SC notice to Punjab Govt, varsities on CMC plea
New Delhi, December 10 A Bench of Mr Justice Y.K. Sabharwal and Mr Justice D.M. Dharamdhikari issued the notice after CMC’s counsel, senior advocate K. Parasaran said the court in an interim order regarding the admission to MBBS course had also protected college’s right to admission as a minority institution and the same be extended to PG courses also. He said as the court had referred the issue to a larger Bench while issuing the interim order on August 9, 2004 regarding admission to MBBS course, the same relief should be available to the college for PG courses till the matter was finally decided by the apex court. While posting the matter for further hearing on January 3, the court, however, restrained the college from holding the entrance test for PG courses, scheduled for January 14. The notice was also sent to the Medical Council of India. Prasaran said the necessity for the college to move the court had arisen because the process for admission to PG courses had already started and the date for the the entrance exam was accordingly fixed for
January 14. The CMC said its rights as minority institution were also protected in the Islamic Academy judgement of the apex court, exempting those
minority colleges from being included in the common entrance test, which had been following their own admission procedure for past 25 years. “For last many decades, students from the college were allowed to appear in the under graduate and post graduate exams conducted by the Panjab University and thereafter by Baba Farid University of Health and Sciences, Faridkot, established in 1998. During this period no objection was ever raised by these universities with regarde to the entrance test or admission procedure by the institute,” CMC said. |

New Delhi, December 10 Mr Azad maintained it was in deference to the Opposition’s wishes that the government had not kept any legislative business on the Lok Sabha agenda today and instead listed two calling attention motions which the BJP had specifically sought. He said the Opposition had raised this point as it was running out of issues on which it could pin down the government. In fact, Mr Azad charged that the BJP was speaking in two voices. In its meetings with the Speaker, he said, the opposition complained that the government was going ahead with its own agenda and was not allotting time for the issues which the BJP wished to highlight. But it adopted a different stance outside, accusing the government of not coming prepared with a proper official agenda. He said of the 47 official Bills which the government planned to table in this session, 11 were in the top priority list. These included six ordinances which have necessarily to be replaced with Acts in the ongoing session. The POTA ordinance has alrady been repealed and others will be taken up subsequently. The remaining Bills, he said, are only to be tabled in this session and then sent to standing committees for discussion. Mr Azad said the Opposition is equally to blame for the so-called lack of official agenda. He said the government was prevented from introducing any Bills in the last few sessions because of the continuous disruptions by the BJP. Consequently, no Bills could be sent to the standing committees for scrutiny. Reiterating that the government had a full agenda ahead, Mr Azad said the two Houses will take up the supplementary demands for grants on Monday while the Bill on the National Commission on Minorities Education will be
discussed in the Lok Sabha on Tuesday. |
New twist to seer case in SC
New Delhi, December 10 Refusing to pass any interim order on the petition filed in the name of Shankracharya by lawyer Kailash Chand, a Bench of Chief Justice R.C. Lahoti, Mr Justice G.P.Mathur and Mr Justice P.P. Naolekar directed advocate A.P.N. Giri, arguing on his behalf, to produced seer’s authorisation letter within a week and posted its hearing to Decmber 17. Senior advocate M.N. Krishnamani, who had been dealing with Shankracharya’s case in the trial court and his bail plea in the Madras High Court, produced a letter from the Kanchi Kamkothi Mutt, stating that except a counsel
representing his team, no other lawyer has been authorised to file any petition in the name of the seer. The letter was duly attested by the Valure Jail Superintendent, he said. Advocate Krishnamani said,”
We have no hesitation to say that the petition presented before the court is
mischievous, without any authorisation and, therefore, be dismissed.” On examining the letter of the mutt, when the court asked Advocate Krishnamani as to why it had the “thumb impression” of Shankracharya rather than his signature, he explained that as per the tradition of the mutt a ‘guru’ after being nominated as Shankracharya, is barred from putting his signature on any paper. Advocate Giri claimed that though there was consent of Shankracharya to file the petition, he could not get seer’s authority because he was restrained from meeting Shankracharya in jail by Virjendra Sarswati, who has allegedly occupied the mutt now. Advocate Giri sought time till December 16 to produce the ‘vakalatnama’ on behalf of Shankracharya to plead his ‘habeas corpus’ petition. As he sought a direction from the court to the concerned
authorities to grant him permission to meet the seer in jail, the Bench said he could file applications before the concerned judicial magistrate in Chennai and the Valure jail authorities in this regard. When asked by the media as how the ‘habeas corpus’ petition would lie when Shankaracharya had submitted to the authority of the court and even moved bail petitions before the trial court as well as the high court, Advocate Giri said he would prove how he was ‘illegally arrested’ in the Shankar Raman murder case. The petition moved by Kailash Chand in the name of Shankracharya, had alleged that the seer had become a ‘victim’ of vote politics in Tamil Nadu. |
Jammu-Poonch rail link ‘not feasible’
New Delhi, December 10 Minister of State for Railways R Velu told the Rajya Sabha that light and compact weapons like 9mm carbines and 9 mm pistols were also provided to the force personnel. To another question, Mr Velu said a survey for the construction of a new line between Jammu and Poonch via Akhnoor and Rajouri was conducted in March 1999 and updated in November 2000. As per the survey the cost of construction of 223 km-long line was assessed to be Rs 4,574 crore. Due to the constraint of resources and unremunerative nature of the project, it was not considered feasible to take up the work, he said. |

Ahmedabad, December 10 Bibi Bano had got around Rs 3.5 lakh compensation after she lost her husband, daughter and six other relatives in the massacre, which she had deposited in a bank and the accused person was allegedly demanding that money, the police said. “The accused person Tanvir Ahmed is absconding and we are trying to trace him out. As per the victim Bibi Bano’s complaint, he demanded money from her on several occasions and doused her in kerosene at her house and torched her on Tuesday afternoon,” the Vatva police said. Bibi Bano, who is being looked after by an NGO, said that Ahmed had been threatening her for several days regarding the money and she had also lodged a police complaint in this regard following which he was arrested and later released on bail. The victim, who had initially moved to a relief camp in the Shah Alam area of the city later shifted to a house in the Vatva area near her sister-in-law’s house and that is where she apparently met the accused person and got close to him, officials added. The Vatva police said that being a riot witness Bibi Bano was given a security cover by the state government but the guard had reportedly gone for lunch when the incident occurred. — PTI |

New Delhi, December 10 Talking to reporters, Mr Shastri said it was a very difficult decision to float a new political party but he had done so to protect the interests of soldiers, farmers and unorganised workers, which was being overlooked by both the ruling alliance and the Opposition. Refuting that he had left the BJP as he was not offered any major responsibility by the party, Mr Sahstri said if this remark had been made by any BJP leader it was “laughable”. He had completed about 25 years of political life and never longed for a post. “At least I cannot degrade myself to that level,” he added. Mr Shastri, elder brother of Mr Anil Shastri who is in the Congress, said the BJP needed to have a ‘chintan’ or introspection on why several leaders were leaving it. He said he had a long talk with Mr Advani on December 8 before seeking permission from him to leave the party. |

New Delhi, December 10 Opposing his application seeking permission to go abroad in the court of Additional Chief Metropolitan Magistrate Ravinder Dudeja, the CBI said, “evidence and material does point an accusing finger towards Chandraswami... and raise a serious doubt regarding his involvement in the assassination of Rajiv Gandhi.” Chandraswami, facing charges of illegal transaction of foreign exchange under various sections of Foreign Exchange Regulation Act (FERA) violation, had applied for permission to go abroad for two months ostensibly to give a discourse to his disciples. The tantrik was recently acquitted by Special Judge Dinesh Dayal in the St Kitts case filed by CBI. — UNI |

New Delhi, December 10 A Bench of Chief Justice R.C. Lahoti, Mr Justice G. P. Mathur and Mr Justice P. P. Naolekar told the counsel for the parties that a mutually agreeable mechanism should be in place within six weeks, otherwise its order of September 13 regarding the appointment of Boundary Commission would come into force. Senior advocate K.K. Venugopal, appearing for Assam, told the court that the state government was not ready to
accept any “pre-conditions” of the Union Home Ministry that the findings of the Boundary Commission, which the Centre proposed to set up, would be binding on it. However, counsel for Nagaland and Arunachal said the two states had no objection to have discussions on the issue with the Centre and to know its stand. |

Mumbai, December 10 Mumbai’s Municipal Commissioner Johny Joseph told reporters here today that nearly 8000 of the 44,000 illegal constructions identified across the city have been demolished in the past three days.
