The case of alleged gang-rape of a 19-year-old girl from Gobindpura locality in Phagwara by three unidentified youths took a dramatic turn today when the victim, who was produced in the court of Judicial Magistrate, Phagwara, claimed in her statement that she was neither raped nor abducted by anyone.

Insurance company asked to pay $200 to airlines passenger

National Insurance Company Ltd has been asked by the District Consumer Disputes Redressal Forum to pay its policy holder an amount of US dollars 200 with 8 per cent rate of interest from November 2003 for delay in delivering baggage to its claimant, while he had travelled to Kenya. A complaint in this regard had been lodged by Mr Harjit Singh, a resident of Bhagat Singh Nagar in Model House here.

Tells court she was neither raped nor abducted

The case of alleged gang-rape of a 19-year-old girl from Gobindpura locality in Phagwara by three unidentified youths took a dramatic turn today when the victim, who was produced in the court of Judicial Magistrate, Phagwara, claimed in her statement that she was neither raped nor abducted by anyone.

Earlier, the victim, in her complaint lodged with the Satnampura police station on April 22, had alleged that her neighbours, Kiran, her daughter Sonia and her friend, Poonam Bajaj, all residents of Gobindpura, first drugged her and then abducted her to some secluded place in a village near Phillaur on April 17, where three unidentified youths allegedly raped her for two days.

The police had arrested the three women and registered a case under Sections 342, 365, 376, 506 and 120B of the IPC against them.

The three women were still in the judicial custody.

The victim, in her statement, told the court that the three women were innocent. They had neither drugged her nor abducted her. “I myself had gone to a place near the JCT Mills where my boy friend, Nirmal, took her to his house in Goraya, where he kept on insisting me to go to my house, but I did not listen to him,” revealed the victim.

She further told the court that the next day Nirmal remained out of his house on the pretext of repairing his car. “I then went to my grandparent’s house and from there I came back to my Gobindpura Mohalla house in Phagwara. On April 19, I once again went to Nirmal’s house,” she disclosed.

Nirmal again insisted her to go to her house, she claimed. Then, she went to her sister’s house, where she fell sick and remained there for the day.

She further said, in her statement to the Judge, that she, instead of going to her house in Phagwara, went to a gurdwara in Ludhiana where she was picked up by the policemen, who handed her over to her family members.

As per her wrong FIR got registered against the three women, who were still in judicial lock-up, and the statement she has given before a Judicial Magistrate in the court, she could be booked for falsely implicating the three “innocent” women in the alleged rape case, Dr Sukhchain Singh Gill, Phagwara ASP, said.

The arrested women would be released on the directions of the court, he added.

Insurance company asked to pay
$200 to airlines passenger

National Insurance Company Ltd has been asked by the District Consumer Disputes Redressal Forum to pay its policy holder an amount of US dollars 200 with 8 per cent rate of interest from November 2003 for delay in delivering baggage to its claimant, while he had travelled to Kenya.

A complaint in this regard had been lodged by Mr Harjit Singh, a resident of Bhagat Singh Nagar in Model House here. The complainant stated that when he had to go to Kenya, he purchased an overseas insurance policy on August 22, 2003. He said that the policy was to cover risks such as illness, loss of passport, total loss of checked baggage and also delay in delivery of checked baggage.

Mr Harjit Singh said he had paid an amount of Rs 688 and boarded a flight of Air India on August 25, 2003, for Delhi to Mumbai and a connected flight from Mumbai to Nairobi. The complainant claimed that on reaching Nairobi, he was told that his baggage containing valuable documents was missing. An hour later, he was informed that his baggage was located from Indira Gandhi International Airport, New Delhi, which would be delivered to him on August 29, 2003. Mr Harjit Singh said that his policy entitled him for a US $100 compensation for the delay of baggage up to 12 hours, and more amount for further delay. He claimed that in his case, there was a delay of 72 hours in passing his baggage.

The officials from the company argued that no immediate intimation was lodged with Loris International, Paris, their international claim settling agents. They said that for the delay of 12 hours or beyond, the company was bound to pay US dollars 100 only. They further claimed that since there was no immediate intimation, the policy holder could not be compensated.

The forum, comprising Mr M.M. Bhalla, president, and Ms Rakesh Kumari, member, said that there was no loss and only a delay of delivery of luggage beyond 12 hours, the company was bound to pay normal compensation and not for incidental inconvenience and loss. It asked the company to pay the complainant an amount of US dollar 100.

The forum also observed that the company had wrongfully denied the claim on unjustifiable ground that the complainant had to move the matter to a sub-agency. For the delay in settling of claim, it further asked the company to make a compensation of US $ 100. It said that Indian currency equivalent to US $200 be given to complainant with 8 per cent rate of interest from November 2003 till the time of payment, which should be within a month.

Retired teachers hold rally

Protesting against the “anti-employee policies” of the government, the members of the Punjab Aided Schools Pensioners’ Cell staged a rally here today.

The demonstrators said they were suffering since the government had stopped the pensions of those retiring after May 31, 2003. They further claimed that they now faced a bleak future.

“The government has not taken any step despite the High Court ruling in favour of the pensioners, asking the government to resume pensions”, Mr Bhupinder Lal, the cell’s state press secretary, said.

The Punjab Chief Minister, Captain Amarinder Singh, had in February this year had assured the aided school teachers of including 50 per cent Dearness Allowance in their salary, but the same had not been implemented yet, he alleged.
