JDA toughens stance
Following up 386 FIRs, 163 complaints against illegal colonisers
Deepkamal Kaur
Tribune News Service

Jalandhar, November 27
The Jalandhar Development Authority (JDA) has toughened its stance against illegal colonisers by properly following up all 386 FIRs and 163 complaints pending with the Police Department for the past few years.

While earlier in many cases inquiry had been kept pending, the officials are now seeking reply from the police officials concerned on the status of each case so as to proceed with them further and to ensure that those indulging in unauthorised development are taken to task.

The JDA officials in majority of the cases have found that the police officials concerned had not even bothered to correspond with the department to get any further information and have just been sitting over such cases for long. Reminders for lodging cases are being sent through the Police Commissioner in all such cases.

The JDA officials have even taken up a daunting task of filing appeals in the Punjab and Haryana High Court and Supreme Court over judgements not coming in its favour. At least five such appeals have been filed in the recent past, said Additional Chief Administrator Sarojini Gautam Sharda, adding that she was also drawing up a list of lawyers who had not been able to represent their side properly.

The Additional Chief Administrator said she had got 13 FIRs lodged against unauthorised colonisers in the past three months. Three of these pertained to illegal colonies at Wadala and Pholariwal villages in Jalandhar, four in Bhullarai, Naurang and Khalwara villages of Phagwara, two each in Mukerian and Garhshankar, one in Ladhewal village of Kapurthala and another in Sultanpur Lodhi.

Whatever formalities had to be carried out in the name of child labour drives, during the ongoing Abolition of Child Labour Week in Jalandhar, were carried out for yet another day today.

In as many as 81 inspections across the district, three child labourers were rescued. While one of them was found pursuing a hazardous occupation, the remaining two were pursuing non-hazardous occupations. While the Deputy Director, Factories, too, joined one of the teams to raid some factories regarding which some tip-offs had been received, ironically, no children were found in any of these factories. The factories included some big business houses of the city.

Yesterday, as many as 150 drives were carried out across the city, but only four child labourers were rescued. Among the children rescued yesterday, two children were found pursuing hazardous occupations, while the other two were found pursuing non-hazardous occupations.

The Labour Department claims that since the children had their parents in the city, they were handed over to them.

Club Mahindra asked to pay up
Tribune News Service

Jalandhar, November 27
The District Consumer Disputes Redressal Forum has asked Club Mahindra to pay Rs 10,000 to a city-based family for deficiency in services.
In a joint complaint filed by Kewal Chaudhary, Managing Director of Action Batteries, his son Samir Chaudhary, son-in-law Ajay Sehgal and brother-in-law Vikram Sachdeva, it has been alleged that representatives of Club Mahindra Holidays Bhambar Sharma and Abhishek approached them for becoming time-share member of the club by giving lucrative offers like five-star luxuries in their all resorts all over India.

"Believing them, we applied for the membership. We were asked to deposit a sum of Rs 25,426 each as an initial payment and the remaining amount of Rs 3,41,220 was to be paid by each one in 60 EMIs of Rs 5,687 each month starting from November 7, 2009, to October 7, 2014," they wrote in the complaint.

Thereafter, the complainants received a confirmation of membership from Ajay Nambiar, Head Member Relations Officer, and thereafter, received certificate of membership dated October 28, 2009. All the complainants made a booking for a Goa resort from November 23, 2009, to November 27, 2009, along with their families, which was duly confirmed.

At the time of making a booking with the executives of the opposite party, the complainants said they were fully assured that they would be provided accommodation with five-star luxuries worth Rs 7,000 per day in a Club Mabindra Resort and also provided with 14 food vouchers worth Rs 500 each.

The complainants were assured that there would be pick-up facility available from the airport and they would be dropped at the resort. The complainants were told that they would be boarded in Club Mahindra Resort in Goa. They said they were shocked to know that three of the families received a holiday confirmation voucher from Goa Jasmine Resort and one member got the booking in Club Mahindra Resort.

They said they were in for another shock when they reached the Goa airport and found that nobody from the resort had come to pick them up for taking them to the hotel. A complainant said he had also made a call from his cell phone to the office of the opposite party, but no proper reply came after which they hired four taxies for Rs 1,000 each and somehow managed to reach the resort.

As and when they reached the Jasmine Resort, they were shocked to see that it was not even having proper three-star facilities. The

complainants said feeling aggrieved, they had been left with no other option but to move to a five-star hotel namely Nano Resort and had spent a huge amount of Rs 60,616 each (Rs 40,616 as hotel charges along with Rs 20,000 as food charges). Thereafter they had sent a number of requests by way of mails for the cancellation of membership and the opposite party cancelled the membership of the complainants, but have not returned the money to them.

Upon notice, the opposite party appeared denying that any allurement was made to give membership on the basis of wrong commitments. The representatives of the club said they had two resorts at Goa - Club Mahindra Jasmine Resort Goa and Club Mahindra Barca Resort. "It is clearly stated in various documents that booking is subject to availability. As such, the members were provided accommodation in Club Mahindra Jasmine Resort and one in Club Mahindra Barca Resort. This fact was known by the complainants in advance," they replied.

They denied that the complainants were promised that they would be provided a pick-and-drop facility from the airport. "Such facility is available on a special request of the member and is chargeable and the same cannot be provided free of cost," they contended, adding that "the complainants have also concealed the fact that all of them had availed themselves of the free ticket vouchers worth Rs 24, 000 each and Rs 96,000 in total and one member Samir Choudhray availed himself of a four-night free stay at Club Mahindra Barca Resort."

The forum members wrote in the judgement, "The matter would have been different if the complainants were not members of the opposite parties and they were not granted free travel facility and stay at Goa. The complainants have not placed on record any document or other material to show that the opposite parties ever promised to provide five-star facilities during their stay as alleged by them. When the opposite parties were giving air travel facility and free stay at Goa, they were expected to provide pick-up and drop facility at the airport. Admittedly, this facility was not provided and constituted deficiency in service. The complaint is partly accepted and the opposite parties are directed to pay Rs 10,000 in lump sum to the complainants in equal shares on account of compensation and litigation expenses within one month from the date of receipt of copy of this order.
