CBI notice to apex court’s Registrar General
Seeks records pertaining to prosecution sanction to former Justice Nirmal Yadav by December 8

The court of CBI special judge Vimal Kumar issued a notice to the Registrar General of the Supreme Court and the Secretary (Justice), Union Ministry of Law and Justice, to produce the records relating to the sanction of former Justice Nirmal Yadav’s prosecution before the court by the next hearing, scheduled for December 8.

On last hearing of the case on October 22, former Justice Nirmal Yadav’s counsel had moved an application for summoning the record relating to sanction for her prosecution.

In its reply filed today, the CBI said that the application moved by Nirmal Yadav was only an attempt by her to delay and drag her trial since this was not the stage for summoning and production of proof.

However in order to obviate any further delay and to ensure expeditious trial of the accused, the CBI said that it had no objection to the court’s summoning the documents or the records relating to the sanction for prosecution of Nirmal Yadav from the Union of India and the Registrar General, Supreme Court of India.

The CBI also submitted to the court the sealed cover containing photocopies of all the documents relating to the sanction for Justice Yadav’s prosecution in its possession.

It was on March 4, 2011, when the CBI had filed a chargesheet against Nirmal Yadav and four others under Sections 11 and 12 of the Prevention of Corruption Act (PCA), Section 120B (criminal conspiracy), Section 193 (related to false evidence) read with Section 192 (fabricating false evidence), Section 196 (using evidence known to be false) and Section 199 (false statement made in declaration) of the IPC.

Besides her, four other persons against whom the agency had filed a chargesheet were advocate Sanjeev Bansal, a Delhi-based hotelier, Ravinder Singh Bhasin, a Chandigarh-based businessman, Rajiv Gupta, and Nirmal Singh.

The case had rocked the Punjab and Haryana High Court after Rs 15 lakh was delivered wrongly at the residence of Justice Nirmaljit Kaur, another judge of the High Court, in Chandigarh on August 13, 2008, following which she reported the matter to the Chandigarh police.

2 killed in mishaps

Mohali, November 9
Two women were killed in road accidents near Mohali today. In the first accident, an Innova hit a motorcycle near Daon petrol station, injuring one Karamjit Singh of Bariali, while his wife Anita (28), who was riding pillion, died on the spot.

The couple's four-year-old child had a narrow escape.

Karamjit Singh was rushed to the Civil Hospital in Mohali.

In the second accident, Gafoora (42) was killed near Lakhnaur village when a truck hit her. The deceased was on foot.

Woman dies in accident

Zirakpur, November 9
A 37-year-old woman was killed in a road accident near Zirakpur on Thursday morning.

The deceased was identified as Anita Rani, a resident of Behlana village, Chandigrah. She was a teacher in a private school at Zirakpur.

The accident occurred when an unidentified vehicle hit the victim when she was trying to cross the national highway near flyover. She was admitted to GMCH, Sector 32, Chandigarh in serious condition. She succumbed to injuries in the hospital.

The police has registered a case against the driver of the unidentified vehicle under Sections 279 and 304 A of the IPC. The body of victim has been handed over to the relatives after conducting the post-mortem.
