Govt accommodation misuse Saurabh Malik Tribune News Service
Chandigarh, May 28 “Let an exercise of other properties owned and controlled by the UT Administration be carried out to find whether there are illegal unauthorised occupants staying there,” ruled Justice Rajesh Bindal. The UT Home Secretary, Anil Kumar, too, was present during the hearing. Before parting with the case, Justice Bindal asserted: “The Court be apprised of further action taken in this matter on or before the next date of hearing”. The Tribune had earlier reported that the Jammu and Kashmir government was “feeling helpless” in initiating action against the culprits. The UT Administration, too, was yet to explain under which policy were the houses given to the Jammu and Kashmir government. Miffed at the inaction on the part of the UT Administration to deal with the matter, Justice Bindal, on the previous date of hearing, had asked the Chandigarh Home Secretary to appear in person “to explain as to why the administration is sleeping over the matter, where it has been found as a matter of fact from a report furnished by the government of Jammu and Kashmir that persons are living unauthorisedly in the houses belonging to the Chandigarh Administration”. The Jammu and Kashmir government had earlier informed the High Court that about 60 houses in Sector 29-B, and in Sector 26 Bapu Dham Colony were “in possession of certain persons, which were initially given to the Jammu and Kashmir government”. Taking up the petition, Justice Bindal has asserted: “From the contention of the counsel for the Jammu and Kashmir government, it is apparent that the government is feeling helpless in taking appropriate action in accordance with law against persons who are in occupation of the government accommodation meant to be used as a night shelter during the period of insurgency in Jammu and Kashmir. “The fact is that the persons are in occupation of the properties for last more than 25 years, some of which have been sublet and have been sold as well." |
