HC upholds ex-servicemen’s appointment in Raj Bhawan

The Punjab and Haryana High Court has upheld the appointment of ex-servicemen on different posts in Haryana Raj Bhawan, by ruling that a high Constitutional functionary like the Governor has the option of choosing his personal staff.

In a curious move, the authorities concerned have fixed different eligibility criteria for posts of Medical Superintendent at three institutes in Haryana. Vacancies for three posts of Medical Superintendent (one each at Pt BD Sharma PGIMS, Rohtak; Shaheed Hasan Khan Mewati Government Medical College, Nalhar (Nuh); and Bhagat Phool Singh Government Medical College for Women, Khanpur Kalan, Sonepat), were advertised recently.

An aged woman (80) was allegedly murdered by crushing her under a tractor at Chimni village under the jurisdiction of Beri police station here late last night. A youth, who is the neighbour of the deceased, also suffered multiple injuries in the assault. Old enmity is stated to be reason behind the killing.

Kidney scam: 2 more witnesses turn hostile

It was yet another day of setback for the premier investigating agency in the infamous kidney scam of Gurgaon when two more witnesses turned hostile in the special CBI court today. Till now, seven witnesses have turned hostile.

New rules to check child marriage

Following an increase in the number of child marriages, the Haryana Government has notified new rules to check the menace. The Haryana Child Marriage Rules, 2011, recently notified by the Women and Child Development Department provide several powers and assign new duties to the Child Marriage Prohibition Officers (CMPOs).

Incidents of child marriage, particularly during mass marriage functions organised on special occasions, have also been taken into consideration while framing these rules.

The rules prescribe that the child marriage prohibition officer will involve all related departments such as Social Justice and Empowerment, Health, Education, Rural Development, Panchayati Raj, Women and Child Development, Police, Information and Public Relations and Revenue among others for better coordination in such cases.

The rules direct the CMPO to ensure that no child marriage is solemnised on occasions like “Akha Teej”, “Akshaya Tritya”, “Mahashivratri”, when marriages are solemnised en masse.

The child marriage prohibition officers have been empowered to initiate action against doctors or other professional, who are found issuing fake age certificates.

The CMPO will give wide publicity about the consequences of child marriage in local language and create mass awareness through films, hoardings, posters, pamphlets, loudspeakers, cultural programmes and advertisements and take a serious note of any form or means of glorification of child marriage and initiate appropriate measures, including legal action, against such persons or organisations responsible for glorifications. They will also coordinate with and monitor priests in their jurisdiction regularly to curb the practice of child marriage.

The CMPO will also educate and involve the owner or in charge of community centres, public buildings, banquet halls and marriage palaces. The CMPO will also create social awareness against child marriage and follow up all complaints or information related to child marriage.

Woman delivers baby in hospital compound

An expectant woman was forced to deliver the child in the compound of the local Civil Hospital here as “insensitive” doctors refused to admit her and sent her back for blood test.

A doctor reportedly refused to accept the blood report of the woman and asked her to undertake the test again for hemoglobin. However, by the time she could reach the laboratory, she got labour pains and delivered a baby boy outside the office of immunisation officers in the open.

Fortunately, a midwife, Shanti from Dhachar village, who accompanied her, conducted the delivery of Geeta (25), wife of Sandeep, with the help of some other women present in the hospital compound.

Geeta’s brother-in-law alleged that the doctors avoided her right from 
the beginning, maintaining that her hemoglobin was only 3 mg and the delivery was not safe. Later, she got her blood tested again and her hemoglobin came out to be 8 mg, but the doctor again refused to accept the report and forced her to go for test again.

A commotion was created as soon as she delivered the baby. The panicky hospital staff rushed to her with a stretcher and took her inside the hospital, said Suraj Kumar, a witness to the sordid incident.

Thought the staff took Geeta and the baby inside the hospital, there was no relief as the hospital did not have an incubator. The baby was then taken to Mahavir Dal hospital.

The Civil Hospital has been facing an acute staff shortage and is known for poor sanitation and did not even have incubators for newborn children.

The Deputy Civil Surgeon, Dr Amar Bajaj, said the doctor concerned could not anticipate that she would deliver the child so soon as her pregnancy was eight months’ old. He said confusion was also caused by the two blood reports, which mentioned the hemoglobin at 3 mg and 8 mg. An inquiry had been ordered and those found guilty of any lapse would face action, he added.

Lokpal must be free from govt control: Supporters

Rohtak, August 27
Hundreds of protesters claiming to be the supporters of Anna Hazare stopped a Panipat-bound passenger train for an hour in Rohtak today. A group of youths blocked the railway line on the Rohtak-Panipat section of the northern Railways near Subhash Nagar.

As the train stopped, youths holding National Flags raised slogans in support of Anna Hazare and against corruption.

The police on getting information rushed to the spot and persuaded the protesters to alight from the train and clear the railway track. A candlelight march was also taken out by the citizens in the evening.

Meanwhile, members of the Nagrik Samaj, Rohtak, a social body supporting the agitation launched by Anna Hazare and staging chain fast for the past 12 days at Sector 6 grounds here, has appealed to the MPs and the union government to bring a Bill ensuring total autonomy of the Lokpal in matter of its powers and functioning if the nation wanted to curb the menace of corruption.

At least seven members of the samaj observed fast on the 12th day in support of the stir by Hazare at Ramlila Grounds in Delhi. They said their fast would continue till the demand raised by Anna was met by the government.

The main focus of all concerned should be the Bill, which could ensure full autonomy to the Lokpal with no direct control of the government to appoint and remove the Lokpal. The office must be independent and free from any kind of control that was existent for other constitutional bodies like the Election Commission.

HISAR: Two protesters fasting in support of Anna Hazare were advised by doctors to break their fast in view of their medical reports. However, both Suresh Sharma and Swami Krishnanand, refused to break it till Anna Hazare continued with his fast in Delhi.

Indian Medical Association representatives also joined the fast. Hundreds of students of local colleges joined the protest at Old Government College grounds here.

KURUKSHETRA: Hundreds of representatives of various social and political organisations reiterated their support to Anna Hazare while 21 farmers under the banner of the Bhartiya Kisan Union observed one-day chain fast in support of Anna Hazare in front of Jindal House here on Saturday.

SONEPAT: Students of GVM Girls College and Hindu Tika Ram Girls College came out on roads and raised slogans in favour of Anna Hazare. Activists of the “Sanjha Kadam-Nari Network” from Kharkhoda reached here at Subhash Chowk to extend their support to volunteers sitting on a fast and organised a march in the town.

PANIPAT: A large number of shopkeepers, representatives of various trade unions and local industrialists observed a complete bandh on Friday.

HC upholds ex-servicemen’s appointment in Raj Bhawan

The Punjab and Haryana High Court has upheld the appointment of ex-servicemen on different posts in Haryana Raj Bhawan, by ruling that a high Constitutional functionary like the Governor has the option of choosing his personal staff.

Dismissing a petition filed by Gaje Singh Muwal and others against the State of Haryana and other respondents, Justice Ranjit Singh also passed strictures on the petitioners by observing they “have unnecessarily made an attempt to drag the name of high Constitutional functionary in this mean litigation”.

Justice Ranjit Singh added: “The challenge apparently has been made with some ulterior motive and design to just drag in the name of such high Constitutional functionary. In such like cases, the Court should and must not invoke its discretionary jurisdiction to interfere”.

Justice Ranjit Singh further added the appointments were made by requisitioning names from Headquarter, Western Command, Chandimandir.

In the petition, it was averred that the Governor gave approval for the appointment on contractual basis for a month, “which was likely to be made permanent on the basis of their performance and suitability”.

It was added the appointments were made to posts such as telephone attendant, house bearer, peon, cook and waiter. “The necessary qualifications and eligibility for such appointment have been ignored while making these appointments,” the petitioners added.

The respondents, on the other hand, asserted the then Governor, His Highness, Dr AR Kidwai, had favoured the services of retired Army persons in Haryana Raj Bhawan “since they were polished and well disciplined persons as compared to their civilian counterparts”.

Justice Ranjit Singh asserted: “A high Constitutional functionary like the Governor should certainly have an option of choosing his personal staff, which also ought to be of his choice in view of various VVIP dignitaries who are required to be attended to in the Raj Bhawan. A decision was accordingly made to employ retired Army persons for a good justifiable and valid reason….

“Even a pseudonymous complaint received in the Raj Bhawan was placed before His Highness, the Governor, wherein His Highness had observed that the recruitments were made after obtaining his approvals in the best interest of the organisation and for better functioning of Raj Bhawan. The complaint was directed to be filed. The justification given in making the impugned appointments is fully appropriate and relevant”.

Different criteria for 3 posts of Medical Supdt raise eyebrows

In a curious move, the authorities concerned have fixed different eligibility criteria for posts of Medical Superintendent at three institutes in Haryana. Vacancies for three posts of Medical Superintendent (one each at Pt BD Sharma PGIMS, Rohtak; Shaheed Hasan Khan Mewati Government Medical College, Nalhar (Nuh); and Bhagat Phool Singh Government Medical College for Women, Khanpur Kalan, Sonepat), were advertised recently.

However, for reasons best known to the authorities concerned, different eligibility criteria have been fixed for the same post at these state-run institutes.

For selection as Medical Superintendent at BPS Government Medical College for Women, Khanpur Kalan (Sonepat), the candidate is required to possess a recognised post-graduate medical qualification from a recognised medical institute and 10 years of administrative experience.

However, the aspirants for the same post at SHKM Government Medical College, Nalhar (Nuh), should have a basic university qualification included in the schedules to the Indian Medical Council Act, 1956, besides the Master of Hospital Administration or MS/MD or equivalent qualifications. Besides, he/she should have two years’ work experience as Medical Superintendent of a hospital with more than 500 beds or five years’ experience as Deputy Medical Superintendent. The aspirant should also have completed 10 years of service after MBBS and five years of service after MS/MD or equivalent qualification. Alternatively, professors of clinical departments at medical colleges of five years’ standing with experience of hospital administration are also eligible.

Things become even more complicated in the case of Pt BDS PGIMS, Rohtak. A person desirous of becoming Medical Superintendent here must have a basic recognised medical qualification included in the schedule to the Indian Medical Council Act, 1956, in addition to a Master of Hospital Administration, MS/MD or equivalent qualification.

The aspirants should also possess five years’ experience as Medical Superintendent of a hospital with more than 500 beds or 10 years’ experience as Deputy Medical Superintendent after MD/MS or equivalent qualification and should have completed 16 years of service after MBBS.

Or, the applicant may have five years’ experience as a senior Professor or an equivalent of Hospital Administration /Clinical Department at a medical college or institution recognised by the Medical Council of India.

The starkly different eligibility criteria have flabbergasted the medical community as well as experts on service rules. They maintain that due and clear-cut weightage has not been given to a post-graduate degree in hospital administration though the functioning of a Medical Superintendent is well within the realm of hospital administration.

Voters to prove identity at polling stations

The Chief Commissioner, Gurdwara Elections, has directed the voters to establish their identity at the polling stations at the time of poll for the SGPC elections to be held on September 18, 2011.

An official spokesman said the voters could establish their identity by producing the identity cards issued to them under the authority of the Election Commission of India but where such an identity card had not been issued or was not available for whatsoever reason, the voters could establish their identify by producing any of the alternative documents, including driving licences, Income Tax Identity (PAN) Cards, bank or post office passbooks.

The spokesman clarified that any document as enumerated above, which was available only for the head of the family, would be allowed for purpose of identification of the other members of the family and similarly any document in the name of any member of the family could also be used for identification of other members of the family, provided that the other member could be identified on the basis of such document. — TNS

80-year-old woman murdered

An aged woman (80) was allegedly murdered by crushing her under a tractor at Chimni village under the jurisdiction of Beri police station here late last night. A youth, who is the neighbour of the deceased, also suffered multiple injuries in the assault. Old enmity is stated to be reason behind the killing.

The deceased has been identified as Bhateri Devi while the injured, identified as Shri Bhagwan (27), has been admitted to PGIMS, Rohtak, where his condition is stated to be critical. The police has registered a case of murder against four persons, including a father-son duo and a woman, on the complaint of the deceased’s son, Subhash.

According to police reports, Subhash and Sukhi Ram had engaged in a verbal duel over some old issue on Friday morning. Both were pacified at that time by their family members but in the night around 11 pm, Sukhi Ram allegedly crushed the mother of Subhash under his tractor when she was sitting outside her house. Sukhi Ram also caused serious injuries to Shri Bhagwan by hitting him with the tractor, said the police.

Both the injured, Bhateri Devi and Shri Bhagwan, were rushed to Civil Hospital, Jhajjar, where Bhateri Devi was declared brought dead while Shri Bhagwan was referred to the PGIMS, Rohtak, due to his critical condition.

Jhajjar SP Patram Singh, DSP Rajeev Deswal, PRO Devender Dangi and other police officials along with forensic science experts today visited the spot and took stock of the situation.

“A case under Sections 302, 323/34, IPC, has been registered against Sukhi Ram, his father, Dharamveer Sngh, Ranjeet and Balkesh, wife of Sukhi Ram’s brother in this regard. Sukhi Ram and Dharamveer have been arrested while raids are being carried out to arrest another accused as well,” said the SP, adding that the tractor used in the crime had also been impounded from the spot.

Kidney scam: 2 more witnesses turn hostile

It was yet another day of setback for the premier investigating agency in the infamous kidney scam of Gurgaon when two more witnesses turned hostile in the special CBI court today. Till now, seven witnesses have turned hostile.

Prosecution witness Shahid, a resident of Meerut, failed to identify the main accused, Dr Amit Kumar, and other accused present in the court. He said in his childhood he had a problem in his kidney therefore he had got it removed. He said he had never seen Amit and other accused.

Another witness Sunil Basra, a resident of Jharkhand, said he had both the kidneys. He also failed to identify all accused.

The CBI court had framed charges against Dr Amit Kumar, his brother Jeevan Kumar, Dr Krishan, laboratory technician Manoj, middlemen Giyasuddin and Jagdish, nurse Linda, Dr Saraj and Dr Upender Aggarwal.

The racket was busted on January 24, 2008, after a joint team of the Uttar Pradesh and the Gurgaon Police raided a house in Sector 22 of Gurgaon. Dr Amit Kumar, who was later nabbed from Nepal, and his accomplices allegedly used to operate on poor and transplant their kidneys into NRI clients.

The CBI, in its chargesheet filed on April 29, 2008, had stated that the accused lured people to a private hospital in Gurgaon and other places, where their kidneys were removed and sold at higher prices to patients, including those from abroad.

Cases for removing kidneys were also registered against Dr Amit and Jeevan in Rajasthan, Maharashtra and Andhra Pradesh.
