HC interim orders bring relief for discoms
Yamunanagar/Ambala, June 9 The interim orders passed by the court are likely to give a major relief to the Uttar Haryana Bijli Vitran Nigam (UHBVN) and the Dakshin Haryana Bijli Vitran Nigam (DHBVN) as a large number of cases are pending in various district courts and the DCDRF across the state. Sources said the UHBVN had filed writ petitions in the high court that the DCDRF and the civil courts had no jurisdiction to entertain disputes pertaining to the unauthorised use of electricity and theft of electricity as defined under Section 126 and Section 135 of the Electricity Act, 2003. However, the DCDRF had given relief to a complainant of Yamunanagar and had directed the nigam to restore the power supply on deposit of 40 per cent of the disputed amount. Similarly, the civil court had also directed the nigam not to disconnect the supply of a plaintiff on deposit of 50 per cent of the disputed amount. Both of the cases were of electricity theft. The Punjab and Haryana High Court, however, stayed the order passed by the DCDRF, Yamunanagar, on the ground that the consumer forum had no jurisdiction to enter upon the matter, which was under the provisions of the Indian Electricity Act, 2003, in the cases of electricity theft. In this case, the court also relied on the judgment of the Gujarat High Court. While staying the order of the civil court, Ambala, the HC ordered that the civil courts were indiscriminately entertaining suits and passing orders of injunction against demand notices, which were patently without jurisdiction as per Section 145 of the Electricity Act, 2003. The civil courts had no jurisdiction to entertain the suits under Section 126 of the Act and in case of Section 135 of the Act, which deals with the electricity theft. The consequences would lead to a criminal trial and discoms could not be compelled to face these proceedings in different territorial jurisdictions against orders passed by it and the remedies were available only under the Act. It was also learnt that the HC had also ordered to club these cases as these were of similar nature. The sources said there were around 8,000 cases, which were pending in various DCDRF and civil courts across the state and the interim orders issued by the HC were likely to affect all these cases bringing relief to
discoms. |
