SC declines to stay transfer of TN Governor

The Supreme Court today declined to pass any interim order on Tamil Nadu’s suit, seeking to restrain the Centre from transferring Governor S. Ramamohan Rao to any other state without the consent of state government.

A Bench comprising Chief Justice R.C. Lahoti and Mr Justice G.P. Mathur refused to pass ex-parte order on the Tamil Nadu’s suit after state’s Advocate General (AG) N.R. Chandran pleaded for the same.

The Jayalalithaa Government, instead of filing a writ petition, had preferred to file a suit in the matter, which said that the Governor could not be transferred without the consent of the state government.

The court, however, directed the registry to list the suit for further hearing in its normal course.

The Jayalalithaa Government alleged that the entire exercise of the proposed transfer of some Governors, was aimed at brining in some person of the choice of Opposition DMK, which is an important alliance partner in the UPA Government at the Centre.
