The Jammu and Kashmir Government said today that grant of permit for the resettlement in the state under an Act of 1982 was under scrutiny of the Supreme Court but ruled out change in the status of evacuee property so far as its present ownership was concerned.

Just 48 hours before the third run of the ‘’Karvaan-e-Aman’’ bus to Muzaffarabad, militants struck in a big way in the valley, killing two leaders, attacking a police camp with rockets and injuring 17 persons overnight.

The security forces gunned down six heavily armed Pakistani infiltrators, including four foreigners, in Jammu and Kashmir early this morning.

No change in evacuee property status: govt

Srinagar, May 3
The Jammu and Kashmir Government said today that grant of permit for the resettlement in the state under an Act of 1982 was under scrutiny of the Supreme Court but ruled out change in the status of evacuee property so far as its present ownership was concerned.

Referring to different views expressed on this issue recently, an official spokesman said the Resettlement Act was passed by the state legislature in 1982. After receiving the assent of the Governor, it was referred to the Supreme Court for its opinion which returned the Act in 2001 without any opinion or remarks.

A writ petition was filed in the Supreme Court challenging the validity of the Act and the court has stayed operation of the Act in February, 2002, and the stay continues to be in vogue, the spokesman said.

The Act, he said, is before the apex court and it would be presumptuous to form an opinion about its validity.

He said the Act provides only an enabling mechanism to issue permits to citizens wanting to return to the state from areas under the control of Pakistan for permanent settlement. — PTI
