No changes in service record, warns
SC New Delhi, July 29 “When the entry was made in the service record and when the employee in service did not make any attempt to have it corrected, any amount of evidence produced subsequently is of no consequence,” a Bench comprising Mr Justice Doraiswamy Raju and Mr Justice Arijit Pasayat said. The judgment came in a matter related to correction of the date of birth by a woman employee of the Uttar Pradesh health department, who had made a request for correcting her date of birth a few days before her superannuation. Setting aside the order of the Allahabad High Court allowing her petition for correcting the date of birth, the apex court said “a plea for correction of the date of birth should not be dealt with by the courts, tribunals or the high courts keeping in view only the public servant concerned (who had come before them)”. If such pleas were allowed in this manner, it would have a chain reaction and several employees would rush to the courts for seeking such a remedy. This would also affect the promotional avenues of the employees below, the court observed. Unless a clear case based on material facts was made for the correction of the service records within a reasonable time as provided under the rules, courts and tribunals below should not issue a direction on the basis of material, which made such a claim only “plausible”, it ruled. The courts below have to fully satisfy themselves that a “real injustice” had been caused to the person concerned and the claim for the correction of the documents was made as per the prescribed rules, the apex court said. |
Shinde blames Al Hadees for bus blast Mumbai, July 29 Speaking to mediapersons at his official residence ‘Varsha’ this afternoon after a high-level meeting to discuss the situation following the blast, Mr Shinde said the Al Hadees was formed by SIMI activists after the latter was banned in the country. Mr Shinde said the outfit was also backed by Lashkar-e-Toiba. — PTI New Delhi: The bomb blast in Mumbai took political overtones in the Rajya Sabha today with Shiv Sena member Sanjay Nirupam demanding the intervention of the Centre and the Congress vehemently opposing it. Raising the issue during Zero Hour, Mr Nirupam demanded Central intervention as the city police had failed to check terrorist activities, which were on the rise. Congress members said the Shiv Sena member was politicising the issue and was raising a matter which was a state subject. —

Security beefed up in
Delhi New Delhi, July 29 Security personnel had been deployed at the Indira Gandhi International Airport and the Safdarjung Airport, railway stations, ISBTs, Rashtrapati Bhavan, North and South blocks, where offices of most of the union ministries are located, other important government buildings and busy market places. The Indira Gandhi Airport was being looked after by the Central Industrial Security Force, but the Delhi Police had also cordoned off the airport area as an extra security measure, police sources said. Taking in view the sensitivity of the situation, the Delhi Police had called reinforcement from para-military forces to meet any emergency situation. The Metro Railway police had also been asked to keep extra vigil. Private security forces had been deployed on under construction metro rail tracks. Restaurants, guesthouses and other suspected hideouts of militants and other unwanted elements were being searched. The district police in sensitive areas like Central-North, North-East and South had been directed by the Commissioner of Police to keep extra vigil in the area and strengthen night patrolling. Beat constables had been asked to be in contact with their informers, the sources said. Meanwhile, barricades have been erected on roads and policemen searched vehicles. |

George New Delhi, July 29 Mr Fernandes assured the Lok Sabha that stringent action would be taken if any security lapse was found on part of the Army in connection with the July 22 terrorist strike on the Army cantonment. Mr Fernandes, who visited the Tanda cantonment on July 23, said an investigation had already been ordered into the incident. Mr Fernandes said a lesser-known militant outfit “Al Shuda Brigade J&K” had claimed responsibility for the incident, stating “the attack on the camp was carried out to protest visiting Pakistani opposition leader Maulana Fazl-ur Rehman’s remarks that the Line of Control should be converted into a permanent border and the Kashmir issue should be resolved within the framework of the Simla Agreement”. He said the identity of the three terrorists had not been established while the driver of the truck, in which they came had been taken into custody and was being interrogated. |

boycott New Delhi, July 29 The decision was taken at yet another meeting to formulate a coordination strategy in Parliament on various issues. The meeting was attended by representatives of the Congress, the Left parties, the Rashtriya Janata Dal, the Samajwadi Party and others and was presided over by CPM leader Somnath Chatterjee. Significantly, Rashtriya Lok Dal President (RLD) Ajit Singh, who had recently resigned as Agriculture Minister from the NDA government, also attended the meeting. The Opposition leaders decided to question Prime Minister Atal Bihari Vajpayee’s prerogative on the induction of any member in his Council of Ministers, particularly when the person concerned is under a cloud. |

Price issue delaying AJT deal New Delhi, July 29 Tabling the action-taken report on recommendations of the Parliamentary Standing Committee on Defence in both Houses of Parliament, the government said a special committee had now been constituted under the chairmanship of Defence Minister George Fernandes to facilitate accelerated procurement of the AJTs. “The proposal for the procurement of AJTs has been delayed due to an impasse in price negotiations,” the government said. “The committee has held a number of meetings and considered various options, on whose basis the government is keen to finalise the AJT deal”, the report said. The government said to improve flight safety measures, the IAF was in the process of procuring simulators for all its major fighter and trainer aircraft and helicopters. The simulators would be procured for MiG-21 bison upgrades, MiG-27, MiG-29, Su-30, Jaguars and transport aircraft like IL-76 and MI-17 helicopters. The proposals for the procurement of simulators are at various stages, the government said. The report said price negotiations for the purchase of the crucial AWACS system were also likely to start soon. It said after the completion of technical parameters, price negotiations were to start shortly. Without naming any country, the report said the clearance of one of the participating countries had not been forthcoming on a few crucial aspects. Under the programme, India is planning to mount the Israeli Phalcon airborne radars on a Russian IL-76 platform. The government informed the committee that price negotiations had also been opened with vendors for the acquisition of surveillance radar as part of measures to expand air surveillance cover in the country.

China sends reply on Arunachal ingress New Delhi, July 29 Replying to the queries of the MPs regarding the recent Chinese incursions into Arunachal Pradesh, Mr Sinha said since there were ‘different perceptions’ between the two countries on the Line of Actual Control (LAC) there could be a possibility for differences as there was no demarcation of border between the two neighbours. The two countries had struck an understanding that if there was any problem between the two sides on the LAC issue, it should be resolved through diplomatic channels without indulging in confrontation. But in Arunachal Pradesh, the Chinese side did not adhere to this and hence India had protested, Mr Sinha was quoted as saying by BJP spokesman Vijay Kumar Malhotra. |

India’s no to pipeline through Pak New Delhi, July 29 Union Minister of State for Petroleum and Natural Gas Sumitra Mahajan in a written reply said, “keeping in view the present state of bilateral relationship with Pakistan, the government is not considering any proposal for on-land natural gas pipeline transiting through Pakistan.” While India and Iran have agreed on the pipeline project, the two countries differ on the best way of laying it. While Iran favours overland pipeline through Pakistan, India has proposed a deep sea pipeline skirting the Pakistani shores. The minister said the India-Iran joint committee had constituted a joint technical sub-committee to explore all options to import natural gas from Iran. “The joint committee had decided to undertake an offshore feasibility study for the laying of pipeline from Iran to India outside the Exclusive Economic Zone of Pakistan,” the minister added. Pakistan, which hopes to gain a large royalty from an on-land pipeline, has offered guarantees for its security, but India is not satisfied. |

Govt acts on Chief Justice’s advice: Jaitley New Delhi, July 29 Mr Jaitley, however, said that setting up of the National Judicial Commission (NJC) could be an answer to a problem like this. The government had introduced the NJC Bill in Parliament during the Budget session. Talking to newspersons after releasing four publications of the Legislative Department of the Law Ministry, Mr Jaitley said even if any complaint of judicial impropriety was there, the government had a very little role to play as any remedial action could only be initiated by the Chief Justice of India. The government would only act on the advice of the Chief Justice as to what action should be taken in such matters, he said. It was not fair to draw an impression that the advocates related to judges practising in the same high courts were getting some kind of advantage unless there was a specific complaint, he said. The Bar Council of India (BCI) had yesterday released a list of 131 high court judges across the country, whose relatives were practising in the same court where they had been posted. |
CPM demands debate on misuse of CBI New Delhi, July 29 “The government has not till today made it clear as to why did the Prime Minister accept Mr Fernandes’ resignation and why did he again induct him. We do not accept the Prime Minister’s prerogative. Some moral accountability should be there,” senior CPM MP Somnath Chatterjee told newspersons here. Saying that he had no objection to a discussion on Tehelka in the Rajya Sabha, Mr Chatterjee pointed out that if such a debate was not held in the Lok Sabha it would be tantamount to an “affront” to the parliamentary system. Making a fresh demand for a discussion in Parliament on the “misuse” of the CBI, he said the CPM had already demanded the resignation of Deputy Prime Minister L.K. Advani. |
Cong objects
to PM’s advice to CAG New Delhi, July 29 Congress chief spokesman Jaipal Reddy said it was highly improper for the Prime Minister to give such advice. “It is against canons of public discourse,” Mr Reddy said. The Prime Minister had yesterday inaugurated a two-day conference of accountants general. The Congress spokesman said CAG was finding faults regarding defence purchases and the Prime Minister was trying to “moderate” the constitutional exercise. Puja New Delhi, July 29 A press note issued here today said the 4095/4096 Himalayan Queen would be augmented by an additional AC Chair Car coach from September 25 to October 30. The 4517/4518 Unchahar Express will be augmented by an additional second class sleeper coach from September 25 to October 30 from Ambala and September 26 to October 31 from Allahabad. According to the note, the 4645/4646 Shalimar Express will be augmented by an additional second class sleeper coach from September 25 to October 30 from Jammu Tawi and September 26 to October 31 from New Delhi. The 4035/4036 Dhauladhar Express will be augmented by an additional second class sleeper coach from September 26 to October 31 from Delhi and September 27 to November 1 from Pathankot. |

Variava, that any attempt to hold a single trial in the five separate cases, would not only defeat the cause of justice, but also prejudice the other accused persons, numbering nearly 500. Mr Yadav had sought clubbing of the trial in five cases, registered by the CBI in Jharkhand. His counsel Ram Jethmalani said since the allegation of criminal conspiracy in all these cases was of a common general nature, there would be a multiplicity of trial for identical offences. He also said that 58 witnesses in all cases were common. Mr Rohtagi submitted that the modus operandi of withdrawing money from different treasuries in the state by the accused might be of the same nature, but the transactions in each of the cases were different. |

Khalid progressing well after surgery Bangalore, July 29 Eight-year-old Khalid Junaid, who travelled on the Lahore-Delhi bus, is recovering after yesterday’s surgery at the Narayana Hrudayalaya, a hospital spokesman said. Khalid was operated after he had turned blue due to the heart defect in what had been described as a “highly complex surgery”. “He is doing fine in the intensive thoracic unit (ITU),” the spokesman said. Meanwhile Noor, the two-and-a-half-year-old Pakistani girl, who underwent heart surgery at the same hospital earlier this month, is expected to be discharged in the next few days. —
