Setback to Bansi Lal

GURGAON, July 17 — The Bansi Lal government today got a further jolt with an Independent MLA from Narnaul, Mr Kailash Sharma, informing the Haryana Governor, Mr Mahabir Prasad, that he continued to oppose the Bansi Lal government.

In a telephonic conversation with a group of reporters here, Mr Sharma said he had sent a fax message to the Governor in the morning.

According to Mr Sharma, he had informed the Governor that he had voted against the motion of confidence moved by the Bansi Lal government on June 25 after the BJP withdrew support to it and he had not changed his stand against the government even today.

Mr Sharma urged the Governor to dismiss the government forthwith as it had come in minority following the withdrawal of support to it by the Congress. The BJP and the Indian National Lok Dal are already opposed to the government.

According to him, he has submitted to the Governor that the Chief Minister, Mr Bansi Lal, must now resign on his own on moral grounds. In case he did not do so, the Governor must immediately sack the government.

Mr Sharma charged that canards were being spread by vested interests against him to suggest that he had changed his stand in favour of the government. The continuance of the government even for a single day was detrimental to the interests of the state, he added.

Mr Sharma further alleged that Mr Bansi Lal was indulging in pressure politics against his opponents. The Chief Minister deliberately ignored the interests of his assembly constituency even though he was earlier supporting the government, he added.

He said he had convened a panchayat of 30 villages of Nangal Chaudhary block of his constituency to decide on the future course of political action.

Mr Sharma's stand assumes significance as 44 MLAs of the Haryana Assembly including 22 of the INLD, 10 of the BJP and 12 of the Congress were already opposed to the government. If Mr Sharma is also included in the list, the number goes to 45. The effective strength of the Haryana assembly is 89 as one of the BJP members is not entitled to vote.

This means that Mr Sharma’s stand puts the anti-Bansi lobby in a position of majority in the state Assembly.Top

 

Cong men a demoralised lot

KARNAL, July 17 — The dithering attitude of the Congress in withdrawing support to the HVP has caused demoralisation among the Congress rank and file. Interviews with party workers in Kurukshetra and Karnal parliamentary constituencies reveal that the gains of the Congress vis-a-vis the BJP following the last parliamentary poll have been negated by the support of the Congress to bail out Mr Bansi Lal during the confidence motion in the recently held Assembly session.

The workers feel that the advantage which the Congress had hitherto enjoyed because of the anti-incumbency factor has been neutralised with one stroke by the Congress high command's decision to save the Bansi Lal government.

The workers at the grassroots level find it difficult to explain to ordinary voters compulsions of the party to support the HVP government which had failed on all fronts. Till yesterday, Congressmen used to criticise the BJP for its continued support to Mr Bansi Lal despite the failures of his government. Now workers of the BJP in the villages ask Congressmen about the temptation which compelled the Congress high command to support the government which had failed to fulfil any of the promises made to the voters.

The Congress, the workers feel, has committed "criminal" act by providing a fresh lease of life to Mr Bansi Lal. If the Congress had felt that the BJP support to Mr Bansi Lal was wrong then how could they justify their support to him now?

A 85-year-old man of Taraori Market, who practises yoga and ayurveda and was jailed twice during the freedom movement, stated that the argument advanced by the Congress high command and the state leadership that they had supported Mr Bansi Lal in order to keep away the INLD-BJP combine from capturing power in the state, was patently wrong. The freedom fighter, who did not want to be named, stated that how come that the Congress high command was unaware of the numbers game in Haryana. Both, the INLD and the HVP had a combined strength of 35 members only in the Assembly when Mr Bansi Lal was asked to seek a confidence vote. From where and how they could have mustered over 11 members to reach the magic figure of 46 when the Congress stalwarts like Mr Bhajan Lal had been claiming that majority out of the 10 independent MLAs had promised to be with the Congress in case the INLD-BJP combine staked its claim for forming an alternative government after the ouster of Mr Bansi Lal. In fact, the workers feel that the high command was led up to the garden path by the leadership who wanted to be on the right side of Mr Bansi Lal in case of any future political scenario in the state for capturing power. It was not without meaning that nine of the 12 Congress MLAs were opposed to the high command's move till the last month.

The Congress in the field now have to do lot of explaining about its stand. During the past two years, the non-Jat voters in the state, had almost felt disgruntled with the BJP and the HVP. A majority of them had started thinking favourably towards the Congress. But of late, they have once again started drifting away from the Congress.

The majority of silent voters amongst the non-Jats and the backward classes, who had been supporting the Congress traditionally, feel cheated with the latest act of the Congress to provide fresh lease of life to Mr Bansi Lal. Mam Chand, a resident of Bahri Mohalla of Kurukshetra who had been a Congressman for years, sarcastically said that had the high command should have asked the backward voters what Mr Bansi Lal had done for them during three years of his rule before supporting his motion in the Assembly.

However, in all this, Mr Bhajan Lal and his coterie had proved to be shrewd tacticians who knew the pulse of the people better than the group led by Mr Bhupinder Singh Hooda. By espousing Mr Bansi Lal's cause, even though for a short period, the Congress had lost much ground in the field. It would take a lot of efforts on its part to retrieve the ground before the coming elections.Top

It wanted to keep the INLD-BJP combination away from the seat of power. It succeeded. But soon afterwards it wanted its own wish of getting the Assembly dissolved fulfilled. Mr Bansi Lal realising the Congress party's position vis a vis the INLD and the BJP combination was prepared to bargain up to a level. He offered, first, an alliance of the two parties in the government and, second he offered to merge his party in the Congress provided he was assured of a reasonable space in Congress politics. But the Congress, divided from top to bottom, failed to make any decision on these and stuck to the dissolution song.

Here again, first it shot off a statement conceding that in the final analysis meant that it would still try to help the beleaguered Chief Minister vis a vis the emerging combination of Mr Om Parkash Chautala and the BJP. It was only "completely dissociating" itself from the HVP government. Party leaders like Mr Pranab Mukherjee and spokespersons like Mr Ajit Jogi had even said that since the Congress had not given any letter to the Governor, Mr Mahabir Prasad, there was no question of saying that it was withdrawing its support. But after former Chief Minister, Bhajan Lal met the Governor and later the Congress President, Mrs Sonia Gandhi, this stance changed. Nevertheless, even while writing the letter to withdraw support to the Governor, the Congress hedged by stating that if another combination emerged, the Congress could act freely.

What the 12-member Congress group wants is that the Assembly be straightaway dissolved. In this it wants to have its cake and eat it too quite, forgetting its small size. It also forgets its own past when it says that for the sake of clean politics and to stop horse trading the Governor should dissolve the Assembly.

Mr Bansi Lal on the other hand is playing an entirely different game. He wants to survive by exploiting the apparent contradiction between his numerous opponents and keeping his own flock together. He initially succeeded in this and could succeed even now.

"What would the Congress do in case the Governor summons the Assembly once again to test the strength of the government? Would it vote with the BJP and INLD combination and get dubbed nation-wide as an opportunist party or see the fall of the HVP government and rise of Mr Chautala or Mr Ram Bilas Sharma as Chief Minister", a senior HVP leader says bluntly. In fact, in this game all the other players are gainers barring the Congress.

But right now the ball is in the court of the Governor. He has before him several legal and constitutional opinion. One view is that as per the judgement in the famous Bommai case, he could once again ask for a trial of strength despite the June 25 vote of confidence.

Alternatively, the Governor can say that the government is in a minority and stands dismissed and recommend dissolution of the state Assembly. This would imply that a head count had been done outside the Assembly and would clearly violate the Supreme Court judgement in the famous Bommai case, wherein the court had observed in its March 1990 judgement, "in all cases of claims of legislators withdrawing support to a ministry the proper course was to test the ministry's strength in the Assembly, which was the sole constitutionally ordained forum to test claims and counter-claims. The assessment of a ministry's strength was not a matter of private opinion of any individual, whether the Governor or the President, and it was not open to bypass the House and depend upon their subjective satisfaction. Such private assessment was an anathema to democratic principles. However, in rare cases where a floor test might be impossible, the Governor must state in writing the reasons for not holding a floor test."

Apart from this constitutional and legal precedent should Mr Prasad dismiss the government, dissolve the Assembly and ask for fresh polls by stating that no stable government could be formed, he is sure to be challenged in Supreme Court. Even prior to that the Union Cabinet and the President might take a different view. In case of dissolution and the powers of the Governors, the President has definite views as he showed in Uttar Pradesh, when Governor Romesh Bhandari dismissed a BJP-led Government. There is also a feeling here that the BJP may ask for suspended animation of the Assembly in the hope of trying its luck after the general elections. However, as of now there is a government in power which proved its majority only recently though it subsequently 'lost part of it.' The Governor is expected to make things clear very soon.

And the gains and losses of political parties can only be totted up after he does so.Top

Scores of representations and telephone calls have flooded The Tribune office here during the past three days with people complaining about the frequent power cuts and scarcity of drinking water. People complained that after July 1, the power cuts had become more frequent and they were yet to get 24-hour power supply promised by Mr Bansi Lal.

The people have now turned to gods for help as special prayers and havans are being performed to appease the rain god.

The farmers have also been facing these power cuts and water crisis. Water required for the paddy crop, which is about to be transplanted is not available. A farmer in Hansi told TNS that he had sown paddy in 10 acres and any further delay in rains would damage the crop. He said he was managing to irrigate his fields for the time being with a diesel engine, which costs him about Rs 120 per acre per day.

Power cuts in the town have become a routine and people have lost all hope of any improvement in the prevailing situation.

In Agrasen Colony, Rampura Mohalla, Dogra Mohalla and several other localities in the old city, taps have gone dry for the past several days and residents are depending on handpumps for water. Due to the dry spell the Public Health authorities have stopped the water supply to the interior areas.

The dry spell, however, is likely to continue for some more days. The incharge of the Agrometrology Advisory Service Unit in the Haryana Agricultural University, Dr M.L. Khichar, said the maximum temperature in the region for the next few days would remain between 39°C to 41°C and the minimum temperature around 26°C. He said, there was likelihood of a sand and dust storm.

The HVPNL sources, however, admitted failure in the power supply and said it was because of excessive load.Top

 

HSIDC move irks unit owners

GURGAON: The Udyog Vihar Industries Association (UVIA), a local organisation, is very critical of moves initiated by the Haryana State Industrial Development Corporation.

In a talk with this reporter, its Joint Secretary, Mr Arvind Batra, launched a scathing attack on the HSIDC and said while the corporation advertised its spectacular development achievements in newspapers, in reality it failed to provide basic civic amenities in its industrial estates.

Several local industrial associations have, recently joined hands to form Gurgaon Industries Action Committee (GIAC). It has primarily been created in response to a demand notice for additional maintenance charges leviable by the HSIDC on 'old allottees' of industrial plots in Udyog Vihar.

The demand notice issued by the HSIDC observes that as per the earlier system of calculating maintenance charges payable by allottees, the charges levied were taken as a percentage of the price of the allotted plot. Since the price of plots has been increasing, the notice points out that "this system was heavily loaded in favour of old allottees", and proposes to "recover the additional charges over a period of time".

The GIAC has reacted aggressively to this issue and termed as "unilateral and unfair" all efforts by the HSIDC to claim additional maintenance charges from Udyog Vihar plot holders. According to them, the HSIDC is only resorting to "milking the cash cow" in view of its failure to effectively market its new estates elsewhere in the state.

The chairman of the GIAC, Major-Gen Sawhney (retd), has, in reply to HSIDC's demand notice for additional maintenance charges, questioned the validity of the "unilateral change" in the terms and conditions of the agreement entered into by the allottees with the corporation. He points out that the earlier charges paid by allottees for basic services have not been utilised for their benefit. "Despite the payments made already, even now there are no streetlights, the sewage system has not yet been fully put into place and the stormwater drainage is not functional", he asserts.

The GIAC argues that the charges, if any, can and should be payable only after completion of development works. Further it is pointed out that the development works must be prioritised. "We do not want red sandstone footpaths along the road as proposed. Instead, if the officials are sincere about development works, they should first ensure lighting, sewage and stormwater drains in the industrial estates, explains Mr Batra. The absence of these basic facilities cannot be overlooked by "providing a facelift and getup of the total area" as mentioned in the HSIDC notice, he points out.

Besides this, a new "supplementary agreement" drawn up by the HSIDC and proposed to be executed with all allottees, is drawing considerable flak from the industrial associations. The new agreement is seen to be too "dictatorial and regressive in its approach", with all kinds of stipulations that any unit functioning in an HSIDC industrial estate must fulfil to continue without inviting scrutiny. A clause authorising the HSIDC Managing Director to appoint an arbitrator in case of a dispute is indicative of the one-sided look of the proposed agreement format, Mr Batra.

The Udyog Vihar entrepreneurs insist that the plethora of rules formulated by the HSIDC go against the spirit of liberalisation the country has been imbibing over the last decade. They point to a few instances of multinational companies which have recently decided to move their operations out of Gurgaon as symptomatic of the malaise afflicting the "once progressive" Udyog Vihar.Top

 

Dental students' future at stake

FARIDABAD, July 17 — Students of the local Dashmesh Dental College were in for a rude shock when they came to know that the college has not been recognised by the Dental Council of India.

Finding their future in the dark, 340 students, including 180 who have already passed out, started an agitation on Thursday to press the college management for getting the institution recognised by the Dental Council at the earliest. The students staged a dharna in front of the college yesterday.

The students alleged that the college management had been telling them that the college had been recognised by the Dental Council of India for the past five years but the reality came out only when former students approaching the Dental Council for the certificates of recognition.

They alleged the college management had cheated them as they had spent lakhs of rupees on their study and lost crucial years of their lives.

The 180 old students, who had passed their courses, were not eligible for jobs in the absence of recognition by the Dental Council of India.

The college authorities closed the college up to July 25 when talks with students failed to produce any desired result.

Sources said the controversy regarding recognition came to the fore as the college authorities had allegedly admitted students without fulfilling the necessary formalities.

The college management had now applied for recognition of the degrees of 180 students.

Mr Jagir Singh Bahia, a senior functionary of the college, said the management was making sincere efforts to solve the problems of former students. There was no dispute regarding the recognition of courses for the currently students as recognition had already been granted by the Dental Council of India. As the students locked the OPD of the college yesterday the college management decided to close it up to July 25, Mr Bahia said.Top

Giving this information, the Chief Minister, Mr Bansi Lal, today said this decision had been taken keeping in view the supreme sacrifice made by martyrs and to boost the morale of the forces.

The state government has authorised Deputy Commissioners to affect changes after considering the matter when any gram panchayat or municipal council etc approaches him with a resolution in this regard.

The Chief Minister lauded the contribution made by young soldiers of Haryana in making Operation Vijay a grand success. As many as 73 brave sons of Haryana have laid down their lives during the Operation. "We will forever feel indebted by the supreme sacrifices made by them for the cause of the country. Twelve per cent of the soldiers in the armed forces hail from Haryana. They always remain in the forefront for safeguarding the honour of the country", he added.Top

 

Man shot at by youths

PANIPAT, July 17 — Surender, alias Ganju, of local Indira Bazar was shot at and injured seriously yesterday evening by two unidentified persons.

According to information, two unidentified youths came to Surender yesterday evening and demanded brown sugar from him. When Surender refused to oblige them and walked away, they shot at him. The bullet pierced through his abdomen.

On hearing the shot the people tried to chase the fleeing criminals, but they managed to escape after firing two rounds in the air.

Surender was taken immediately to the Civil Hospital in a serious condition and was later referred to the All-India Institute of Medical Sciences in New Delhi.

A case under Sections 307 and 34 of the IPC has been registered by the police here.

In another case, six girl students and a teacher of the local Industrial Training Institute were hit by a Maruti car on the main GT Road causing multiple injuries on their heads, legs and other parts of the body.

According to reports the victims were waiting for a vehicle outside the institute when the car, reportedly went out of control, hit them. The injured were admitted to the Civil Hospital. The teacher Vinod Kumari and a student Manju, have been referred to the PGI Chandigarh and Rohtak, respectively. The police has registered case against the driver.Top

CHANDIGARH, July 17 — Haryana has taken another step towards an independent and transparent regulatory regime in the power sector with the Haryana Electricity Regulatory Commission (HERC) by issuing guidelines to HVPN for power procurement, load forecasts and resource plans in keeping with the Haryana Power Reforms Act.

These guidelines aim to make power procurement a transparent, economical and a more efficient process for HVPN and other licensees. The HERC has finalised and issued these guidelines after a public consultation process and taking into account comments received from different agencies, including HVPN.

Commenting on the guidelines Mr V.S. Ailawadi, Chairman HERC said, "The guidelines aim at transparent procedures so that economical and efficient guidelines ensure adequacy of power and reasonability of its cost of procurement. We have also laid down strict guidelines. This is critical to ensure that the consumers are able to derive benefits from the reforms within a reasonable period of time and the different aspects of power procurement are met on a regular basis," says Mr V.S.Ailawadi, Chairman, HERC.Top

Mr Devi Lal visited the family of a Kargil martyr Krishan Kumar at Tarakanwali village and paid his condolences.

He criticised the Congress for projecting Mrs Sonia Gandhi as leader and said blind following had been a characteristic of the party.

Former Deputy Prime Minister stressed on the need of unity among the nationalistic parties. He said the Congress must be eliminated politically so that no party should ever think of handing the reins of the nation to a person of foreign origin.

Commenting on Haryana politics Mr Devi Lal said the state did not have effective leadership and the prevailing lawlessness was an outcome of it. Referring to the 'murim' murder case he said vested interests and lack of courage were responsible for it.Top

CHANDIGARH, July 17 — BSP President Kanshi Ram held a two-hour long meeting with Haryana Chief Minister Bansi Lal here this evening.

They are believed to have discussed the political situation in the state and the country against the backdrop of the Lok Sabha poll. Possibilities of a tie up between the two parties may also have been discussed.

Mr Kanshi Ram drove over from Patiala to talk to the Haryana Chief Minister. He later left for Delhi by road.

CITU workers take out procession

SONEPAT, July 17 — A large number of industrial workers, affiliated to CITU , took out a procession here yesterday in support of their demands.

Carrying placards and raising anti-government slogans, they marched through the main bazars of the city.

On reaching the mini-secretariat, the procession was turned into a rally addressed by leaders of the union. Later, a memorandum listing the demands of the union was presented to the Deputy Commissioner.The memorandum urged the state government to hold a meeting of the representatives of employers and employees in the presence of the Labour Department authorities and revise the wages of workers by fixing Rs 3,500 as the monthly wages. It regretted that the state government had failed to revise the wages of workers for the past several years despite the fact that these should have been revised after every two years.

The memorandum also demanded immediate lifting of the lockout in Vog Textile Mills, Bahalgarh, and the reinstatement of all suspended and terminated workers.Top

 

Five proclaimed offenders held

SONEPAT, July 17 — The police has launched a special campaign to apprehend proclaimed offenders and bail jumpers who had been evading arrest for the past nine to 20 years in Sonepat district.

Mr K. Selvraj, SSP, said here today that the police had succeeded in arresting five proclaimed offenders and 40 bail jumpers during the campaign. One of the proclaimed offenders, Mohinder, alias Mandu of UP, was allegedly involved in a case of dacoity in the Ganaur police station area and had been evading arrest for 20 years or so.

Another proclaimed offender, Mani Ram of Nuna Majra village in Jhajjar district, had been arrested after 16 years. Sunil of Kalan Mohalla, Sonepat, who was involved in a case under the Indian Arms Act, had been arrested after nine years.Top

 

Tipnis visits A.F. Station

AMBALA, July 17 — The Chief of Air Staff, Air Chief Marshal A.Y. Tipnis, visited the Air Force Station, Ambala, here yesterday. He was received by Air Officer Commanding K.S. Chhina.

The air chief was accompanied by his wife, Molina, who is the president of the AFWWA.

The air chief complimented all personnel for the recent successful air operation in Kargil. He cautioned them not to be complacent.

Mrs Tipnis addressed the wives of Air Force personnel of the base and extended her appreciation to them for their valuable contribution towards welfare activities. She also visited the wounded soldiers in the military hospital and presented them with gifts.Top

 

Higher quota for Army recruitment sought

CHANDIGARH, July 17 — Mr Bhupinder Singh Hooda, President, Haryana Pradesh Congress Committee, has demanded a higher quota for the Army recruitment from Haryana presently going on all over the country.

In a statement here today, Mr Hooda said the number of jawans and officers from Haryana, killed in the recent Kargil conflict, was much higher than that of the other states. The valour of the jawans had been widely acclaimed in all circles and the saga of sacrifices made by them in the Kargil-Batalik-Dras sectors had doubled the desire of Haryanavi youths to join the Army to defend the motherland.Top

 

Protest against power shortage

KAITHAL, July 17 — Hundreds of farmers from Kangthli and adjoining villages blocked traffic on the Kaithal-Patiala road at Kangthli today in protest against the irregular power supply in the area causing loss to standing paddy crop.

The villagers raised slogans against the state government and the HVPN and demanded adequate supply.

The dharna which started at 10 a.m. was lifted at 11.30 a.m. on assurance of the SDM, the DSP, Ghula, and the Xen, HVPN, Kaithal.Top
