The fate of a number of high-profile officials and politicians hangs in balance as a full bench of the Jammu and Kashmir High Court today kept its judgement reserved after hearing differing arguments of the CBI, the Kashmir High Court Bar Association and the state's Attorney General in a sex scandal case. The full bench comprising Justices Nisar Ahmad Kakru, Virender Singh and J.P. Singh wrapped up the proceedings after hearing arguments of CBI counsel Anil Bhan and AG Altaf Ahmad Naik.

The bench is to decide whether they have to first decide the points of conflicts in the conflicting judgements of a division bench, after which the Chief Justice constituted a full bench, or they will hear the case afresh, an argument advanced by the AG and opposed by the CBI as well as the bar.

The division bench of Justice Bashir Ahmad Kirmani and Imtiyaz Hussain on August 8 last year differed on the further course of action in the case, which has sent over 15 persons, including legislatures and IAS and IPS officers, behind bars. While Justice Kirmani observed that the CBI had left off many persons despite having evidence against them and asked it to proceed against them.

Justice Hussain said the agency should bring all material before the Chief Judicial Magistrate and he should take whatever action is deemed appropriate. The former kept the case before the bench, the latter had disposed it.

However, both judges did not bring their points of dissents on records, arguments over which have kept the full bench busy.

The CBI did not make its stand explicit when the bench asked its counsel what the investigating agency’s views are. Justice Virender Singh chided Bhan saying he was confusing the court instead of assisting them. Bhan had said the maintainability of the case could be challenged if the bench agreed to AG’s contentions that they could hear the case afresh.

Justice Kakroo asked him to make his views clear on the matter before them rather than making hypothesis. Recording CBI’s stand, Bhan said the bench “should refer the matter back to the Chief Justice to get question of differences formulated by the division bench” before the bench takes up the matter again. The bar’s views were largely on the same lines.

Gujjars lend support to stir in Rajasthan

Gujjars in Jammu and Kashmir have decided to openly support their counterparts in Rajasthan for their demand of granting ST status to the community.

The Gujjar community in the state today announced to start an agitation to show their solidarity with the Gujjars in Rajasthan.

Various leaders of the community while addressing a press conference in Jammu said that there was no course but to join the ongoing agitation launched by the Gujjars of Rajasthan for their ‘just, reasonable’ and ‘genuine’ cause of granting tribal status to the community.

“If the Gujjars of J&K and Himachal can get the tribal status way back in nineties, then why the Rajasthani Gujjars were being deprived for the same benefit ? said one of the leaders. He said “We are one race, one tribe having same socio-economic, cultural background, so treat us in the same manner ?

As part of their agitation the community has decided to join the ‘rail roko andholan’ and would stop rail traffic between Delhi-Jammu.

“We have decided to join the andolan and are going to stop the rail traffic between Delhi and Jammu from tomorrow,” said Mohd Anwar Chaudhary, state president of the Jammu and Kashmir Gujjars United Front, a political organisation working for the betterment of Gujjars in the state.

He said that the community had also been planning to stop milk, mutton, vegetables and other commodities supplied by the community in the state so as to motivate the central government to intervene in the matter of granting ST status to Rajasthani Gujjars.

The front also condemned the police firing on agitating Gujjars in Rajasthan and held the Rajasthan government responsible for the ‘killing of innocent Gujjars’ in Rajasthan.

“The government should immediately stop police repression and talk to the leaders of the agitation for arriving at an amicable settlement,” a Gujjar leader said.

Freed by Pak, imprisoned in state ‘formalities’

Three Indian prisoners belonging to Jammu and Kashmir, who walked to “freedom” on May 24 after languishing in Kot Lakhpat jail in Lahore for nearly two decades, continue to face verification by different agencies including the police at a Joint Interrogation Centre (JIC) in Miran Sahib near here.

The trio was projected as restored to their families by the district administration here yesterday. However, after performing the “restoration” ceremony in presence of the assistant commissioner (general), they were whisked away to the JIC for completing the remaining formalities, said official sources.

The three natives of the state — Mangal Singh, 35, of Channi Diwani in Akhnoor, Shahbuddin, 63, of Ari village in Mendhar (Poonch) and Parvez Ahmed Masoodi, 53 of Aripanthan Budgam were among 99 Indian prisoners including fishermen, who were released by Pakistan via Wagah on May 24.

Sources said, after their “restoration ceremony” at the deputy commissioner’s office here yesterday, jinxed relatives of the released prisoners have been shuttling from pillar to post to know about their dear ones.

They also met a couple of politicians, a Congress MLA and a MP, who assured to take up the matter with the authorities concerned, they added.

A senior police officer told the relatives of released prisoners that they would be released after President Pratibha Patil leaves the state, they said.

When contacted, DGP Kuldeep Khoda said, there were no hurdles in their release but there was a procedure, which had to be followed.

“It takes a little bit of time and after the formalities are over they would be restored to their families,” he added. “Since it’s related to the security let the agencies complete their formalities and requisite verifications,” said the DGP.

It may be mentioned here that Shahbuddin, Parvez Ahmed Masoodi and Mangal Singh spent 17 years, 16 years and 13 years, respectively, in Kot Lakhpat jail at Lahore. Since they had returned to the state, verification and other formalities could have been done at their native places, said a human rights activist adding that considering their services to the country and protracted sentence, the police and other agencies should have exhibited a human face.

Govt imposes Section 144 along IB

Jammu, May 27
The Jammu and Kashmir Government today imposed Section 144 of the CrPC on the movement of more than four persons along the international border and imposed a ban on the sale of combat dress in Samba district.

Saurabh Bhagat, district magistrate, Samba, has imposed a ban on the movement of group movements along the IB. He has also restrained private parties dealing in the sale, procurement, storage and stitching of Army combat dress cloth and readymade combat dress in Samba district for a period of two months, an official release said.

These steps have been taken in view of the reports of infiltration of militants along the IB and use of Indian combat dresses by infiltrating militants in Samba district, where a group of 15 militants are reported to have infiltrated after border firing on May 9.

The militants who used Army’s combat dresses, killed seven persons including four civilians. All authorised persons private/firm/shops dealing in such articles shall immediately inform in writing to the nearest police station details of their carrying on this occupation, the statement said.

All authorised firms shall sell these articles to the armed forces personnel after verifying their identity cards and noting down their names and unit number.

Police officers of the rank of assistant sub-inspector and above have the authority to check and inspect such registers on routine as well as for the purpose of investigations and inquiries. — PTI

Govt asked to preserve environment

The Environment Committee of the Legislative Assembly has called for coordinated efforts to conserve the environment and maintaining the ecological balance in the state.

The committee opined that natural resources including the water bodies and the environment were the most attracting features of state for tourists from across the world. It urged the government to make all out efforts to preserve them with full vigor, an official spokesman here said.

The committee that met under the chairmanship of MLA Dr Sheikh Mustaffa Kamal here yesterday and discussed measures related to environment, pollution control and other allied issues on the subject and suggested various measures for preserving the environment. It expressed concern over the degradation of the environment, conditions of water bodies and shrinking of forests in the state.

It observed that despite efforts made by the government, there was room for further measures at various levels. “There is a great need to educate general masses for saving the environment and natural resources and government should launch vigorous campaigns through seminars and other forms involving school, colleges, NGOs, environmentalists and intellectuals,” the committee felt.

Snowfall, rain bring temperature down

Snowfall lashed Pirpanchal ranges of Jammu and Kashmir thereby lowering the temperature in Rajouri-Poonch areas. Snowfall of four feet was recorded in Pirpanchal ranges in Poonch, the Met officials said. “This is also an area of concern as fresh snowfall has occurred during May,” they said.

Work on the Mughal Road connecting Poonch with the Kashmir valley through Pirpanchal ranges has been stopped in view of the snowfall.

Meanwhile, the residents of Rajouri got much needed relief from hot summer with rains bringing the temperature down. However, with rain splashing this township, the electricity was snapped off for more than four hours.

Residents were seen cherishing the cold weather. Some even pulled out their warm clothes to fight the unexpected cold.

“The rain has brought us much needed respite from the sultry weather. The dip in the temperature was so much that I had to put on the warm clothing. I am loving the cold weather,” said Jamsheed Malik, a resident of ward no 10.

“However, the electricity department spoiled our day by snapping off the power for more than four hours.”

There were reports of hailstorm, rain and dust storm from within this district and also from the neighbouring district of Poonch.

30 houses damaged in blasts

Over 30 houses were damaged due to blasts that were executed by the authorities engaged in the construction of a railway line at Banihal in Ramban district on the Jammu-Srinagar National Highway.

The police has registered a case of negligence against the company which has allotted the work to construct the railway station at Banihal. No arrest has been made so far in this regard.

Reports said officials of the company carried out blasts near Kaskoot to carve out a path for the construction of a road to connect the railway station. As the blasts were of high intensity over 30 houses were damaged.

Residents came out on streets and shouted slogans against the authorities and demanded action against the officers responsible for this negligence. They were also demanded compensation for the affected families.

Senior civil and police officers rushed to the spot and pacified the protesters. They assured to take action against the officers for adopting casual approach while conducting blasts in the sensitive area.

IRCON, the company that allotted the national project of laying railway line from Katra to Banihal, has allotted construction work of railway station to a private company. Without informing local people about their plans, officers of the private company conducted blasts early morning today near Kaskoot.

A case has been registered in this regard.

Pratibha visits Vaishnodevi

Jammu, May 27
President Pratibha Patil today offered prayers at the holy-cave shrine of Mata Vaishnodevi in Trikuta hills here during the last stage of her five-day visit to the state.

Flanked by state Governor S.K. Sinha, Patil and her family flew to Sanjichat helipad at Katra belt from Jammu and offered prayers at the shrine, official sources said.

“It was a call of Mata, that is why I am here with my family. Without goddess’s call, no one can reach her,” Patil, who was accompanied by husband Devi Singh Shekhawat, her daughter, son, son-in-law and grand children, said. They performed special ‘aarti’ and chanted prayers at the shrine.

Tight security arrangements were put in place, in and around the shrine, ahead of Patil’s visit with personnels of the Army, the CRPF and the police being deployed in the area in Reasi district. — PTI

Panel to probe hospital deaths

The government has constituted a committee to inquire into frequent deaths of patients in Lal Ded maternity hospital since January this year and submit its report within 20 days.

This decision has been taken in view of the media reports about frequent deaths taking place in the hospital, an official spokesman here said. The committee would also ascertain as to whether there was any negligence on the part of functionaries of the hospital, he added.

Dr Shahida Mir would be the committee head assisted by professor Dr Muneer Khan and Professor Dr M.A. Kamili as its members.

The hospital medical superintendent has been asked to provide all logistic support to the committee in conducting the inquiry. It would also suggest measures to be taken by the government in further improving the patient care in the hospital.

Cyber cafes continue with lax approach

Days after the terror strike in Samba, cyber cafes in the winter capital of the state are caring two hoots about the norms regarding verifying the identity of the users.

While prior to the Samba incident the cyber café owners didn't bother to ask for a photo identity card from the users, a section of them has now fallen in line, particularly the ones working under the banner of 'Sify iway'. These cyber cafes are seeking photo ID proof from the users and are noting down its details in their record. On the other hand, some cyber cafes are asking the users to merely jot down their name and mobile number in a register in the name of maintaining record. This lax approach of the cyber café owners defeats the very purpose of keeping record of the users, as a user may easily register a fake name and a mobile number and get away with it.

A three-year-old girl, Rutaba, was drowned to death when she lost her balance and fell into the Heeber nallah at Panzgam village in Kupwara yesterday.

In another incident, four passengers were injured when a vehicle in which they were travelling turned turtle at Waserkhatoo Kralpora, Kupwara. The injured were admitted to the hospital. — UNI
