Plea for pulling down Ranbir Hooda’s statue dismissed
Saurabh Malik/TNS

Chandigarh, August 13
A plea for pulling down a statue of Ranbir Singh Hooda in Shahabad Markanda has failed to find favour with the Punjab and Haryana High Court.
Dismissing with costs the plea filed by Shahabad Markanda resident Des Raj against the local municipal committee, Justice Mehinder Singh Sullar asserted “the appellant appears to be in the habit of filing such false applications with an eye to get unwarranted popularity”.

Ch Ranbir Singh Hooda, father of Chief Minister BS Hooda, was a freedom fighter and a member of India’s Constituent Assembly.

Justice Sullar asserted that the removal of the statue was sought on the ground that it had been put up by the committee on a disputed land for political reasons and was liable to be removed. It was added that the land did not belong to the committee, but a community of Shahabad Markanda.

Des Raj and Paras Ram had also filed a suit for restraining the municipal committee from interfering in the peaceful possession. But, their plea was dismissed with costs by the Trial Court on February 15, 2002. The appeal filed against the order too was dismissed on January 21, 2005.

Justice Sullar asserted: “The trial court has recorded a finding of fact that the plaintiffs have failed to prove the ownership as well as possession over the property in question and dismissed the suit. Not only that, the first appellate court has affirmed the impugned decision. The first appellate court has reiterated that the property belongs to the municipal committee.”
