Consumer Courts
PUDA told to allot booths
Tribune News Service

CHANDIGARH, July 17 — While setting aside an order of the District Forum-II, the District Consumer Disputes Redressal Commission has directed Punjab Urban Development Authority (PUDA) to recall cancellation of allotment of booths to two Sikh migrants and allot them the same.

Two Sikh migrants, Mr Gurcharan Singh and Mr Mohinder Singh, had filed an appeal in the Commission against an order of Forum -II. In his complaint, Mr Gurcharan Singh had contended that he had been allotted a booth in Phase-I, Urban Estate, Phagwara, on December 16, 1986, after he had deposited Rs 1,417. The allotment letter had also been issued to him. He further averred that later PUDA observed that the complainant was not entitled to allotment as he had failed to pay 25 per cent of the price within 25 days.

The Commission bench consisting of President, Justice J. B Garg, and members, Col. P.K Vasudeva ( retd) and Mrs Devinderjit Dhatt, observed that PUDA could not leave a policy of the State Government unimplemented. They further held that denial of a booth to a bona fide allottee amounted to deficiency and hence PUDA's stand was not justified.

The bench further directed the migrants to deposit the outstanding part of the price within a period of three months. A similar order was passed in the case of an appeal preferred by Mr Mohinder Singh.

Lost packet

The UT Consumer Disputes Redressal Forum-I has directed a local courier company to pay a compensation of Rs 6,000 to a complainant for having lost a packet containing her admission form.

Ms Usha Devi, a resident of Kangra, had in her complaint stated that she wanted to apply for admission in the diploma course in library science at Punjabi University, Patiala. For doing so she filled the admission form and after completing all the necessary formalities, she handed over the envelope to Blaze Flash Couriers Company

She further stated that the packet contained original matriculation certificate and a demand draft of Rs 3,240 along with the admission form. The complainant also alleged that at the time of accepting the packet, the courier company had assured timely delivery. The packet, however, it was alleged, never reached the destination.

The representative of the courier company in his reply maintained that they had a branch at Patiala and they had delivered the packet there. But the packet got lost there.

After hearing the arguments , the Forum bench comprising its President, Mr H.C Modi, and members, Mr R.K Behl and Ms Shashi Kanta, held the courier company guilty of deficiency in services because the complainant's precious year of educational career was wasted as a result of the packet getting lost at Patiala.

The bench directed the respondents to pay a compensation of Rs 6,000 to the complainant as costs of the damage and the mental agony and tension suffered by her.Back
