Brawl involving former cricketer Yograj Singh
HC Judge refuses to shift case
Tribune News Service

Chandigarh, October 16
Two days after differences between the Bench and the Bar surfaced in a case involving former cricketer Yograj Singh, Justice K Kannan of the Punjab and Haryana High Court today refused to transfer the matter to another Bench.

Justice Kannan also directed in the open court the imposition of Rs 10,000 costs. Detailed orders are not yet available.

Justice Kannan also stayed investigations in the matter.

As the case came up for resumed hearing, an application for transfer of case was placed before Justice Kannan following the verbal spat that took place about two days ago. Taking a solemn view of the matter, Justice Kannan dismissed the plea.

About a month ago, former cricketer Yograj Singh was allegedly involved in the brawl with a former DSP. His NRI cousin Kuljit Kaur then moved the Punjab and Haryana High Court for initiation of action against the cops, who failed to register the case under appropriate sections of the IPC.

The brawl between Kuljit Kaur’s family and the retired DSP, Ashanand, and his two sons had allegedly taken place on August 24. Appearing on Kuljit Kaur’s behalf, senior advocate Puneet Bali told the Bench that an attempt to rape case under Section 354-B of the IPC was not registered despite the chest and neck injuries.

Bali added that Section 166A in the Code of Criminal Procedure, 1973, also made it clear that police officers refusing to register a case under the relevant section of the IPC were to be proceeded against.

Kuljit Kaur has already submitted a handwritten statement to a DSP, narrating the incidence of brawl between her family and the retired DSP and his two sons on August 24.

In her complaint to the officer, Kuljit Kaur had alleged that police officials were unwilling to lodge her complaint, even though she showed the bruises she and her children suffered. She also alleged that she along with Yograj Singh, Bhupender Pal Singh, Aaron and Tanya were made to sit in illegal detention for the whole night of August 24 at the Sector 5 police station. But the police allegedly did not detain the retired DSP Ashanand and his two sons the same night, but arrested them only the next morning.

DLF Homes fined for deficiency in service
Tribune News Service

Chandigarh, October 16
The UT Consumer Disputes Redressal Forum has directed DLF Homes Panchkula Private Limited, Sector 8-C, Chandigarh, through its director, sales and marketing, Ananta Singh Raghuvanshi, to pay Rs 20,000 compensation for deficiency in services, unfair trade practices and causing mental agony and harassment to the complainant.

The builder has also been directed to pay Rs 2,02,698, along with interest at 9 per cent to the complainant.

The complainant, Kamal Kumar, a resident of Sector 14, Panchkula, purchased an independent floor measuring 1,450 sq ft in the project ‘DLF Valley, Panchkula’ and was allotted property for a total consideration of Rs 57,56,500.04. Execution of the Independent Floor Buyer’s Agreement and payment of a total amount of Rs 17,71,945 was made by the complainant.

It was alleged that after the execution of the agreement, the builder sent a letter dated July 8, 2013, whereby the complainant was informed that in compliance of the order of the Supreme Court, the construction activities at the project site have been stayed and no further construction activities were carried out pursuant to the said directions.

It was stated that in such matters of delay, the company was not liable for performance of its obligations and that it would endeavour to complete the project subject to the delay of 12 months, which had occurred due to the stoppage of the work. Hence, it was requested to the complainant to confirm that whether he would agree to the above condition for additional time to be taken for completion of the construction. It was further informed that in case the complainant did not agree, then the builder would cancel the allotment and refund the amount paid by the former along with simple interest calculated at 9 per cent per annum.

Pursuant to above, the complainant had sent his consent to withdraw the allotment and had requested for cancellation of the property and refund of the paid amount with interest on July 18, 2013.

It was alleged that the amount deposited for the service tax had not been refunded with interest and he was not satisfied with the amount received.

The total amount along with interest refunded to the complainant by the DLF was Rs 19,65,188. The complainant has contended that the builder have, therefore, made less payment of Rs 2,02,698 to him.

The company was found deficient in giving proper service to the complainant and having indulged in unfair trade practice, the forum said.

Hearing deferred
Tribune News Service

Chandigarh, October 16
A court today deferred the hearing in a defamation case filed by two Indo-Tibetan Border Police (ITBP) personnel following their arrest on the charge of possessing fake currency notes, which were actually genuine, to December 11. The UT police and the SBI had prayed for dismissal of the suit saying that no legal notice was served nor entire court fee was paid by the complainants while filing the case.

The two ITBP personnel, Nain Singh and Amar Singh, had been arrested and kept in police custody for two days only to be released later as their case was found genuine. The suit was filed after the UT police, on May 17, 2013, arrested them and claimed to have busted a ‘fake currency racket’and recovering ‘fake’ notes amounting to Rs 91,000.

Amar Singh had procedurally drawn salaries of 70 ITBP men, amounting to Rs 11 lakh, from Jalandhar on May 16. The personnel were here for a training course at the ITBP’s Ramgarh centre. Of these, 23 men had given Rs 3 lakh to be deposited in their accounts at the SBI’s Chandigarh Air Force Station branch. The branch manager allegedly found that 91 currency notes of Rs 1,000 were ‘fake’. The two ITBP personnel were arrested. But the RBI checked the notes two days later and found them genuine. Based on the report, the judicial magistrate Aashish Saldi, on May 20, discharged the ITBP men.

Asiad winner honoured
Tribune News Service

Chandigarh, October 16
Punjab’s Mandeep Kaur, winner of 4x400 metres relay race at the Asian Games held in Incheon (South Korea), was honoured by Rahul Gandhi during his visit to the Panjab University campus here today.

Following dope offences, Mandeep bagged the gold medal, after returning from a two-year ban. Earlier, she had won gold medals twice in the Asian Games.

“The recent medal in the Asian Games is my answer to critics. After the doping charges, I was made to stay out of the coaching camps in Patiala and I was even barred to play in home competitions. For getting a proper training, I spent every single penny from my own pocket. However, the recent feat is a slap on the face of people, who disrespected me and tagged with me doping charges,” said Mandeep Kaur.

Kaur was all smiles after getting honoured by the Indian Youth Congress chairperson, Rahul Gandhi, during a function organised by the NSUI wing.

“Receiving the honour amidst the youths left with me with a proud feeling. There is no dearth of talent but one needs encouragement. To boost the morale of Punjab players, the state government should come forward and encourage players just like it is being done in the neighbouring states. No offence, but we are yet to receive what a winner deserves. Punjab can still serve Indian sports with best of the talent however, the youth must be motivated and sports must be promoted sports through various means,” said Mandeep Kaur.
