Chandigarh, March 12 Calling for the adoption of “some extraordinary measure”, Justice Ranjit Singh also directed the state Advocate-General to inform the court within three months the “outcome of the proceedings”. Coming to the rescue of Phulla Ram, Justice Ranjit Singh asserted: “The petitioner is an unfortunate person facing sufferance due to careless and unhelpful attitude of the respondents. Perhaps, this is his fate because he is a son of a sweeper, who is no more. The petitioner is struggling to get his mother’s provident fund since 1996, the year his mother died.” Justice Ranjit Singh asserted that: “She was working in the office of the Haryana Tourism Corporation, Karnal. The petitioner, being the legal heir, applied for all benefits and completed the formalities. The respondents released the ex gratia amount of Rs 20,980 on February 19, 2001, but no other dues were released.” Justice Ranjit Singh added that: “The respondents not even cared to consider the case till the receipt of a legal notice dated July 2, 2007. “One can well imagine the plight of the petitioner. He would have made endless rounds to the office of the employer each time to be shunned to come later…. “The Regional Provident Fund Commissioner has also apparently failed to perform its legal and bounden duties…. The objections raised by the RPFC for not releasing the employee’s provident fund amount would sound hollow as can be seen… Frivolous nature of the objection is apparent. Gratuity and ex gratia have been paid to the petitioner. Still, he is being asked to produce succession certificate. No further time can be granted to the respondents. The respondent state would recover the interest from the employees’ concerned.” |
Ratia gets judicial complex
Ratia (Fatehabad), March 12 The double-storeyed judicial complex comprising four courtrooms has been constructed at a cost of Rs 2.74 crore. The complex also houses a litigant hall, a library, a case property room and all other necessary rooms. Justice Mittal said the credibility of the judicial system depended upon the fact whether people were able to get justice in time and at affordable cost. He said with this objective in mind, the High Court was in the process of appointing 94 new judicial officers in the state. The Justice said it was the endeavour of the Punjab and Haryana High Court that a judicial officer did not have more than 500 cases at a given time for speedier disposal of cases. Justice Mittal said 19 out of 21 districts of the state had their judicial complexes and those in Palwal and Mewat were under construction. Similarly, the construction works on judicial complexes in 18 out of 23 subdivisions was in progress, while such complexes have already been constructed in three subdivisions. Justice Mittal exhorted lawyers to come forward in eliminating social evils from society. He said poor litigants approached their counsels with great hopes and lawyers should perform their duties honestly to live up to their expectations. Justice Tej Pratap Singh Mann hoped that the new judicial complex would mitigate the problems of the common people and save their time and money in their pursuit for justice. The Additional Solicitor General of India, Mohan Jain, and Raj Kumar Tewatia, District and Sessions Judge, Fatehabad, also spoke on the occasion. Justice Rajesh Bindal and Justice RC Gupta, both judges of the Punjab and Haryana High Court, DC Vijay Singh Dahiya, Additional District and Sessions Judge SC Goyal, Chief Judicial Magistrate Mohinder Singh, Judicial Magistrates Ajay Prashar, Amandeep Diwan and Amit Sharma and SDM JK Abhir were also present. Virender Taneja, president of the local Bar Association, thanked the judges for the new judicial complex at Ratia. |
Using cuss words no crime, says Delhi HC
New Delhi, March 12 The ruling was given by a Division Bench of Justice Pradeep Nandrajog and Justice Suresh Kait on a petition of Krishna Pal Singh, a constable dismissed from the CISF, Unit IOC, Panipat. “...Our experience guides us that jawans do speak street language while communicating with each other and liberally spice queries with abuses,” the Bench observed in its ruling on Wednesday. The ruling came relating to an incident of December 16, 2002, when Krishna Pal Singh was involved in a spat with his senior, Sub-Inspector RL Pandit, who was the shift in charge of the CISF, Unit IOC, Panipat. While Singh alleged that Pandit triggered the spat and slapped him, the latter alleged that it was Singh who abused and assaulted him. A preliminary inquiry was conducted and Singh was suspended on December 17, 2002. Singh told the inquiry panel that on December 16, 2002, he was not feeling well and when his duty was over at 9 pm and his reliever did not arrive, he contacted Pandit over the telephone and wanted to know why the reliever had not come. “Singh was told by Pandit that he had requested Head Constable Davender Kumar to look after his post till a reliever was sent,” states the petition. Accordingly he left the duty place when Kumar came and went to Gate No. 1 where Pandit abused him by swearing in the name of his mother, he alleged. However, after an inquiry, Singh was given the penalty of compulsory retirement with full pensionary benefits. The Delhi High Court Bench, in its observation, said: “In the backdrop of the facts noted by us which has preceded the spat, the greater probability rests in the probable fact that when the petitioner reported at gate No. 1, Sub-Inspector RL Pandit, with the usual pleasantry uttered expletive language.” “Being unwell, the petitioner was in a little foul mood and did not accept the dialogue as the usual customary exchange of pleasantries, and this triggered off the spat followed by jostling,” the Bench said in its order. “We find that neither the disciplinary authority, nor the appellate authority nor the revisional authority have analysed the facts keeping in view the backdrop circumstances and the facts. The Sub-Inspector had deposed incorrect facts,” the Bench said. “Evidence suggests a mutual fight between Pandit and the petitioner which was triggered at the instance of Pandit,” said the Bench. The court dismissed the opinion of the inquiry officer as “purely surmises and conjectures” and ruled that Singh should be reinstated in service immediately and given full wages from March 10. The pension he had been getting since his dismissal would be treated as compensation.

Jats serve ultimatum on govt
Panipat, March 12 The committee has warned that if its demand is not met by then, Jats will launch a relay fast outside Jantar Mantar in New Delhi and will also gherao MPs for three days, beginning March 15. Speaking to mediapersons here today, state president of the youth wing of the committee Jagveer Singh Goyat said a decision in this regard was taken at a meeting held in Noida yesterday, which was attended by all senior leaders of the committee. He said the committee would “redraw its strategy” in case its demand was not accepted by the government. He said it had been decided in principle to ensure that the agitation was carried out in a peaceful manner. Meanwhile, the committee has praised Chief Minister Bhupinder Singh Hooda for supporting their cause. Fatehabad: Activists of the Jat Aarakshan Sangharsh Samiti blocked another railway track in the district today. The Jat activists sat on dharna on the Bathinda-Rewari railway track at Mehuwala village in the morning, bringing trains on this route to a halt. The ongoing dharna of the Jats at Gajuwala on the Ludhiana-Hisar railway track also continued today. Samiti leaders had announced in advance that they would start a dharna at Mehuwala from today. The police had made elaborate arrangements in view of the call given by the Jat activists. Speaking to mediapersons at the dharna site, Sube Singh Dhaka, general secretary of the Akhil Bharatiya Jat Aarakshan Sangharsh Samiti, said they would continue their agitation till the Central Government met their demand. |

Residents hold protest against boys’ kidnap
Faridabad, March 12 The police is still clueless about the whereabouts of the boys and the kidnapper. The residents raised slogans against the police and allegedly broke flower pots. Some of them allegedly threw stones at the police post. The protest continued for more than half an hour. According to the police, it has prepared a sketch of the kidnapper. The sketch has been drawn on the basis of a description given to the police by a sister of the victims. The sister (12), also a student of Green Field School where the victims study, was returning from school with the victims when a stranger accosted them. The stranger reportedly told them that their parents wanted him to accompany them to the nearby Bagrola village so that clothes could be purchased for them. While the girl refused to go, the three children went away with the stranger. The police said it had sent teams to Aligarh, Allahabad, Agra and Ghaziabad. The police is also working on the angle that the kidnapper could be one of the tenants of the family. |
5-month-old in jail for no fault of hers
Sirsa, March 12 He alleged that Maya was married to Raj Kumar of Sadewala village in this district for three years and her in-laws harassed her for dowry. The police had arrested Raj Kumar immediately after Maya’s death and his mother, the only other member in the family, was looking after the infant, Ritu. After villagers from Satbir Singh’s Ghoriwali village held a protest against alleged police inaction, the police arrested Savitri Devi on Wednesday and produced her before a court at Ellenabad. The judge remanded Savitri in judicial custody and she was lodged in a jail in Hisar, as the district jail at Sirsa does not have a women ward. The police said as Ritu’s father was already in jail and the little one’s maternal grandfather had refused to accept the child, they had no option but to send her to jail with her grandmother. The authorities in the Hisar jail said special care was provided to kids, who landed in jail with their parents or guardians. “We provide milk, dalia and other special diet needed for children in the jail,” said a jail official. |

Lecturer abducted from college campus
Jhajjar, March 12 The incident took place nearly an hour before the visit of Rohtak MP Deepender Singh Hooda to the college for inaugurating its two-day annual athletic meet. Though the MP reached Bahadurgarh as per the schedule, he had to go back after being informed about the incident. However, he directed the police officials to take all possible steps to trace the lecturer at the earliest. The lecturer, identified as Mohit Hooda of Rohtak, used to come to the college in his car daily from Rohtak. He was allegedly abducted when he was parking his car inside the college. The abductors were allegedly chasing Mohit from Rohtak, police sources said. No case has been registered in this regard. Jhajjar SP Sourabh Singh said police teams had been formed to trace the lecturer. |

Karnal, March 12 Manoj’s brother Naresh, who had waged a lone battle to bring the “killers” to justice, said the verdict would be challenged in the Supreme Court and he would ask the government to increase their security and hold the SP and the DGP responsible for safety and security of all family members. The apprehensions of Naresh and his sister Seema were not misplaced when Manoj and Babli, who were also under the police protection, were brutally killed by Babli’s family members. Additional Sessions Judge, Karnal, Vani Gopal Sharma had pronounced the death sentence to five accused, Gurdev, Baru Ram, Suresh, Rajinder and Satish, all relatives of Babli, and life imprisonment to Ganga Raj, a village strongman, on March 30, 2010. However, the High Court, in its verdict delivered yesterday, acquitted Satish and Ganga Raj and converted the death sentence of four others to life imprisonment. |
SYL canal to be made functional: CM
Yamunanagar, March 12 The Chief Minister, who was addressing mediapersons following a public meeting at Balegarh village here, said the state had its due share in the Ravi-Beas waters, which the state would get, and the Sutlej-Yamuna Link (SYL) canal would be made functional. In reply to a question on reservation, he said reservation was granted on the basis of economic and social factors. Therefore, the demand should be made in a peaceful manner, as blockades would hamper the process of development. |

Chandigarh: Announcing another incentive for anganwadi workers, CM Bhupinder Singh Hooda on Saturday said after marriage they could seek a transfer to a different place provided a vacancy existed and their request would be considered on
priority. The CM was addressing a gathering of anganwadi workers and helpers who had come to his residence to express their gratitude for increasing their honorarium He had announced a hike in their honorarium during the Assembly session. While the anganwadi workers will get Rs 5,000 per month, anganwadi helpers will get Rs 2,500 per month.
