Jerath’s response to fresh FIR

The registration of a fresh FIR about two weeks ago against Mr K.K. Jerath, former Chief Engineer of the UT Administration, nearly six years after an anonymous complaint was received by the Administration has raised more questions than it has answered.

The case has been registered on the basis of an enquiry conducted by the Vigilance Wing of the Chandigarh police which alleges irregularities in the provision and fixing of aluminium glazing of Block B of the Government Medical College and Hospital, Sector 32, here, which is said to have caused a loss of nearly Rs 27 lakh to the exchequer. Besides Mr Jerath, others named in the FIR include Mr A.S. Dhingra, Executive Engineer-cum-Superintending Engineer, Mr Yogesh Gupta, SDE now XEN, CITCO, Mr Ram Singh, SDE, Mr P.P. Chhabra, SDE, Mr Amarinder Singh Walia, Mr Tarsem Lal Singla and Mr S.P. Singh, contractors.

Mr Jerath has already lost his job as Chief Engineer and is facing trial in a number of cases for various alleged acts of omission and commission during his tenure in the Engineering Department. He told TNS here today that the new case was superfluous because the subject matter of the FIR had already been covered in a writ petition filed in the Punjab and Haryana High Court six years ago by a contractor.

The writ petition No. 3025 of 1997 which was filed on March 5, 1997 was decided by a Division Bench of the High Court consisting of Justice Amarjeet Chaudhary and Justice V.S. Aggarwal on September 1, 1997 which held that there was no merit in the writ petition which also contained allegations relating to the construction of Block C and D and also aluminium glazing work of block B.

It is also pointed out that the FIR has been registered on the report of an Inspector of the Vigilance Wing who cannot be expected to be familiar with technical requirements of the engineers. Instructions issued by the Central Vigilance Commission stipulate that a technical matter should preferably be inquired into by a technical officer.

Why these instructions were not followed by the Administration in this case is a mystery.

It was obligatory on the part of the enquiry officer to obtain the version of the affected persons before recommending any action against them.The FIR says that the vigilance enquiry report was submitted by Mr Gurdial Singh on December 2, 2002 while explanation of the affected persons was submitted to him on December 11, 2002. This means that the affected persons have been proceeded against ex parte without giving them a reasonable opportunity to them to explain their position.

Special concessions for PU students

Panjab University will give a special concession to students of honours schools in the undergraduate classes in affiliated colleges from the forthcoming annual examinations.

Students who could not pass the honours subject examination in the second and third-year classes can avail of the chance from the forthcoming examinations. Students opting for the honours school in affiliated colleges offer the subjects only in the second and third years.

The university will give a special chance to students of arts, science and commerce streams. The students, however, need to have secured at least 50 per cent in aggregate of the papers in the regular course. Students will be required to deposit an examination fee of at least Rs 5,000 per examination form and the required late fee as per university rules.

Importantly, the chance can be availed of by the students only in the year succeeding the chance in which they clear their regular examinations. The matter comes up for formal clearance by the Senate and will be done in anticipation of the approval by the Centre Government.

In another decision, candidates who have passed the honours school examination in science from the university will be allowed to reappear as private candidates in theory papers in which they wish to appear with a view to improve the previous result. The candidates will be allowed to reappear in the first, second or third-year examinations, simultaneously or separately.

A candidate will be given two chances within three years from the year of passing the BSc (honours school) examination. The candidate will appear in the annual or the semester examination along with the regular examination. A candidate who has passed M Sc (honours school in semesters) will also be given chances to improve his previous performance on a pattern as applicable for the MSc (annual examination) classes.

The change will be applicable from the forthcoming annual examinations onwards.

Another concession is planned exclusively for wards of employees in affiliated colleges on the pattern of concession for university employees. According to the proposal of Dr Dinesh Talwar, “ half-fee concession provided to wards of university employees may also be extended to wards of teachers of affiliated colleges on a par with university employees.”

Dr Amarjit Singh Dua, Principal Harmit Kaur and Principal B.D.Budhiraja have added to the resolution of Dr Talwar and the same comes before the university house for clearance.

It has, however, been clarified that the concession will be extended to wards only of in-service and confirmed employees of the university and its affiliated colleges. Employment certificate for the purpose will be issued by the heads of departments in case of university employees and principals in case of college employees. The funds on this account in the case of wards of employees of the affiliated colleges should be charged out of the College Development Council Fund.

Estate Office seeks non-existent transfer fee

And old couple is being reportedly harassed by the Estate Office. The couple, Mr Kashmiri Lal and his wife Mrs Phula Devi, own a shop-cum-office in Sector 31. The SCO is in the name of Mrs Phula Devi.

The Estate Office, due to some miscalculation, has demanded that Mrs Phula Devi deposit Rs 17. 82 lakh as fee for re-transfer. Mr Kashmiri Lal said, ‘‘We have not applied for transfer of ownership to anyone, not even in the family. We have even abstained from transferring the rights to our sons as to avoid any levy on an unearned increase. How the Estate Office reached this conclusion that the property has to be re-transferred is a mystery,’’ he added.

The couple had got a notice from the Estate Office asking for the money. Mrs Phula Devi had bid in an open auction for SCO number 35 in Sector 31 in 1975. Then it was auctioned off for Rs 51,000.

Now the Estate Office in its notice has told the couple that they faced eviction from the SCO. The old couple has no way of depositing the huge sum of money as they run the small SCO selling goods of daily needs.

The earning is just enough for the old couple to survive. No portion of the SCO is on rent which could enhance earnings, said Mr Kashmiri Lal. He demanded intervention from senior officials of the Chandigarh Administration saying they should at least read the file of the case and see who was behind it.

OSD to Sushma in great demand

Nobody in the PGI, not even the Director himself, is as sought after as the recently-appointed Officer on Special Duty (OSD) to the Union Health Minister, Mrs Sushma Swaraj, who runs his office permanently sitting at PGI.

The office of the OSD, Mr Rajinder Sikka, located at PGI’s Advanced Paediatric Centre, is the place for all those seeking personal favours , be it for their promotion, selection, seniority or any such matter.

Engagements of Ms Sushma Swaraj in city: Inauguration of Arts Block VI; Panjab University campus; 3 pm. Inauguration of National Institute of Nursing Education at PGI; 9.15 am. The XXV annual convocation of PGIMER: Bhargava Auditorium, PGI; 11 am.

Mr Sikka, a junior official in the Haryana PWD, had remained attached with her even during her stint in the Information and Broadcasting Ministry. ‘‘No doubt previous health ministers have also had their OSDs, who would come here on and off but it is for the first time that one of them is running a permanent office located at the PGI,’’ said PGI sources. In fact, Mr Rajeev Lakhera, OSD to the previous Health Minister, Mr Shatrughan Sinha, used to visit the PGI once in two months for a day or two.

‘‘Stationing a man permanently at the PGI, when everyone knows that he is the minister’s man, will only embolden the disgruntled elements, who are looking for personal favours and hitting out at people for their own vested interest,’’ remarked a doctor. PGI sources said any serious issues which need the attention of the minister, could be sent to her by the Director Office directly.

‘‘I fail to understand why my appointment should fuel this kind of speculation, as an OSD to the minister also sits at AIIMS in New Delhi,’’ he said.

The minister, apart from presiding over the convocation at the PGI would also inaugurate the National Institute of Nursing Education. Being her first visit issues like appointment of the Dean could be discussed.

Though the PGI is running Evening OPD, but majority of the faculty members feel that the difficulty being faced in keeping the show running should be brought to her notice.

Minister arrives

The Union Health, Family Welfare and Parliamentary Affairs Minister Sushma Swaraj tonight reached the city.

Ms Swaraj was received at the railway station by the BJP National Executive member Satya Pal Jain, BJP local President Yashpal Mahajan and Party General Secretary Purushottam Mahajan, amongst others.

Outcry against Bush war

The local unit of the Congress, led by MP Pawan Bansal and the Punjab Human Rights Organisation (PHRO) here today burnt effigies of the US President George W Bush and British Premier Tony Blair to protest ‘unilateral’ war on Iraq. The PHRO Chairman Justice Ajit Singh Bains, at a separate protest rally, urged the USA to immediately halt attacks on Iraq. Akali leaders, including former Mayor Harjinder Kaur and N. S. Minhas also addressed the gathering. Shamil Ahmed and Abdul Sattar, community leaders from Mani Majra and Burail, respectively, termed the attack as ‘goondaism’ of America.

Jacob asks Admn to update emergency services

The UT Administrator, Lieut Gen J.F.R. Jacob (retd) today asked his Adviser, Mr Virendra Singh, to work out a centralised ambulance requisition system.

Attendants of the patients at the Government Medical College and Hospital, Sector 32, narrated this problem to General Jacob when he made an unannounced visit to the hospital last night. At present besides hospitals various NGOs also run ambulance services. All these services have separate telephone numbers.

At a coordination meeting today General Jacob asked the Engineering Department to properly maintain the roads dividing Sector 38 to Sector 40 within one month. These roads were in bad shape with non-functional streetlights. These roads were earlier with the Municipal Corporation and had now been handed over to Chandigarh Administration for maintenance a few weeks back.

The General had also visited the Sector 39 police station where he found wireless system operators were not well trained to use the system. The Inspector General of Police was asked to arrange for their proper training. The IG was also asked to ensure proper maintenance of all police stations and their wireless and telephone logbooks

Finding low computer usage in police stations the General also asked the IG asked to train more cops on computer as last night the Administrator had found the computer room to be locked.

Also the General asked the Commissioner, Municipal Corporation, to devise a disaster-preparedness training programme for firemen working in the Chandigarh Fire Department. At present firemen are only trained in fire fighting programme. The disaster management would include the things like handling victims of earthquakes, stampedes and major accidents.

Liquor goes cheap

Once again, it is time for Bacchus lovers in the city to enjoy whisky and beer at low rates. Due to the annual stock clearance sale by liquor traders, all brands of whisky are available at discount, which varies between 30 per cent and 40 per cent. The variation is on account off brand pricing.

Each year, in the last week of March, liquor traders offer liquor on low rates, aimed at clearing stocks at the end of the financial year, when annual licences expire.

Traders who are unable to sell their stocks go in for distress sale as the trader who gets the licence for the next financial year does not have the capacity to lift the entire stock. In the trade, inventory is also very high.

Sources in the trade say consumers, while buying beer, should see the dates of manufacture as beer which is more than six or eight months old loses its taste.

Beer is being sold at a discount of Rs 15 per bottle. The price of light beer has dropped from Rs 45 to Rs 30 per bottle. Prices of strong beer and some premium brands have dropped to Rs 35 and Rs 40, respectively. Effectively, the price of premium brands of whisky has come down by Rs 100 a bottle, while medium and lower brands have seen a drop of Rs 75 to Rs 85 a bottle. In the lower brands, the drop per bottle is about Rs 70.

Traders are cutting costs and offloading stocks, says a source. All major vends in the city have put up big banners, announcing the new prices. Another source says buying a full case of whisky will fetch extra discount.

City dodges VAT for a while

The Chandigarh Administration will not implement the much criticised Value Added Tax (VAT) regime in the city on the scheduled date of April 1.

Well placed sources told Chandigarh Tribune that VAT will not be implemented in Chandigarh from the scheduled date. However, this does not mean that implementation of VAT has been put off indefinitely, they added.

Under the Reorganisation of States Act, 1966 Chandigarh Administration is bound to follow all rules and Acts of Punjab. In this case also, it has been decided to wait for Punjab to notify its Act on VAT, confirmed the Finance Secretary, Mr Karan Avtar Singh. Once Punjab does it, we will adopt it, he said.

Under the normal practice, once Punjab passes the Act through its legislature, Chandigarh can adopt the same for implementation here. Since Chandigarh has no legislature of its own, it has to adopt Acts from other states for implementation.

In Punjab, the bill for VAT is scheduled to be introduced in the Assembly but this needs to be passed followed by an approval by the Governor.

HUDA nets over Rs 4 cr in auction

The Haryana Urban Development Authority (HUDA) netted Rs 4.62 crore during an auction of 117 commercial sites in various parts of the town yesterday.

The auction of these booth sites, built-up booths, double-storeyed shop sites, shop-cum-offices and showrooms in Sectors 16, 19, 20, 21 and 26 and Mansa Devi Complex, Sector 5, got a lukewarm response.

Twenty sites were auctioned, fetching HUDA Rs 4.624 crore, compared to the total reserve price of these sites of Rs 4.025 crore. The auction of sites in Sector 19 got a good response, as did the sites in Mansa Devi Complex.

The sites in Sectors 16, 20, 21 and 26 fetched between Rs 1 lakh and Rs 3 lakh more than the reserve price.

Construction stopped on IAF request

Replying to a question in the Punjab Vidhan Sabha today with regard to the ban on construction within the municipal limits of Zirakpur, Chowdhary Jagjit Singh, Punjab Local Bodies Minister, said this had been done on the basis of a letter to the state government by the Air Force Station, Chandigarh.

He said the state government had set up a high-level committee to examine all aspects of the matter. Appropriate action would be taken on the basis of the committee’s report, he said.

He said demolition of any building had not been ordered. The Air Force had asked the Punjab Government to stop construction within 900 metres of the local Air Force Station.

Meanwhile, the discussion on the SYL canal would be held in the House on April 1 for two hours. The Budget session had been extended till April 2.

MC order on clearance of debris

Either get the debris lying in front of your house lifted through the municipal corporation at a nominal charge of Rs 50 upto 25 cubic feet and Rs 2 per cubic feet above that or face double the charges along with a penalty of Rs 500. An order to this effect has been notified by the Municipal Corporation of Chandigarh, invoking its newly enacted provision.

Residents may contact the corporation at phone numbers 711672 or 710670 extension 414. Complaints or demand for the lifting of the debris can also be sent to the Complaint Centre, Municipal Corporation Building, Sector 17.

A specialised complaint centre has come up after the corporation’s suggestion to create such a centre before starting a crackdown on the people to ensure cleanliness in the city.

The corporation has appealed to the people to come forward voluntarily and cooperate with the authorities to keep the city clean and avoid penalty.

Passport makes 23-yr-old an infant

Slipshod work of clerks at the Regional Passport Office here has not only caused inconvenience to a 23-year-old youth from Yamunanagar but can also land him into trouble.

On January 24 this year, Mr Mukesh Chauhan was issued a passport (E 3911708) that showed his date of birth as August 26, 2002. Thus, he has been shown as seven months old and, as per the passport, when the passport was issued he was just five months old. Ironically, the same page carries the recent photograph of him.

The Yamunanagar lad, whose original date of birth is August 26, 1979, says he has visited the office at least five times but to no avail.

Treasury to open tomorrow

With the financial year drawing to a close, the treasury will remain open on Saturday to aid the transaction of government money. The Finance Department will also function on Saturday. Official sources confirmed that the treasury would accept financial instruments of government offices.

Income tax authorities will decide tomorrow whether to remain open on Saturday.

Visit by CISF Director-General

A guard of honour was presented to Mr B.B Mishra, Director-General, Central Industrial Security Force, during his visit to the CISF unit at the Punjab and Haryana Civil Secretariat here today.

The Director-General took a round of the secretariat and also reviewed security arrangements. As per a press note issued by Mr Ajit Singh, Senior Commandant, Mr Mishra informed that a proposal had been sent to the Ministry of Home Affairs to change the name of the CISF since it was performing multi-dimensional duties. Man succumbs to injuries

Mullanpur-Garibdass, March 27
A 60-year old farmer of Mullanpur-Garibdass village, Hari Singh, who had allegedly been beaten up by his neighbours, succumbed to his injuries at the Kharar Civil Hospital this evening. Hari Singh, in his police statement, reportedly named Swaroop Singh, his two sons Surinder Singh and Sucha Singh and grandson Tejinder Singh.

The police has registered a case of murder. All the accused are said to be at large. The body has been sent for post-mortem examination.

The police had earlier registered a case of assault, but when Hari Singh died, Section 302 of the IPC was also slapped on the accused.

Police sources said there was old enmity between the two families and the two were engaged in a legal battle over a piece of land. However, the family members of the victim could not give any immediate reason behind the murderous attack.

As per information available, Hari Singh, who had gone to his fields to collect grass last evening, was attacked by the four persons with sticks and batons. Hari Singh received injuries on his arms, legs and lower abdomen and was rushed to the Kharar Civil Hospital in a serious condition. Mr Darshan Singh and Mr Charanjit Singh, sons of Hari Singh, claimed that they were eyewitnesses to the alleged attack.

“We saw that our father was being brutally beaten up by Swaroop Singh, Surinder Singh, Sucha Singh and Tejinder Singh,” alleged Mr Darshan Singh. He added, “When we tried to intervene, they started threatening us and later fled.” Mr Darshan Singh and his brother Mr Charanjit Singh had gone to the fields to bring back the grass which their father had collected.

Ms Naseeb Kaur, widow of Hari Singh, said, “When we took him to the hospital, he (Hari Singh) was unconscious, but we never knew that he was going to die”. The deceased is survived by his wife, three sons and two married daughters.

The police has booked a bank manager — Mr Manmohan Singh, and two others — Mr K.D. Sharma and Mr Anil Sharma, on the charge of defrauding the Land Development Bank of Rs 50,000 and the Central Cooperative Bank of Rs 1.8 lakh after preparing forged documents for seeking bank loans.

Two arrested: The police has arrested Ashok Kumar and Ami Chand from Bagwali village and seized 40 bottles of liquor from them.

Seven booked: The police has booked seven persons — Paramjeet Singh, Surinder Singh, Joga Singh, Dharampal, Rajinder Singh, Lakhbir Singh and Kuldeep Singh of Basaula village — on the charge of assaulting Dalel Singh.

1 lakh stolen: A resident of Chandigarh, Mr Dinesh Kumar Rathore, has reported that Rs 1 lakh was stolen from his car on Wednesday. According to his complaint filed with the police, he had gone to the HUDA office in Sector 6 to attend an auction of commercial sites and had left the money in a bag in his car. When he returned, he found the money missing.

Ex-Mayor’s mobile snatched

Two unidentified scooterists tonight snatched a GSM mobile phone from former Mayor Harjinder Kaur on the slip road between Sectors 22 and 35.

“I stopped on the way to ring up a friend to find out a shop and two persons came on a scooter and snatched my Panasonic mobile phone,” Ms Harjinder Kaur told Chandigarh Tribune tonight.

She said one of the scooterists kept the engine running while another leapt upon her phone and rode away on the scooter.

She said she gave a call for help to catch the thieves who ran away taking advantage of darkness as V-6 lights were not functioning.

Rs 3 lakh stolen from car

A briefcase containing Rs 3 lakh belonging to Mr Kulwant Singh, a scrap dealer and resident of SAS Nagar, was allegedly stolen from his Honda City car in Sector 30 here this evening.

As per information available, accompanied by his two nephews and a son, Mr Kulwant Singh collected the money from his agents in the Industrial Area. At around 9.30 p.m., they all went to the Sector 30 market to buy some sweets. The briefcase containing the money was lying on the seat of the car. When they returned, the money was missing.

A case has been registered.

Four AWOL commandos arrested

SAS Nagar, March 27
The police here today arrested four commandos from the III Commando Battalion, serving in the Commando Complex, Phase X, for being absent from duty for over two months. The police has registered a case against them on the recommendation of their Commandant under Section 29 of the Police Act.

Police sources said Satpal, Kashmira Singh, Paramjit Singh, and Ramcharan Singh, along with Nirmal Singh, who was arrested earlier, were put on election duty in Gujarat but failed to show up for duty. They were produced before a court in Kharar and remanded in judicial custody. TNS
