HC upholds extension to PGI Director
Chandigarh, November 11 Dismissing a bunch of petitions, a Division Bench comprising Justice Adarsh Kumar Goel and Justice Ajay Kumar Mittal upheld the Central Administrative Tribunal (CAT) order of May 26, that had gone in favour of Dr Talwar. Several persons, including Dr Rohtas Kanwar Yadav, professor and head, department of radio-diagnosis, and BD Sharma, PGIMS, Rohtak, had challenged Dr Talwar’s appointment and extension. Dr Yadav had contended that the correct procedure was not followed in granting extension to Dr Talwar. CAT held that though there was a procedural irregularity in processing the matter by the Centre for extension to be given to Dr Talwar, the end of justice would not be achieved by quashing and setting aside the extension on procedural technicalities, depriving the institute of an eminent and experienced director already running the institute. CAT had also directed the Centre and the PGI administration to proceed as per rules to readvertise the post of professor/HoD cardiology and to complete the process of selection preferably within a period of six months and till then, Dr Talwar would continue on the said post. However, Dr Talwar had challenged the said direction. He had also impugned CAT directions, in which it had mentioned that Dr Yadav had a locus standi to challenge his appointment. CAT had also issued directions to the authorities concerned to strictly adhere to the prevalent practice of inviting nominations form various institutes in future for the post of PGI Director or to adopt proper procedure of inviting applications from eligible candidates through proper channel by giving wide publicity in reputed newspapers. Dr Yash Paul Sharma (additional professor and former head, department of cardiology, PGI) had also filed a petition challenging that Dr Talwar was occupying two posts. |

Colour blind cannot be constables: HC
Chandigarh, November 11 Taking up a petition by Neeraj and other petitioners against the Union of India and other respondents, the Bench of Justice MM Kumar and Justice Ritu Bahri ruled: “The general duty constables or the IRB constables have to perform variety of functions and colour blindness certainly affect their performance of duty.” The Bench asserted: “The short issue raised in the petition is whether a person suffering from colour blindness could be appointed to the post of a constable. After their selection for the post of constables, they were medically examined and found unfit on account of colour blindness.” “It is undisputed that the petitioners were selected for appointment as constables in the IRB. They were not elected as constables who were to discharge duties on executive side namely clerical work. The Central Administrative Tribunal (CAT) rejected their claim by placing reliance on the Punjab Police Rules, 1934,”added the Bench. The Bench further observed, “A perusal of the rules shows that civil surgeon is under obligation to conduct medical examination of every recruit before his enrollment. He will test the eyesight, speech and hearing of the recruit. If there is a tendency, which is likely to render him unfit or any other defect found during medical examination, such a candidate may have to be rejected being medically unfit.” “The rule further states that the conditions of the police services makes it necessary that the medical examination should be very strict. Once the rules provides for a strict medical examination then any defect of eyesight affecting the duties have to be recorded. Such a defect of eyesight may have to be considered as medical unfitness,” the Bench said. Dismissing the plea, the Bench added: “In the present case, the colour blindness of a constable selected in the IRB will certainly affect performance of his duty. We are in agreement with the view taken by the Tribunal that there is sufficient room in Rule 12.16 of the Rules to disqualify a person suffering from colour blindness for appointment to the post of constable in the IRB.” |

Chandigarh, November 11 The court has issued a notice to the Chandigarh police seeking its reply. Sukhmani Brar, accused of crushing to death two cousins on August 17, had surrendered before the UT police on August 18. Thereafter, she was released on bail on the same day. A case of causing death due to rash and negligent driving under Sections 279, 337 and 304-A of the IPC was registered against the accused on the statement of eyewitness Sarabjit Singh, a resident of Khuda Ali Sher. |

HC asks judges to pay surprise visits to jails
Chandigarh, November 11 The directions came during the resumed hearing of a petition alleging human rights violations and corruption among the staff of Karnal district jail. Advocate Navkiran Singh told the Bench of Chief Justice Mukul Mudgal and Justice Ranjan Gogoi that it was surprising to know not even a single complaint had been made by the inmates in the complaint boxes inside the Karnal jail in the previous four years. The Bench also issued directions that the complaint boxes should be provided in all jails. The case was further adjourned for January 18. |

Rape accused released on probation
Panchkula, November 11 District and Sessions Judge PL Ahuja while issuing the orders for his release also directed that the accused would serve his punishment for one year. The case dates back to September, 2009, when the victim, a resident of Kalka, in her complaint to the police alleged that accused Rajender had met her at railway station and took her to his house where he tried to rape her. She also alleged that the accused beat her up. The police had registered the case under Sections 323, 376 and 511. The counsel for the accused said that the court had acquitted his client from Sector 376 and 511 of the IPC, but had held him guilty under Section 323 of the IPC.

Chandigarh, November 11 Sitting in the courtroom, the girl said emotionally, “I have remained away from him for months and now, being with him, I feel very contented.” Bhupinder and his wife were residents of Hallo Majra. They eloped on September 27, 2009, and solemnised their marriage at a temple in Sunam, near Patiala. On the complaint of the girl’s mother, Anita Sinha, the police registered a case against Bhupinder under Sections 376, 366 and 363 of the IPC. During trial, she deposed in court that the girl had eloped and married Bhupinder on her own will. |

2 barge in flat, manhandle woman

Singh said they had received a complaint and were investigating the
case. He said complainant had some dispute regarding some payment to
be made to the former owner of the flat. Amrit alleged that two
persons knocked at the door of her house at 3.10 pm and told her that
they were bank employees and her flat was a bank property. When she
told them that she was alone in the house and they should talk to her
husband, the accused pushed her aside and entered into the house. She
said when she tried to raise the alarm, the accused fled.

Gang of robbers busted
Panchkula, November 11 The accused were planning to rob a deserted house in front of the Ruhani Satsang Bhawan, Paploha road, Kalka, and were also possessing lethal weapons, including a country-made 315 bore pistol, knives and iron rods kept in a Swift car bearing registration no. DL4C-AM 3901, parked the house. After getting a tip-off, the police team headed by SHO Mukesh Kumar gheraoad the house and apprehended three criminals. The accused have been identified as Dharambir and Satish both residents of Tikri Kalan, New Delhi, Neeraj, resident of New Jivan Nagar, Sonepat. The other two accused have been identified as Sajid, resident of Meerut, and Yash Pal, resident of Kishava Garhi. The police said gang leader Yash Pal directed Neeraj to stand at the main gate of the house with iron rod, and told Satpal and Sajid to keep an eye on the other members of the family. The police has registered a case under Sections 399, 402 of the IPC and 25-54-59 Arms Act. The police recovered .315 bore loaded pistol, one magazine of pistol 32 bore, two live cartridges of 7.65 kf from the spot. The police said the accused have confessed to committing a robbery and a case under Section 457 and 380 of the IPC had registered against them at the Kalka police station. The police said some of the accused had revealed that they were also involved in robberies committed at various places, including PS Nagloi, Delhi, Bahardur Garh, Rohtak, and Railway Sarai, Rohilla, New Delhi. SP today rewarded all members of police parties with commendation certificate and cash reward. |

Man held for gambling
Chandigarh, November 11 According to sources, Gopal Krishan, a resident of Samadhi Gate, Mani Majra was arrested from near Nirman Cinema in Sector 32 on Wednesday while indulging in gambling. The police recovered Rs 24,510 from him and registered a case under the Gambling Prevention Act against him. Stolen
Rakesh Kumar, a resident of Sector 12, told the police that someone had stolen his Hero Honda Splendor motorcycle (CH 03 Q 3350) from market in Sector 24 on November 4. Similarly, Anjali Khanna, a resident of Sector 22, lodged a complaint with the police alleging that her Honda Activa scooter (CH 03 P 4659) was stolen from Sector 17 on November 7. In another incident, Pawan Kumar, a resident of Sector 22, told the police that someone had stolen his Honda Activa scooter (CH 03 Y 9325) from Sector 22 on Wednesday. Three separate cases of thefts have been registered at different police stations.
Injured
Subodh Kumar, a resident of Bihar, was injured when he fell from a scaffolding at an under construction site in Industrial Area, Phase I, on Wednesday. He was admitted to the Sector 32 Government Medical College and Hospital. The police has booked contractors Harashpreet Kaushalon on charges of endangering life.
Snatched
Malwinder Singh, a resident of Sector 38 West, filed a complaint with the police alleging that two unidentified motorcyclists snatched his mobile phone from near grain market roundabout at Sector 39.
Haryana cop behind bars
A 24-year-old Haryana Police constable landed behind bars following a brawl at a restaurant in Sector 17 here a little after midnight. The SHO of the Sector 17 police station, inspector Jaswinder Singh, said the constable, Jaiveer Singh, a resident of Jind, was with the crime branch of the Panchkula Police on
deputation. The police recovered a .9-mm countrymade pistol with four cartridges from him, which he pulled out during the brawl to threaten a city resident. He told the police that he had bought the weapon from Saharnpur in Uttar Pradesh. Jaiveer was attending a party by a local advocate, in which he had a verbal duel with restaurant staff members and then with Atul Thakur, a resident of Sector 44 here. The police was informed about the incident, which reached the spot and arrested the accused. The police registered a case of wrongful restraint and criminal intimidation under Sections 341 and 506 of the Indian Penal Code and Sections 25, 54 and 59 of the Arms Act. The accused was produced in a local court today, which remanded him to judicial custody. |

Rs 80,000 burgled from 3 shops
Mohali, November 11 In Phase 3B market, burglars broke the front shutter of three shops at 3 am and committed burglaries. From Chaudhary Medicos, ` 18,000 and cosmetics were stolen and from Bah Di Hatti burglars took away ` 25,000 and from the third shop Sant Departmental Store ` 3,000 cash and grocery were found stolen. SHO Matour Tarlochan Singh said the CCTV footage at the departmental store was being used to track the suspects. Last year, a series of thefts had been reported from shops in Phase V market. In another incident, two motorcycle-borne youths snatched a gold chain from 65 year-old Paramjit Kaur, who was sitting in the front courtyard of her house in Phase VII here this evening. Before the woman could raise the alarm, the boys escaped. A juice vendor, who was standing near the house, told the police that one of the boys was wearing a helmet and other one covered his face. Earlier, GNPS-36 posted 197 runs for the loss of six wickets in the allotted 20 overs. Jaskaran Singh punished the rival’s bowlers to hit 78 off 41. His innings contained 11 boundaries and two sixes.
