hostage. Suggesting that the government should consider dropping the cases registered against farmers, the report also recommended medical compensation to the farmers and policemen.

The commission had suggested that the Deputy Commissioner should be made overall in charge of the district as far as law and order was concerned. The government should go ahead with its plan for an industrial project on the land, it recommended in the report.

Boy electrocuted in Rewari village

A 15-year-old boy was electrocuted while his mother Usha Devi suffered serious burn injuries after they came in touch with a high tension wire in the balcony of their under-construction house at Bharawas village in the district today.

Usha was referred to Safdarjung Hospital, Delhi.

The incident took place when the woman and her son Sonu were standing in their balcony and the high tension cable passing closely pulled them towards it.

The police said it was a case of accidental death.

Four children injured in roof collapse in Kaithal

Four children were injured when the roof of their house collapsed at Nanakpuri locality here today.Sources said the children were rescued by neighbours and rushed to the Civil Hospital.

Charan Singh, a labourer, and his wife Pushpa left for work early the morning. All four children, Annu, Nisha, Tamanna and Babli, where inside the house when the roof caved in. On hearing their screams, neighbours rushed to the spot and pulled them out.

Charan Singh said his children were at home as they skipped their school today.

Package rates for medical treatment to be implemented

The Haryana Government has decided to implement package rates for providing treatment to government employees, pensioners and their dependents in the approved private hospitals.

An official spokesman said here that the government had also issued guidelines for effective implementation of the package rates, which had been worked out in consultation with various empanelled hospitals.

He said all the empanelled hospitals would charge as per the fixed package rates and the charges would be reimbursable to the employees or pensioners and their dependents.

The package rates include lump sum cost of in-patient treatment, day care and diagnosis procedures.

Notice to state over tax on dharamshalas

The Haryana Government's move to exempt almshouses from property tax while imposing it on dharamshalas and imambaras has come under the judicial scanner.

Acting on a petition filed in public interest, seeking "parity", the Punjab and Haryana High Court has put the state and its functionaries on notice. The matter will now come up for further hearing before the Bench of Chief Justice Sanjay Kishan Kaul and Justice Augustine George Masih on November 13.

The notice came on a petition filed by the Seth Nanak Chand Tuleram Jhunthra Trust through its trustee Bhim Jhunthra.

In the petition filed through counsel Sukhvinder Singh Nara, he asserted that the trust started a dharamshala for the "welfare of general public and for charitable purpose" in 1940 in Sirsa. The dharamshala was exempted from taxes under the Income Tax Act and the Wealth Tax Act.

The government had issued certain notifications whereby not only the dharamshalas, but also others institutions such as mosques, temples, churches, gurdwaras, charitable hospitals, dispensaries, orphanages, almhouses, drinking water fountains, municipal buildings and lands, graveyards, cremation grounds, cemeteries, imambaras and government schools and offices were also exempted from the payment of property tax.

But in June last year, the government issued the impugned notification on tax on building and land within the Municipal Corporation limits.

The notification makes it mandatory for dharamshalas and other institutions to pay tax, while granting exemption to almhouses.

Dalit abducted, raped

Sources said Pardeep Kumar of Chidiya village in Bhiwani abducted the victim hailing from Ghiji village of this district on Sunday and raped her in a vehicle. The accused had assured the victim of freeing her from evil spirits with the help of tantric acts. However, he raped her in a car at lonely spots on the outskirts of the village. He fled the spot after committing the crime. The accused was reportedly known to the victim.

The accused is yet to be arrested.

One held for harassing teacher

Gurgaon: A schoolteacher today lodged a complaint against a resident of Mumbai for sexually harassing her.

In her complaint to the police, the teacher said Anu Malhotra, who was presently residing in Ashok Vihar colony, approached her with a promise to launch her son as child artist in films.

She alleged that he was forcing her to have physical relations with her and when she refused, he started sending obscene messages on her mobile phone.

"We have arrested Anu, who claims to be an assistant director with Yashraj Films. He was produced in a court which sent him to judicial custody," said Inspector Babu Lal.

Rahul Yadav of Sector 10 complained to the Vigilance Bureau that he had been booked for running a hookah bar and the accused officers-- Sub-inspector Satish Dagar and ASI Roshan Lal from the Sector 14 market-- had asked for Rs 50,000 to let him go.

He had already paid Rs 30,000 and was to pay Rs 20,000 today when the Vigilance Bureau laid the trap.

Rahul Yadav was booked for running the illegal hookah bar in August and granted bail by a court.  

3 held for hitting father-son duo

Rewari: The police has arrested three persons for allegedly assaulting a father-son duo at Lukhi village. Sumer Singh Yadav and other members of his family attacked Sompal Yadav and his son Sunil Yadav yesterday.

On the statement of Sompal, the Kosli police has booked Sumer Singh Yadav, his wife Lajwanti, his two sons Lokesh Yadav and Sharad Yadav and two others. Sumer Yadav and his two sons have been arrested.

RTI Act failed to serve its purpose: Activists

The Right to Information (RTI) Act that came into force on October 12, 2005, has failed to bring transparency and the bureaucrats who on the pretext of the Official Secrets Act concealed the information of public interest for decades, have been appointed Information Commissioners, defeating the spirit of the Act.

When we spoke to a number of RTI activists, they lamented that the Act had failed to help the common man and RTI applications were being treated as complaints by the government departments. They said not many people were aware of the fact that there was an application form for the RTI in Haryana. Nothing has been done by the government to make the people aware about the RTI except organising some seminars, they say.

"The state public information officers (SPIOs) are non-cooperative, the First Appellate Authority (FAA) is corroborative, Information Commissioners are being selected by the government and the Lokayukta is virtually toothless. Under such circumstances, how can one assume that the RTI Act would serve its purpose," said PP Kapoor, a well-known RTI activist.

"The SPIOs try their best to conceal information and in more than 80 per cent cases, the First Appellate Authority (FAA) upholds the order of the SPIOs, forcing RTI activists to appeal to the Chief Information Commissioner (CIC). The FAA even tries to belittle the Information Commission and in more than 50 per cent cases fails to appear before the Information Commissioner, delaying the proceedings. Moreover, there is no provision of penalty on the FAA," Kapoor added.

There is a need to introduce a chapter on the RTI Act in the school curriculum. A budget should be earmarked for creating awareness on the RTI besides bringing transparency in the appointment of Information Commissioners. Rajesh Sharma, another RTI activist, said 14,055 applications were filed under the Act in Haryana till July last year and the applicants had to file appeals in 2,134 cases as relevant information was not furnished. However, the penalty was imposed only in 358 cases for suppressing or delaying information, he added.

Union Minister and senior Congress leader Selja is visibly upset over the deteriorating political atmosphere in the state and is of the view that the level of bitterness now prevalent in the higher echelons was not witnessed in the past.

A day after being hit on the left shoulder by a stone while travelling from Kalka to Chandigarh on the Kalka-Sai Nagar Shiridi superfast express yesterday, the Union Minister is distressed over the turn of events, sources close to the leader told The Tribune.

The incident took place when she boarded a general coach after flagging off the new train and sat next to a window when all of a sudden a stone hurtled towards her, hitting her on the shoulder. Selja refused to offer any comments on whether the incident could be a handiwork of a miscreant, a pre-meditated attack or a freak accident.

Prior to the incident, she was at a meeting organised by the Pradesh Congress Committee where, according to reports, Congress general secretary Shakeel Ahmed had asked party members not to air their grievances in public. However, some members, who were not favoured by those controlling the organization, were not given an opportunity to share their views even in closed-door meeting, sources said.

On her part, Selja said it was surprising that state leaders were talking of enemies when in politics one only heard of rivals. “Atmosphere is polluted. State leaders are talking of enemies in politics. How can you have enemies? We only heard of rivals,'' she said.

VAT slashed on textile products

Chief Minister Bhupinder Singh Hooda today reduced VAT on textile products and carpets, druggets, woollens, durries, cotton floor durries and rugs from 12.5 per cent to 5 per cent. This would benefit the traders to the tune of about Rs 150 crore.

Addressing representatives of various trade unions here today, Hooda assured traders that the government would favourably consider their demand for further relief in filling VAT-D 3 Form. He said the government had already increased the limit for this form from Rs 10,000 to Rs 25,000 .

The textile products on which VAT has been reduced included pillow covers sold with bedsheets, comforters, duvet covers, cushion covers, bolster covers and ready to use curtains.
