HC orders interim bail for Yadav
Saurabh Malik Tribune News Service
Chandigarh, August 19 The high court made it clear that she would have to appear before the trial court on the fixed date for her anticipatory bail. Now, Justice Yadav has the satisfaction of getting interim relief from the high court. However, the conditional respite makes it mandatory for the former high court judge to appear in Sector 17 district courts as an accused in a corruption case - something she has apparently been avoiding since long. The single-page order, handed out by Justice Permod Kohli after hearing arguments for approximately 20 minutes today, says: “Notice of motion for September 7. Meanwhile, the petitioner shall be admitted to bail by the trial court on her appearance on the date already fixed in the case that is August 27, subject to her furnishing bail bond and surety to the satisfaction of the trial court.” A direct aftermath of the order is that Justice Yadav will not be able to avoid the shutterbugs and other lens men, as she appears before the court as any other common person facing criminal proceedings. Her attempt to avoid the media became somewhat apparent during the hearing of the bail plea as her counsel SK Garg Narwana sought the high court’s permission on Justice Yadav’s behalf to appear before the trial court through an advocate. After Justice Kohli showed no inclination to accede to the demand, Narwana asked the Bench whether she could appear before the courts below on any date before August 27. Again, the plea did not find favour with Justice Kohli as he reiterated the direction on her appearing before the court on the day fixed. The hearing also saw Justice Kohli verbally questioning the CBI on the need to arrest her and oppose her bail plea, even though the chargesheet in the matter has already been filed. Claiming innocence, Justice Yadav, in her petition through Narwana, earlier submitted that she had been implicated by the CBI. “The petitioner has been made a target of political vendetta as her brother is a Cabinet Minister in the Haryana,” her petition reads. Justice Yadav added that the chargesheet was filed the day she retired, “which shows the malafides and machinations of the politicians, bureaucrats and the CBI, who intend to defame and malign the reputation of the judiciary, as they always feel inconvenient and humiliated in the high court, whenever they are found to have misused their power for their personal benefits/gains.” |
Assembly messes up fact on Bhajan Lal
Chandigarh, August 19 The “mistake” that Bhajan Lal was elected to the Haryana Legislative Assembly eight times, as mentioned in the obituary resolutions, went unnoticed even as speaker after speaker from across party lines paid homage to his “greatness”. It was left to his younger son and sitting Haryana Janhit Congress MLA Kuldeep Bishnoi, visibly upset at the “carelessness” of the government in preparing the resolution, to point out that Bhajan Lal had been elected to the House not eight but nine times. Opening the brief day-one of the monsoon session, Chief Minister Bhupinder Singh Hooda read out the obituary resolutions, including that of Bhajan Lal. He urged the Speaker to adjourn the House as a mark of respect to the leader, stating this had been a convention the House had followed for former Chief Ministers. Listing out the various positions he held in his political career spanning over four decades, the resolution, among other things, said, “In his death, the country had lost a seasoned parliamentarian, an astute statesman and an able administrator.” While state president and MLA Ashok Arora spoke on behalf of the INLD, the leader of the Haryana Bharatiya Janta Party Legislature, Anil Vij, spoke for his members. Bishnoi, who spoke after them, began by saying that he too associated himself with the resolutions. Stating that he was pained to point out that the resolution of “jannayak Bhajan Lal” wrongly mentioned him as an eight-time MLA, Bishnoi charged the government of “misleading” the House. “He was elected to the House nine times, one being a byelection that he won. I condemn this resolution,” Bishnoi said. To this, Parliamentary Affairs Minister Randeep Singh Surjewala responded by saying that it was a typographical error and would be rectified. However, this failed to appease the agitated Bishnoi, who said such a mistake was not acceptable and found Vij’s support on the matter. Hooda, too, said the “mistake” would be corrected. Finally, Speaker Kuldeep Sharma, in an attempt to placate Bishnoi, said he should not violate the sanctity of a “solemn occasion” and the resolution cannot be made controversial. The House also condoled the death of former Arunachal Pradesh Chief Minister Dorjee Khandu in a helicopter mishap on April 30 this year; former Haryana minister Charan Dass Shorewala; former MP Rao Man Singh; former legislator Dharampal Singh; the July 13 Mumbai terror attack victims and others. It was adjourned till August 23. Meanwhile, Hooda unveiled a portrait of Mahatma Gandhi in the House of the Haryana Vidhan Sabha here today. He said Mahatma Gandhi was the voice of the nation who led the country to Independence and his efforts gave them the present democratic system. While describing Gandhi as the embodiment of high ideals, Hooda said Gandhi made great contribution in the freedom struggle and stressed for "Gram Swaraj". He was an apostle of peace, truth and non-violence and his values guide us even today. Faux Pas

Land mafia grabs dargah land
Hisar, August 19 A delegation of the samiti led by its president Harphul Khan Bhatti today met the DC and submitted a memorandum. It stated that under the patronage of influential persons and the police, members of the land mafia were grabbing the land which was under litigation. Permanent structures were being erected over the land and the police was not booking the culprits because of the political pressure. Bhatti alleged the self-appointed ‘Sajda Nashin’ of the dargah had fraudulently transferred the land on his name and had gradually sold it. When records were seen, it turned out that the land belonged to the Custodian Department of the state. — TNS |

Work out plan to allow mining in Faridabad, SC tells state
New Delhi, August 19 The three-member Forest Bench, headed by Chief Justice SH Kapadia, said representatives of the court-appointed Central Empowered Committee (CEC), the Ministry of Environment and Forests (MoEF), the state government and the private parties involved in mining should come out with a plan for rehabilitation of the areas affected by mining in the Aravalli Hills region over 40 years. According to the Haryana’s Additional Advocate General (AAG), there are 170 subsisting mining leases in 600 hectares in Faridabad, where the ban on mining is sought to be lifted. Allowing mining in limited areas of Faridabad and Gurgaon would be sufficient to meet the requirements of construction material for the next 20 years, he said. Senior counsel Ranjit Kumar, amicus curiae in the case, said those involved in mining had shifted their activities to Rajasthan and Gujarat following the ban on mining in the Aravalli region of Haryana. |
