Kiran Deep

Chandigarh, June 12
Reacting to the attachment order of the Lahore bus (in which Prime Minister Atal Behari Vajpayee had visited Lahore in 1999), passed by a local court recently, the DTC authorities today moved a plea seeking release orders of the bus.

The court had ordered the attachment of the bus to recover compensation due to Shanti Devi, complainant in the accident claim case, who had alleged that her husband had died due to negligent driving by a DTC bus driver.

The DTC authorities in the application claimed that due to some mistake the bus was attached to recover the compensation amount which the DTC had to pay to Shant Devi. The authorities stated that the said amount had been deposited to Nazir of the court on May 4 this year.

Sources informed that the Union Ministry of Transport, took note of the matter after the news of bus attachment of appeared in newspapers. Sources also informed that the question regarding the non-payment of compensation in time was also considered. The ministry sought explanation from the Chairman and Managing Director of DTC in New Delhi over this issue.

When contacted DTC counsel in Chandigarh Mr N.S Minhas said today that the DTC had moved an application as it had already deposited the compensation amount. He also informed that the bus was not attached yet and was plying between Delhi and Chandigarh.

The local court had earlier passed the order of attachment of the DTC bus (DL-1-PA-3711), acting on the complaint of Shanti Devi and her two sons. The claimant, Shanti Devi, had filed a case against DTC, bus driver Mr Dina Nath, and the Insurance company. She had stated in the accident claim case that on April 24, 1999 her husband Gulshan Kumar, was coming home in Sector 37-C from Sector 23-D on his scooter. She alleged that when her husband reached near Sector 36- 37 dividing road, he was hit by a DTC bus (DL-1PA-2828.) The UT Additional Sessions Judge had directed the DTC and others to pay a compensation of 3, 75, 000 to Shanti Devi and her two minor son with interest at the rate of 12 per cent per annum from the date of institution of the case till its realisation. The claimants, Shant Devi and others, had filed the attachment order when they failed to get the compensation awarded by the court.
