Juveniles held guilty of raping pregnant woman

In a first order of its kind, a Delhi court today held two juveniles guilty of gangraping an eight-month pregnant woman in her husband’s presence while she went to answer the nature’s call and directed them to perform a month’s community service.

Passing the rare reformatory order, the Juvenile Justice Board Principal Magistrate, Santosh Snehi Mann, said both the delinquents shall perform community service at Bara Hindu Rao Hospital here “so that they are sensitised by serving the people in pain and suffering and realise the trauma the victims and their families go through”.

“They should become conscious of the fact that every single member of the community has a right to live with dignity,” the court added.

The Magistrate noted that the juveniles during the course of the trial behaved in a responsible manner and their social circumstances do not warrant their removal from the community. The court also pointed out that Section 15 of the Juvenile Justice (Care and Protection of Children) Act, 2000, provides different modes for rehabilitation of such children who come in conflict with law.

The duo was ordered to be released on probation of good conduct for three years and placed under their parent’s care on any parent executing personal bond with one surety of Rs 10,000 for each of them. However, the court observed that the delinquents in the company of three adult offenders used the pregnant woman as an object to satisfy their lust three years ago at Ashok Vihar here, after holding her husband captive without thinking about the damage they caused to her body and soul.

Son-in law kidnaps professor

In a bizarre incident, one Baldev Raj Sethi, a retired Delhi University professor, was kidnapped from near his house by his son-in-law in Tilak Nagar area in west Delhi on Monday, to demand the return of his wife from Mr Sethi’s house.

Soon after the kidnapping incident, Sethi’s family received a telephone call from his son-in-law. Manoj Patel, a businessman in Gujarat, who claimed to have kidnapped him.

Patel allegedly first demanded Rs 10 lakh as ransom. Later, however, he said he would release Sethi only if the retired professor’s daughter and his wife Archana, who had left him recently, came back to him. Archana had married Patel more than a year back but had come back to her father’s house sometime back following marital discord and filed for divorce.

Sethi’s family have lodged a complaint of harassment against Patel and police teams had been sent to Gujarat to trace his whereabouts.

Bawaria gang members held, several cases solved

New Delhi, February 17
With the arrest of five persons belonging to the Bawaria tribe, the North-West district police today claimed to have solved several burglary cases in Haryana and Uttar Pradesh.

The police also claimed to have seized 450 stolen bags of wheat worth Rs 3.5 lakh, one country-made weapon, along with two live cartridges, three button- actuated knives and one iron rod from their possession.

The accused persons who were arrested have been identified as Chander Pal, alias Ram Chander Bawaria (42), Fakira Bawaria (22), Kallu Bawaria (23), Babloo Bawaria (26) and Mahabir Bawaria (24), all residents of Haryana.

Acting on a tip-off that the members belonging to the Bawaria tribe would be coming to Anaj Mandi in Narela, the police found that the members were loading wheat bags in a tractor.

When the police reached the spot for verification, one of them started firing and others brandished knives. However, they were soon overpowered by the police.

During interrogation, the accused persons told the police that they were engaged in liquor smuggling during the days of liquor prohibition in Haryana and later joined the Bawaria group headed by Ramesh Bawaria.

The group used to loot grains from godowns in Haryana and Uttar Pradesh and sell them in grey market at market prices.

Five cheats arrested

With the arrest of five persons, the North district police claimed to have busted a gang of cheats and seized fake identity cards of the Enforcement Department of NDPL from their possession.

They were identified as Rajesh, alias Munna (27), resident of Burari, Anoop Singh Rana, alias Sushil Kumar Malik (25), resident of Jharoda Marza, Ashok Kumar, alias Amit Rathore (29), resident of Dheer Pur, Manoj Kumar, alias Rajesh Yadav (24), resident of Burari and Bhikam Singh Yadav (48), resident of Rohini.

The police received a complaint from one Rohit Aggarwal that two persons came to their house posing themselves as officials of Enforcement Department of NDPL and checked the electric meters. Later, they came along with three more persons after some time and told Rohit that the meter had been tampered and he should pay a penalty of Rs four lakh. They also said that they would settle the case if he paid them Rs 50,000 on the spot.

Rohit immediately contacted his neighbour and when his neighbour checked with the authorities of NDPL, they were found to be cheats.

During interrogation, the accused persons told the police that they came into contact with one electrician, Subhash Kumar, who used to fix the meters in houses. Based on the information provided by Subhash, the accused persons visited the prospective houses with fake identity cards and demanded money.

In another case, the North district police claimed to have arrested one Peero Yadav and seized 1.8 kg ganja from his possession.

Based on a tip-off, the accused Peero Yadav (25), resident of Bihar, was nabbed from Azad Market.

Credit card racket busted

The police have unearthed a credit card racket where money has been siphoned off from various bank accounts after “finding out” the credit card numbers and secret code of ATM cards of customers. The racket was carried out by sending e-mails to the unsuspecting customers through the Yahoo mail server.

This is the second such racket unearthed by the police. It may be recalled that last week the police had unearthed a job racket where unemployed youths were lured into depositing money into bank accounts on the promise of being provided employment.

In the latest case, those who passed on this information to the criminals discovered to their horror that their balance amount in the bank had been withdrawn. No case has been registered in this connection so far, the police said.

The criminals used the Yahoo server, which seems to have been prepared with a special computer programming, to fool the credit card and ATM card users. According to the police, the cleaver “manipulation of the technology” ensured that the criminals could not be easily traced.

The manager of the Rajnagar branch of IDBI Bank, Mr Amit Singh, received a similar mail directing him to “send your bank debit card number and the secret code” through your mail.

He said that the technology has been so carefully manipulated that it was difficult to find out the e-mail address of the sender. It was difficult to find out who has sent the mail, the bank manager said.

Provide security to municipal authorities
during raids: HC

The Delhi High Court has directed the police to provide security to the Municipal authorities while conducting raids on unauthorised dairies in various parts of the Capital.

The Chief Justice, B. C. Patel and Justice S. K. Kaul said it was the duty of the police and the civic agencies in the Capital to ensure safety of the people. The Municipal Corporation of Delhi (MCD) and the Delhi Police should ensure that the people walk on the roads without endangering their lives, said the judges.

While replying to the court’s notice on the incident of a bull trampling two persons to death on February 4 at Baldev Park in East Delhi, the MCD submitted that the owners of unauthorised dairies attack its staff when they go to raid them.

Taking suo moto cognizance of the reports in newspapers of the incident, the Court on February 9 had issued notices to the MCD and the Delhi Police to file a status report on stray cattle by March 2, 2005.

The animal was shot dead by a team of the Delhi Police after struggling for hours to control it. The bull also damaged a Maruti car beyond repair parked nearby.

Last year, the MCD had filed an action taken report in the High Court on the measures taken to clear the Capital’s roads of stray cattle and dogs. Common Cause Society, a voluntary agency, had pleaded the court to issue direction to the authorities to make the city roads free of stray cattle, which hinder traffic movement and also cause accidents. ‘’We have pleaded that stray cattle should be off the city roads and streets as they not only create hindrance in the smooth movement of traffic but also cause accidents,’’ Common Cause counsel Meera Bhatia had said during the hearing of the petition.

She said despite the claims of the civic authorities that they have taken required action as per the court’s earlier orders, the stray cattle continue to roam freely on the roads and streets. The court had earlier directed the Centre, the Delhi Government, the MCD and the New Delhi Municipal Council (NDMC) to make joint efforts to clear the city roads of stray animals.

Social bodies demand check on ‘satta’
menace in Faridabad

Gambling has been flourishing in the district under the garb of lottery business, consuming the hard-earned money of lakhs of poor people in the towns of the district here. The gambling business, popularly known as ‘Satta’, is believed to be a result of a well-developed nexus between the ‘Satta’ operators and the police. A number of social organisation including the ‘Bharat Vikas Parishad’, ‘Manav Sewa Samiti’, ‘Ekta Yuva Shakti Sanghthan’ and the ‘Prabhat Samajik Sangh’ have demanded a check on the ‘gambling’ and ‘satta’ racket operating in the district.

It is learnt that the government-floated lotteries has been adversely affected by such ‘shady business’, as nearly Rs 60-70 lakh that could have gone to the government coffers from the sale of lottery tickets daily was being pocketed by the ‘Satta’ players.

With Faridabad being one of the leading industrial township in northern India, involving lakhs of workers and businessmen, it has turned into a ‘perfect place’ for the lottery and satta business. There was no shortage of people ready to gamble so as to earn easy money.

Apart from the Badarpur border and Hodal border, which are the two leading points for the ‘satta bazaars’, there were number of ‘spots in the town’ where this menace was operating smoothly without any hindrance.

People come in thousands to these ‘points’ to “make their fortune”, alleged Mr K. L. Gera, a social activist working in the area.

Though the police officials may claim that that there was no gambling or ‘satta’ racket operating in the district, the ground situation was different, he added.

It is reported that an alleged nexus between the operators and the police stations has enabled a smooth operation of the ‘satta racket’, in which over Rs 60 lakh were transacted daily. This amount could have been diverted to the government lotteries if there had been no ‘satta racket’ operating in the area, according to observers. It is learnt that lottery tickets worth Rs 70-75 lakh were being sold by the various stalls daily in the district and this amount could have doubled if there had been no ‘satta’ operating here, he said.

The cost of the ‘katchi ticket’ of the satta could vary from Rs one to several hundreds. It is reported that the ‘satta’ players offer more flexibility and greater chances of profit than a normal lottery, making it a more attractive option for those wising to make a “kill” in the market, claimed an insider.

Moreover, an added attraction is that one gets to “know of ones fortune on a daily basis”, unlike the lottery business, where one has to wait for days together.

According to sources, the police do arrest some persons occasionally involved in the ‘satta business’, but they are more for symbolic value than to punish the operators. It is learnt that the raids and the arrests are pre-planned moves.

The police in many areas receive monthly payment from such operators, it was alleged by insiders. The ‘satta racket’ is operational in most of the lottery markets at Ballabhgarh, Bata Chowk, near K.C cinema and in Hodal town in the district. It may be recalled that the Haryana Government had banned ‘single digit lottery’ few years back so as to end gambling. However, the illegal ‘satta’ or ‘matka gambling’ has flourished unchecked over the years.

Teachers, students concerned over violence in DU

Academics took a back seat with students staying away from classes in the aftermath of the violence that erupted in Kirori Mal College.

The college wore a deserted look and some students were even reluctant to talk about the incident, which saw the use of sharp edged weapons.

While one of the injured is said to be in critical condition, the DUSU General- Secretary, Gaurav Khari, has been sent to judicial custody till February 21. Even as the incident has shocked the people, others claim to “have seen it coming”.

Their contention is that with the falling standards of discipline and values and an increase in the “ show of might”, it is not far fetched to imagine a “film style fight breaking out in college campuses”.

“If you have supporters carrying arms during college elections and teachers being assaulted for even flimsy reasons, does this fight surprise you,” asked a college lecturer.

Seeking anonymity, he said, “one really has to think twice before reprimanding an erring student. Can one forget that a teacher in Shraddhanad College lost his life for trying to stop students from cheating in examinations.”

Following the violence between the students and residents of Chandrawal village, some sections in the University are demanding “increased security cover” and want to keep the “outsiders out”.

“There should be a secluded campus like JNU. Anyone can enter college grounds here especially during the festivals. They play villains and then DU gets the flak,” complained a second year student in Hindu College.

The blame game that has ensued two days after the incident, has enveloped all, parents, media, authorities and even the students…with nobody exactly being able to pinpoint the exact reason for what they call, “falling standards”.

“Everybody I think is responsible, the parents for being too liberal, the teachers for being too withdrawn, the media for making mountains out of molehills and the students for not being able to manage their freedom,” said a professor.

Pointing a finger at the students’ unions she added, “students’ unions and the leaders ought to take their role as models seriously. If they have no qualms about getting into nasty fights, what examples will they set for others.”

Questioned about the involvement of their Gaurav Khari, who is also the General Secretary of DUSU, the ABVP spokesperson, Nakul Bhardwaj said, “it is a case of misunderstanding. He had gone there to resolve a fight…instead got injured himself. He had not gone there to fight as was reported.”

Meanwhile, questions are also being raised about the security in the college. “There were police personnel posted at the gate, could they not have prevented what happened. The college has its own security measures like CCTVs, how come they did not see the fight break out,” another student asked.

DU bandh today

The Delhi University Teachers’ Association (DUTA) has called for a complete bandh of the University tomorrow to protest against the violence during their peaceful march at the Shivaji College. The DUTA also organised protest march at various colleges today to express concern over the delay in fulfillment of their demands by the MHRD and the UGC.

Examination results

The Guru Gobind Singh Indraprastha University has declared the term-end first semester examination results of MA/MSc (Criminology) and MSc (Forensic Science). These examinations were held in December last year.

These courses are offered at LNJ National Institute of Criminology and Forensic Science under the Ministry of Home Affairs. The institute is affiliated with GGSIPU for these courses. —TNS

ABVP to hold march to Parliament on February 22

Demanding the enactment of a central legislation to streamline education in the country, the Akhil Bharatiya Vidyarthi Parishad will be organising a march to Parliament on the February 22 to highlight the various issues connected with the students.

Addressing the media here today, the General Secretary, Mr K. N. Raghunandan, said that they have already submitted a memorandum to the HRD Ministry and even the Ministry has shown consensus on the need to have a central legislation on issues related to the student community.

The ABVP has sought the establishment of new colleges of professional and technical education based on manpower requirement surveys and arrangements for freeship amounting to 20 per cent for the poor and meritorious students and to those from socially backward sections.

Claiming that a large number of students have been driven to despair and frustration, Mr Raghunandan claimed there is a pressing need to have a central legislation on issues connected with the student community.

Suggesting certain provisions for the central legislation that can be enacted in exercise of the power under Entry 66 of List 1 of the Constitution, he said only one entrance test at the state level and a single window system for admission should be followed.

There should be a fee regulatory authority at the state level to regulate fee structure, fees should be fixed on the basis of recurring expenditure, Capital expenditure and should not be included in the matter of fee fixation. “Colleges should be graded on the basis of their performance and fees should be fixed on the basis of the grading and the capacity of a student to pay,” said Raghunandan.

The legislation can contemplate the creation of an ‘Education Development Bank’ for giving financial assistance to the needy and an Educational Tribunal to deal with the disputes arising between the various parties related to education, the ABVP put forth.

PHDCCI for handing over infrastructure
development to DSIDC

New Delhi, February 17
The PHDCCI has called for giving Delhi Small Industries Development Corporation (DSIDC) the responsibility of developing and maintaining infrastructure in the existing industrial areas of Delhi.

By making DSIDC a single agency to provide adequate and quality infrastructure in terms of basic civic amenities, uninterrupted power supply and common facilities to these industrial areas, the Delhi Government could help curb the increasing exodus of small units to the neighbouring regions, it said.

According to PHDCCI, the government should also weight the option of public- private partnership for the purpose. For the model to succeed, a suitable mechanism for maintenance of industrial units should be created whereby independent, reputed companies in the private sector are identified and maintenance contracts given.

Involvement of industrial area associations in maintenance should also be encouraged through a mechanism of transferring a share of the revenue collected from the industrial areas through property tax and other levies, it said.

The PHDCCI has underlined that such proactive measures have become imperative as lack of inter-agency cooperation and lack of clarity of roles is impeding the efforts to extend long needed infrastructure in Delhi’s industrial estates. —TNS

‘DJB undervalued to benefit pvt parties’

NGOs today pitched in to help out senior BJP leader Madan Lal Khurana in his seemingly lone battle over water as they moved the CBI over his allegations that a Rs 75,000-crore scandal has hit the Delhi Jal Board (DJB).

The ‘Rashtriya Mukti Morcha’ filed a complaint with the CBI, echoing Mr Khurana’s accusations that a Rs 76,000 crore DJB had been grossly undervalued at Rs 1,500 crore by Price Water Coopers (PWC) with an aim to sell the water utility to private parties.

The DJB, whose chairperson is Chief Minister Sheila Dikshit, had spent Rs 40.5 crore more in the commissioning of its asset valuation by the MNC, Morcha President Ravinder Kumar said in his complaint. He sought CBI investigations against Ms Dikshit, DJB CEO Rakesh Mohan and PWC officials whom he accused of criminal conspiracy to embezzle public money.

At a joint news conference with Mr Khurana–who had earlier vowed to move the CBI himself–Mr Kumar and All India Crime Prevention Society General Secretary Sandhya Sharma accused PWC of not including machinery, fixtures and fittings and building structures in their valuation report. They alleged that a conspiracy was underway to sell the DJB at throwaway prices.

However, none of his party colleagues accompanied Mr Khurana at today’s news conference, which heard him saying that the DJB’s was the ‘’biggest scandal’’ he had seen in his 45-year political life. But Khurana downplayed his not being joined by any of the BJP leaders, saying he and his party were equivalent entities.

‘’We will wait until the end of this month for the CBI to act. In case it does not, we will follow another course, which we have already planned,’’ Khurana said. Asked why he did not move the CBI himself, the BJP leader said such action could have politicised the issue.

Emphasising that empowerment is a tool to acquire excellence, the Lieutenant- Governor said that one way to empower people was to offer them right to information. He said that absolute transparency in government activities is needed to make democracy more meaningful.

Donation for tsunami victims

The Institute of Company Secretaries of India (ICSI) has contributed Rs 3,36,880 to the Prime Minister’s Relief Fund in aid of the tsunami victims. The cheque was presented today by Mr N. K. Jain, Secretary, ICSI, to Mr Rohit Khera, OSD to the Prime Minister, Mr Manmohan Singh.

The employees, members and students of the institute made the contribution to fulfill their responsibility towards the less fortunate brethren.

Based on a new concept of nutrient-based medical therapy, ‘Sarvapisti’ has cured thousands of cancer patients in their advanced stage of disease. The tests on this medicine were conducted by the centre in the past. The patients are now leading a normal life without any stigma of cancer, a spokesman said.

‘Sarvapisti’ has been developed from the ancient science of nutrient energy. It is prepared from the natural food material, which strengthens the body immunity to drive out the disease. The scientists of the centre discovered the methods to get nutrient energy at laboratory level from food in 1978. And they prepared several medicines by isolating nutrients form different groups of food, which provide curative effect for many chronic diseases during scientific observations.

Fire safety norms

Experts have stressed the urgent need for strict enforcement of norms to ensure fire safety in public buildings and places.

According to experts at a conference on ‘Safety’, organised by the Safety and Quality Forum of the Institute of Engineers, major fires in the past have all occurred in public buildings like schools (Kumbakpnam, Tamil Nadu), cinemas (Uphaar, Delhi), conference halls (Vigyan Bhawan, Delhi) and high-rise buildings like Delhi’s Gopala and Ansal towers.

However, strict adherence to building norms would help a great deal in preventing such tragedies in future, the Capital’s Chief Fire Officer, Mr R. C. Sharma said.

The new sector rates have been made applicable from February 16. One direct offshoot of increased sector rates is that government will get higher stamp duty per registry of property in Indirapuram. In Loni, too, the new sector rates have been made applicable. Those property owners, who had not got the registry of their property done, will have to pay higher stamp duty now. One reason for increased sector rate of property is that many private builders have started operating in the area.

In recent days, the Ghaziabad Development Authority has sold residential plots at the rate of Rs 14,000 to 16,000 per sq mt. After this, the administration felt that a hike in sector rates was called for.

Assistant Commissioner Stamps Ajay Kumar said that a proposal for hiking sector rates was submitted to the District Magistrate Santosh Kumar Yadav, which has been approved by the DM.

Mayor orders removal of encroachments

New Delhi, February 17
The Mayor of Delhi, Mr A. R. Verma, today inspected the Laxmi Nagar area in East Delhi. During the inspection focussed on sanitation and removal of encroachments from Priyadarshani Vihar, he ordered the MCD officials to remove encroachments from the streets. — TNS
