Ensure canal water to farmers: Nehra SONEPAT, Dec 12 — Mr Azad Singh Nehra, president, human rights cell of the Congress, today accused the Indian National Lok Dal Government, headed by Mr Om Prakash Chautala, Chief Minister, Haryana, of misleading the farmers of the state on the issue of ensuring the supply of canal water to villages at the tail-end. In a press note issued here, he alleged that all canals, distributaries and minors had dried up and farmers were facing an acute shortage of canal water even during the rotation period. Cases of water thefts from canals with the connivance of ruling party legislators and other powerful leaders of the INLD were on the rise and the authorities were hesitant to take any action against them, he said. Mr Nehra pointed out that the water-courses constructed about 15 years ago had been damaged and the state government had failed to get them repaired. This, he said, had resulted in the serious shortage of canal water in them. He said the drought-like conditions prevailed in the districts of Sonepat, Rohtak, Jhajjar, Rewari, Mohindergarh, Faridabad and Gurgaon, whereas farmers of Sirsa and Hisar districts were getting adequate quantity of canal water as the Haryana State Minor Irrigation Tubewells Corporation (HSMITC) had spent the entire money in these districts which was allocated for the whole state. He said farmers of the district had completed the sowing of the Rabi crops, particularly wheat by running their tubewells through diesel generating sets as the state government had failed to ensure regular power supply. He decried the discrimination against the local farmers and those of the Rohtak district by the government and alleged that they were getting canal water for a week during the rotation period, whereas the farmers of Sirsa, Fatehabad and Hisar districts were being supplied canal water for 21 days in a month. Mr Nehra warned that if this sort of injustice was not stopped the farmers had no alternative but to launch an agitation. He demanded immediate and effective steps for ensuring regular power and water supplies to farmers of these
districts. |
HC censures Estate Officer, CA CHANDIGARH, Dec 12 — A Division Bench of the Punjab and Haryana High Court comprising Mr Justice Jawahar Lal Gupta and Mr Justice K.S. Garewal has come to the rescue of a purchaser of a shop-cum-office site from the Chandigarh Administration and in the process has passed severe strictures on the Estate Officer and the Chief Administrator (Finance Secretary). Mr Opinder Pal Singh and his associates purchased the site for Rs 63 lakh on December 18,1996, in an open auction. They paid Rs 15.75 lakh, constituting 25 per cent of the bid money within the stipulated period of 30 days. Though the allotment letter was issued in February, 1997, the possession of the site, which was not free from encumbrances, was not given to the purchasers. Ultimately, in October, 1997, the purchasers surrendered the site and asked for a refund of the money. Instead, the Estate Officer cancelled the lease and forfeited Rs 6.30 lakh. The purchasers’ appeal was dismissed by the Chief Administrator on December 22, 1998. The Adviser to the Administrator, Ms Vineeta Rai, partially accepted the revision petition filed by the purchasers. She observed that the Estate Officer did not act promptly in having a tree as well as an electricity pole removed from the site, which compelled the petitioners to surrender the site. “This inaction of the Estate Officer has resulted in avoidable inconvenience to the petitioners.” She reduced the forfeited amount from 10 per cent to 0.5 per cent. However, the petitioners were informed by the Estate Office that only Rs 2 lakh was payable and not Rs 31,500 as in terms of the Adviser’s orders. The petitioner then approached the High Court. While allowing the petition, Mr Justice Gupta, who authored the judgement, wrote: “The attitude of the
respondents (the Administration) appears to be — ‘We are in the wrong. Yet you will pay for it’. This is wholly unfair and arbitrary. Such an attitude cannot be accepted in any civilised society, much less than in a democracy, where people are governed by the rule of law and not men. The orders passed by the Estate Officer and the Chief Administrator were totally arbitrary. Even the order passed by the Adviser for the forfeiture of 0.5 per cent of the amount was wholly unwarranted. Why should the petitioners pay when they are not to blame in any manner whatsoever? Rejecting the contention of the respondents that before the auction a public notice was given regarding the location and lay-out of the site and it was for the petitioners to satisfy themselves before bidding for it, the Bench said while dealing with the state or any of its instrumentalities, “a citizen should be entitled to proceed on the assumption that the property shall be totally free from all encumbrances and that the possession shall be delivered without delay or demur.” The Bench also regretted that the Chief Administrator (Finance Secretary) had dismissed the appeal of the petitioners “in a wholly mechanical manner.” Accepting the petitioners’ plea that no ground rent and interest should be charged, Mr Justice Gupta observed:"
To say the least, it appears that the respondents have shown no regard for fairness or even the statutory provision contained in Rule 10 of the Chandigarh Leasehold of Sites and Buildings Rules, 1973. They have acted in a wholly arbitrary manner. The provision of the rule being totally clear, the claim for ground rent and interest is wholly untenable. The court ordered that the amount be refunded to the petitioners alongwith 15 per cent interest per annum within one month of the production of a copy of the court orders. The petitioners were also awarded Rs 10,000 as costs. Turning down the petitioners’ demand for 24 per cent interest, which is charged by the Administration from a defaulter, the Bench said: “We are not persuaded to be as unreasonable as the Administration is.” |

4 killed, 21 injured as bus, truck collide FARIDABAD, Dec 12 — Atleast four members of a marriage party were killed and 21 others injured in a bus-truck collision near Hodal town in the district last evening. According to information, the bus carrying a marriage party collided head-on with a truck near Hodal town, about 30 km from here. The bus was on its way to Indroli village in Rajasthan. The deceased have been identified as Arman, Jayram, Munshi and Isloob, conductor of the bus. The condition of some of the injured is stated to be critical. The injured have been admitted to the Badshah Khan Hospital here. A case under Sections 279, 337, 338 and 304-B of the IPC has been registered. No arrest have been made so far. |

Inspector’s bail plea
rejected KAITHAL, Dec 12 — The Additional District and Sessions Judge, Mr R.C. Gupta, today rejected the anticipatory bail application of Inspector Jai Singh Dahiya, an accused allegedly involved in the paddy purchase scam, which caused huge losses to the exchequer, following which a case under Sections 409 and 420 of the IPC was registered against him, a commission agent and other officials of the Food and Civil Supplies Department. It was alleged by the prosecution that the inspector had fraudulently shown the purchase of 35,000 quintals paddy in connivance with some rice millers and commission agents on November 10 last. During the course of hearing of the bail plea it was also pointed out by the prosecution that in a statement sent to the DFSCs office on November 10 evening the paddy purchased on behalf of the DFSC, Kaithal, was shown at 28,000 quintals and subsequently some more entries were made in the records. This figure was raised to 54,000 quintals. The paddy figures shown to have been purchased subsequently were actually out of the earlier purchases which were made from the farmers on a much lower price. After showing this purchase at the rate of Rs 540 per quintal the profits were shared by traders and the Food and Supply Department officials. On the other hand, it is learnt that Inspector Jai Singh Dahiya was earlier booked under Section 409 and 420 of the IPC in 1995 and a case was since pending in the court. Following this case the said official was suspended. Strangely enough, he was again posted as Inspector at the P.R. Centre and assigned the duties of purchasing paddy on behalf of the Food and Civil Supplies Department. Again, he was charged in the case booked against him and suspended by the government. In the meantime another Inspector of this department, Mr K.D. Sharma, has also reportedly been suspended after being indicted by the Vigilance Bureau following an inquiry against him. According to the latest reports, the police had got incriminating documents and strong evidence in the paddy purchase scam against the Food and Civil Supplies Department officials and some traders who were allegedly involved in this scam. But it is reported that the government has ordered a vigilance inquiry in this case, which has raised many an eyebrows. It is generally believed that all this is being done to please some officials and traders who had established contact with the state’s ruling party leaders. Some BKU leaders and farmers have expressed resentment over this development. |

Guidelines on village panels cleared CHANDIGARH, Dec 12 — The Haryana Cabinet, which met here today under the chairmanship of Chief Minister Om Prakash Chautala, took some important decisions, including approving the guidelines worked out for the functioning of the village development committees (gram vikas samitis). According to an official press note, under the guidelines the VDCs will get development works done with funds of the Haryana Rural Development Fund Administration Board as well as from other schemes of the government. The right to utilise Gram Nidhi will remain with the gram panchayats as per the existing practice. A separate bank account will be operated in a nationalised bank or a central cooperative bank in the name of the Gram Vikas Nidhi. This account will be operated by the president (sarpanch) and any two members of the VDC authorised by the Gram Sabha. Withdrawals can be made by the president and either of the two authorised members. The VDCs will inspect development works and arrange material and labour for these. The VDCs will authorise three of its members to purchase the material from the market at a reasonable rate. The condition relating to the purchase items after obtaining three quotations, as in the case of government departments, will not be applicable to the VDCs. Withdrawals from the bank will be made on the basis of the resolution passed by simple majority in the VDCs. The amount will be withdrawn in three or four instalments without the permission of the Social Education and Panchayat Officer or Block Development officer or Subdivisional Officer (Civil), as in the case of rural funds. The VDCs will record details of the proceedings, consumption of material and muster-roll in a register. There will be a separate cash book for the rural development fund. The members of the committee will be responsible for the judicious use of funds. The engineering wing of the Panchayati Raj Department will provide technical guidance to the VDCs. The junior engineer concerned can be called by the VDCs as and when required. After the completion of a piece of work, the VDCs will submit the entire records concerning the project to the office of the Block Development and Panchayat Officer (BDPO) concerned. The BDPO will send an attested copy of the utilisation certificate given by the VDC to the department/organisation which had given the funds. It will not be mandatory for the Gram Vikas Samiti to maintain a measurement book, but the details of the material purchased, and labourers and masons employed will be entered in the register. The Cabinet today also approved the state government’s Right of Way (RoW) policy and agreement for laying of the communication backbone to encourage distance education through information technology (IT) tools, IT enabled services for providing large-scale employment and for taking the Internet to the rural areas. The policy makes Haryana the first state in the country where each infrastructure provider will offer 10 per cent cashless equity in the company laying the backbone to one of the designated organisations in the state, an official press note said adding that the Secretariat for IT, Haryana, would act as a nodal agency for facilitating the grant of RoW permission in the state. The Cabinet also approved the proposal of the Public Works (B & R) Department to stand guarantee to obtain a loan of Rs 150.53 crore for the Housing and Urban Development Corporation (Hudco) for the second phase of the project for the improvement of major district roads and other roads in the circles of Hisar, Rohtak, Bhiwani and Jind. The Cabinet also gave its approval to transfer 7.94 acres of land of the abandoned Delhi sub-branch to Delhi Metro Rail Corporation Limited at a rate of Rs 88 lakh per acre for the construction of the Metro Hazari -Trinagar section. The Cabinet also approved the proposal of the Revenue Department to allot land to Hafed, the Agro-Industries Corporation and the Haryana Warehousing Corporation for the construction of godowns. The godowns will be used to store crops. The Cabinet also gave its ex-post facto approval for increasing the authorised share capital of the Haryana Power Generation Corporation from Rs 5 crore to Rs 155 crore. |

Govt urged to lift ban on recruitment ROHTAK, Dec 12 — The meeting of the executive council of Maharshi Dayanand University convened after a gap of nearly three years settled several controversial issues yesterday. After attending the day-long meeting of the council, the newly appointed Registrar, Dr Satpal Singh Dahiya, said in a press conference that the Vice-Chancellor, Major-Gen (retd) Bhim Singh Suhag, had been authorised to fill the vacant posts of Finance Officer, Architect, System Analyst and Technical Adviser to the Vice-Chancellor along with those of teachers in different departments on contract basis. The council requested the state government to lift the ban imposed on appointments through the Education Secretary, Mr Prem Prashant, who was the representative of the government at the meeting. As many as 14 members of a total of 20 were present at the meeting yesterday. The Registrar said the services of 17 watchmen appointed during the tenure of a former Vice-Chancellor, Lieut-Gen (retd) O.P. Kaushik were regularised on the demand of the Non Teaching Employees Association of the University. Mr Balwan Singh Suhag was approved to be appointed as Legal Adviser of the university. The Vice-Chancellor was authorised to take the final decision regarding the restoration of services of an Assistant Security Officer, Balraj Singh, whose services were terminated on the charge of producing bogus degree certificate of graduation for employment. |
Four policemen suspended PANIPAT, Dec 12 (PTI) — Four police personnel have been placed under suspension by Mr Kuldeep Singh Sihag, SP, for allegedly taking bribes from the vehicle operators at UP-Haryana border check post. The suspended police personnel included Head Constable Jai Bhagwan and sepoys Vinod, Bijender Singh and Himat Singh. They were found guilty of extortion in an enquiry conducted by DSP Baljit Singh Rathi. The enquiry was ordered by the SP when he received several complaints from the vehicle operators. Meantime, a Samajwadi Party legislator from Uttar Pradesh has also reportedly lodged a complaint with the SP, Panipat, and the IG, Rohtak police range, against the alleged misbehaviour of police personnel with his relatives at the same check post a few days back. |

Police whisks away fasting employee Chandigarh, Dec 12 — Even as Ms Raj Kumari, who was on an indefinite fast as part of the Haryana employees’ protest against the state government’s alleged reluctance to revert reserved category employees promoted after March 1, 1996, was whisked away by the Chandigarh police last night when her condition was found to be deteriorating, another employee, Ms Meenaxi Sharma of the DPI’s office, today volunteered to sit on fast. Ms Raj Kumari has been kept at the Sector 16 hospital here, a police official of Chandigarh said, adding that no case had been registered against her. Ms Promilla Sharma was on fast before Ms Raj Kumari. Ms Promilla Sharma was preceded by Mr Prithwi Singh Layal. While Mr Prithwi Singh was arrested and sent to Ambala jail by the Panchkula police after he decamped from the Sector 16 hospital, Ms Promilla Sharma is still recuperating at the hospital. The agitators, who had resumed the pen-down strike from the afternoon of November 16, today once again held a protest rally in front of 30-Bays building. It was addressed by employees’ leaders from Punjab, including Mr Shyamlal Sharma. Mr Sube Singh Yadav, an employees’ leader of Haryana, who had gone underground following a case registered against him under ESMA, made a surprise appearance at the rally in the morning when he also addressed the gathering. The agitators cited the Punjab and Haryana High Court order yesterday asking the Education Department of Punjab to implement the decision of the Supreme Court in the Ajit Singh Janjua case, and alleged that the Haryana Government was discriminating against the general category employees by dilly-dallying on the issue. The Haryana Government had initially reverted seven under-secretaries belonging to reserved categories as superintendents by taking a cue from the Supreme Court order in the Ajit Singh Janjua case. However, it stayed the order allegedly due to a contempt petition filed in the apex court by the affected under-secretaries against the state government’s interpretation of the court judgement. Even after the contempt petition was dismissed by the court, the state government did not implement its earlier order allegedly in view of a directive given by the court that the reserved category employees could challenge the interpretation in the high court. Subsequently, the affected under-secretaries moved the high court by filing a petition. The hearing of the case started on November 27 and it was being heard on a day-to-day basis. The state government is maintaining that it will go by the court order on the reversion of the reserved category employees who were promoted after March 1, 1996. So far, 55 employees have been dismissed by the Haryana Government for participating in the strike and 21 have been arrested under ESMA and the CrPC . Eighteen out of the 21 arrested employees have obtained bail so far. The agitators alleged that today also Mr Ram Kumar, an employee with the Architecture office, was arrested by the Haryana police from near the venue of the rally when he was returning to his office after giving a speech to the strikers. |

cash card scheme SONEPAT, Dec 12 — The Department of Telecommunications has decided to introduce a cash card scheme from December 15 for the benefit of telephone subscribers. According to official sources, the subscribers can dial anywhere in the country and abroad by using their confidential code under this scheme. The subscribers, in turn, will not be charged separately but will be told by the department officials about the amount outstanding in their cash cards. The cash card will be of the denomination of Rs 100, Rs 200 and Rs 500 each and these will be valid for six months only. These cards will be renewed by the department after the amount is ended.

Talking to The Tribune, Mr Krishan said his priority will be to accord “service to the people”. “We will be doing everything to improve upon the services,” he said. Regarding the Rajpura train accident, Mr Krishan said not that safety is lacking but one has learnt from the accident. “I will be visiting the accident site tomorrow,” he said. A number of senior railway officials, including the Additional DRM, Mr Ashwini Kapoor, and Senior DCM, Mr Sanjay Goel, were present at Ambala Cantt railway station to receive Mr Deepak Krishan. Immediately after getting down from the 2925 Paschim Express, Mr Krishan headed for the Railway Officers Rest House from where he proceeded to the DRM office. It may be recalled Mr Vijay Kumar, has already proceeded on leave after the Rajpura train accident. On December 3, the Railway Minister, Ms Mamata Banerjee, had given a dressing down to railway officials while on a hurricane visit to the accident site. She had also reportedly asked why the track had not been inspected despite an order in this regard by her three months back. Ms Mamata Banerjee had also expressed her annoyance at the frequency of accidents in the Ambala division apparently alluding to the Khanna train accident. A day later, on December 4, Ms Mamata Banerjee had asked seven senior officers in her department to proceed on leave forthwith to facilitate an “impartial and unbiased” enquiry into the Rajpura train accident. Making a suo motu statement in the Lok Sabha, Ms Banerjee had said the officers who have been asked to proceed on leave, including Divisional Railway Manager, Ambala, Senior Divisional Safety Officer, Ambala, senior Divisional Mechanical Engineer, Chief Engineer and Chief Track Engineer of Northern Railway. |
Train mishap: body of Pilibhit passenger unclaimed AMBALA The Railway officials know that Kamal Das hails from Pilibhit, as it is mentioned on his ticket. But little else is known about the only body lying unclaimed. The railway officials have already informed their counterpart in Pilibhit about the body and photographs of Kamal Das have been put up on the station there so that the near and dear ones could claim his body. The Senior Divisional Commercial Manager, Mr Sanjay Goel, said out of the 45 passengers killed in the accident, 44 bodies have been claimed. “To enable them to tide over the situation, we had immediately paid ex gratia of Rs 15,000 to the family members of the deceased and had paid Rs 5,000 to the grievously injured,” he said. Mr Goel said all ex gratia cheques of Rs 1 lakh for each of the grievously injured passenger and Rs 2 lakh for the deceased passenger — have been prepared. “We have sent three teams to UP, Bihar and Punjab, who are in the process of distributing the cheques for the grievously injured,” he said. He said a total of 78 cheques had been prepared for the grievously injured train passengers, out of which 25 grievously injured have already been paid the total ex gratia amount. “Regarding the total ex gratia payment for the next of kin of deceased passengers, it will be done as soon as the verification of the next of kin is done,” he assured. “About Rs 10.5 lakh in cash has been given as ex gratia. For the grievously injured, the total ex gratia amount works to around Rs 73 lakh, which has already been prepared and dispatched. The total ex gratia amount for the deceased is about Rs 90 lakh,” he said. Mr Goel said immediately after the accident, free tickets had been provided besides attaching extra coaches and giving passes to the attendants. “Our welfare activity is still on. About 10 patients are still being looked after,” he said. |

Mr Sharma said arrangements had also been made for window delivery of roll numbers at the head post offices. “Consequently, we appeal to the candidates concerned to approach the delivery post offices of their area to collect their roll numbers,” he said. Advocate held for rape of maid REWARI, Dec 12 — The city police has arrested Risal Singh Yadav, an advocate, and his neighbour K.C. Bhatia in connection with a case of rape and intimidation registered against them on the basis of a complaint lodged by the wife of Mr Narender Singh, a resident of Rajiv Nagar here. The complainant worked as a domestic help at the advocate’s residence in Mohalla Topchiwara here. The third accused has absconded. Mr J.S. Dahiya, Chief Judicial Magistrate, Rewari, has remanded the accused — Risal Singh Yadav and K.C. Bhatia — to judicial custody till December 23. |

Tenure of Chahal
panel extended CHANDIGARH, Dec 12 — The Haryana Government has extended the tenure of the Chahal Commission of Inquiry by another six months. The Inquiry Commission was set up on December 7, 1999, under the chairmanship of a former Judge of the Punjab and Haryana High Court, Justice G.S. Chahal, to look into various aspects of the prohibition imposed in the state by the Bansi Lal government in 1996. It was lifted after 21 months. Initially, the commission was given three months to report its findings. Its tenure was extended by three months twice. Sources said that the extension had been necessitated by the fact that after the commission visited various districts, more and more evidence came its way. About 700 affidavits have been filed before the commission, which has also examined Mr Surender Singh, son of the former Chief Minister, Mr Bansi Lal, and the then Prohibition Minister, Mr Ganeshi Lal. Their examination is inconclusive. The sources said many a time information sought from various departments like the Excise and Taxation, Police, Transport, Labour, Tourism and Industries, was not readily available and forthcoming. The commission has already visited Jind, Kurukshetra, Gurgaon, Sirsa, Fatehabad, Bhiwani, Panipat and Mahendragarh districts. It will shortly visit the remaining districts. No affidavit has been filed from Panchkula, Karnal and Yamunanagar districts, while a few have been filed from Rewari, Jhajjar and Sonepat districts. |

Rathore, Sonia told CHANDIGARH, Dec 12 — The Ruchika molestation case has cast its shadow in the contest for Haryana Congress President’s post. Some senior state Congress leaders, including a former Union Minister, reportedly met Congress President Sonia Gandhi today and made a representation to her about Mr Bhajan Lal’s alleged patronage to Mr Rathore during his tenure as the Chief Minister of Haryana. Not only Mr Rathore was promoted and the charge of molestation against him was dropped when Mr Bhajan Lal was the Chief Minister, the victim’s brother was arrested and tortured during his regime, the Congress leaders reportedly told Ms Sonia Gandhi. The move is believed to be inspired by Bhajan Lal’s bete noire, Mr Bhupinder Singh Hooda, HPCC chief, whose bid for retaining the state Congress President’s post has been challenged by Mr Bhajan Lal. |

for 11 districts CHANDIGARH, Dec 12 — The Uttar Haryana Bijli Vitran Nigam (UHBVN) is planning to install 11,698 distribution transformers of 25 kva, 63 kva and 100 kva capacity at the cost of Rs 46 crore in Panchkula, Yamunanagar, Ambala, Karnal, Kurukshetra, Kaithal, Panipat, Sonepat, Jind, Rohtak and Jhajjar districts under an ambitious scheme approved by the Rural Electrification Corporation (REC) of India during the current financial year and next year. A spokesman for the nigam said here today that REC had also approved the installation of LT capacitors on these distribution transformers at the additional cost of Rs 6.76 crore along with the creation of 41 capacitor banks of 11 kv level at 33 kv sub stations at the cost of Rs 2.23 crore to ensure quality power supply to consumers. It would not only improve the voltage system but also help in reducing line losses, he said. |

diseases begins HISAR, Dec 12 — A short course on the ‘application’ of epidemiological of principles in plant disease control began at the Haryana Agricultural University here today. As many as 40 scientists from different states are participating in it. Inaugurating the course, Mr Vijay Kumar, Vice-Chancellor, highlighted the role of plant epidemics in causing serious financial losses to farmers. He emphasised the need for critical analysis of relationship amongst host, pathogans and environment conditions for developing suitable disease forecasting system. Exams rescheduled KURUKSHETRA, Dec 12 — Various postgraduate and diploma courses (re-appear and supplementary) examinations scheduled to be held from December 15 have been postponed due to administrative reasons. These examinations will not be held from December 25. This was announced by the Controller of Examinations, Kurukshetra University, Mr Ramesh Sharma, here today. Mr Sharma said the roll number slips and datesheets of eligible candidates were being arranged to be sent in due course. Detailed datesheets of these examinations were being sent to the principals of postgraduate colleges. |

500 acres submerged JIND, Dec 12 — About 500 acres of land were submerged under water due to a breach in the Barwala link canal near Balerkha village in this district yesterday. The breach has caused considerable damage to the recently sown wheat and other rabi crops. The cause of the breach could not be ascertained yet. The authorities have started plugging the breach on a war footing. Meanwhile, the affected farmers have demanded compensation for the loss to their crops. |

formed FARIDABAD, Dec 12 — A district-level peace committee has been constituted headed by the Deputy Commissioner, it would have member of the Lok Sabha, MLAs, Additional Deputy Commissioner, SDMs, tehsildars and the district Public Relations Officer as its members. At least 44 non-official members have been included in this committee, including several sarpanches, numberdars, panches and former sarpanches. |

Bill on cow
slaughter in next session CHANDIGARH, Dec 12 — The Haryana Government will bring a bill aimed at banning cow slaughter in the state during the next session of the Assembly. This assurance was given by the Chief Minister, Mr Om Prakash Chautala, when a three-member high-level delegation of the RSS met him at his residence here today. The delegation was led by Mr Darshan Lal Jain, Prant Sanghchalak of the Haryana unit of the RSS. The Prant Karyawah, Dr Bajrang Lal Gupta, and the Prant Pracharak, Mr Rameshwar Dass, were the other members of the delegation. |
