PU students entitled to refund, rules HC
Chandigarh, January 12 The directions by Justice Augustine George Masih came on a petition filed by Puneet Nagpal and a fellow student against Panjab University and another respondent through counsel Aseem
Aggarwal The directions assume significance as the varsity was only adjusting the registration fee and development fund, instead of refunding the amount.
The petitioners were initially admitted to five years' BA-LLB (Honours) course under the NRI category, but were shifted to the general category later as seats became available. They sought adjustment or refund of the excess amount, as fee and other charges for the NRI category are higher.
As the case came up for hearing before Justice Masih, the varsity counsel maintained “there could only be an adjustment of the registration fee and development fund in foreign/PIO/NRI/ NRI sponsored/industry sponsored category. There could be no refund under any circumstance and the adjustment has also to be done within the same session”.
Allowing the petition, Justice Masih ruled: “Development fund and the registration fee has to be adjusted as the same are non-refundable. After such adjustment, the remaining amount, if any, due has to be adjusted from the other heads and if still some excess amount is due to the candidate/student, the same has to be refunded, which process has not been followed by the respondent-University in the present case….Non-refundable amount if allowed to be retained by the University would amount to undue enrichment by the university, which cannot be permitted….” Before parting with the order, Justice Masih asserted: “The petitioners are entitled to refund of the amount due, which has not been adjusted i.e. the development fund and the registration fee. The amount be adjusted/refunded to the petitioners within a period of 15 days from the of receipt of the order’s certified copy”. |
