Justice Yadav still not to hold court
Chandigarh, December 27 The roster of duties, scheduled to come into force from January 6 next year, clearly says Justice Yadav is not holding the court. She had recused herself from judicial work soon after the surfacing of her name in the “cash-at-judge’s-doorstep case”. The three-judge committee, looking into the matter, had given its findings that the cash, allegedly meant for her, but erroneously delivered at the house of another judge with similar name, was not bribe money. The committee had stated it was, as such, a case of judicial impropriety. Ever since the submission of the report by the committee to the Chief Justice of India, speculation on her fate was rife at the Bar. The fact that she is not holding the court even after the report’s submission suggests Justice Nirmal Yadav still has to clear her stand on the issue. Available information suggest the inference of judicial impropriety was drawn after the committee associated in its inquiry everyone directly, or even indirectly, connected to the matter. The committee had also taken the assistance of the other judge at whose house the cash was wrongly delivered. Her statement in the capacity of a complainant was recorded by the committee. In the inquiry, the committee had taken note of the fact that the bag containing currency notes was opened by the judge’s peon inside the house on her instructions. At the time of the incident, a section of media had wrongly reported that the bag was opened by the security guard. The fact that his role was limited only to calling the police at the behest of the judge is quite evident now. His presence in the inquiry was not even felt necessary by the committee. A salient feature of the new roster is that Chief Justice Tirath Singh Thakur has asked the high court judges to take up on priority basis the “cases relating to senior citizens, cases in which proceedings before the lower courts have been stayed and remand cases from the Supreme Court”. |
