PCA finds suspended UT Sub-Inspector guilty in probe
Chandigarh, February 11 The Police Complaint Authority (PCA) while dealing with two complaints against Sharma simultaneously stated in the order today that Sharma had abused his powers and acted with mala fides and arbitrariness during inquiry as well as during investigation of a case when he was posted with the Economic Offences Wing. “The Inspector General of Police is requested to initiate regular departmental inquiry against SI Naveen Sharma for a major penalty on account of his arbitrary conduct and abuse of power during the inquiry prior to the registration of the FIR and in the investigation thereafter. It is also requested that the departmental inquiry may be handed over to a senior police officer preferably to the rank of Superintendent of Police for a speedy and fair inquiry.” The PCA also ordered that the investigation in the case be handed over to the crime branch. The complainants Sukhbir Singh Shergill and Jatinder Dua had filed separate complaints with the PCA against Sharma. An FIR dated April 19 was registered at the Sector 3 police station on a complaint of Raman Uppal. It was alleged that Shergill in connivance with Dua were involved in a major scam while setting up a private limited company. It was alleged that Shergill and others cheated Uppal of crores of rupees during the opening of a company, "Customer Related Management Services”, in Sector 9. It was alleged that the funds were being misused blatantly and properties were purchased by the accused. The market value of the properties was over Rs 300 crore. However, Shergill had claimed that Raman Uppal was never a shareholder of the company and the documents annexed with the complaint were false and fabricated since they did not constitute a part of the Registrar of Company Records. A case was then registered against Shergill and Dua after investigation by Sharma. In his complaint to the PCA, Shergill pointed out that he had already filed two criminal cases with the Mohali police against Uppal and the case registered against him was false and in retaliation. In a separate complaint filed by Jatinder Singh Dua, a question had been raised that the police had not yet registered a case despite an order by the CJM, Mohali. The second allegation in this complaint is about three vehicles of ICRMS Pvt Ltd having been illegally taken away. The PCA stated in the order that Raman Uppal’s allegations that all the papers relating to the incorporation of the company were forged and the forgery and fabrication continued thereafter make it amply clear that it was Mohali where the offences could have taken place. “The documents produced by Raman Uppal during investigation have been declared to be unacceptable by the Assistant Registrar of Companies and the comments on those documents are damning. He has minced no words while stating that the entire story of the complainant appears to be forged stated the PCA. |
