Golf Club to use FDs to follow SC order
Chandigarh, August 30 Golf Club president BS Gill said they will use the club’s hard-earned FDs and will submit them before the High Court in the form of FD, he said. The Supreme Court had directed the club to deposit 50 per cent of the amount within three weeks as directed by the Punjab and Haryana High Court. The club management had moved the apex court challenging the orders of the High Court. On July 19, the Deputy Commissioner had asked the club to deposit lease rent of Rs 8.59 crore for the period March 2008 to March 2014 within 15 days, failing which the premises would be sealed. The club had submitted that the UT Administration should fix the lease amount on the pattern of that of the Delhi Golf Club. The Delhi Golf Club pays less than Rs 6 lakh per annum as lease rent, whereas the UT Administration is demanding Rs 1.68 crore from the Chandigarh Golf Club for the year 2013-14. Moreover, the Delhi club sprawls over 179 acre while the Chandigarh Golf Club is spread over 132 acre. The value of the Delhi Golf Club land is much higher than that of Chandigarh, the club had submitted. |

Lok adalats settle 396 cases in a day
Mohali, August 30 A total of 1,449 cases were taken up before the 12 benches, specially constituted (six at Mohali and three each at Dera Bassi and Kharar). Giving details, Tarntaran Singh Bindra, Chief Judicial Magistrate-cum-Secretary, DLSA, Mohali, said the cases being taken up and disposed of by the courts were of all kinds, including civil suits, matrimonial, cheque bouncing, land disputes, etc. “In total 1,449 cases were taken up and 396 cases involving a sum of Rs 31,51,07,861 were settled. These cases were decreased from the pendency of cases in court,” TS Bindra said. He added that three Additional District and Sessions Judges, posted at Mohali, could not hold lok adalat today because of the ongoing computer training at the Chandigarh Judicial Academy. “Despite that the number of disposal of cases is quite satisfactory. The parties to the litigation are now well aware of the benefits of lok adalats and they rather wait for these adalats so that their cases may be settled amicably,” the judge said. Notably, lok adalats are being organised on every last working Saturday of the month. The general public and litigants, in particular, should avail the benefits of lok adalats as matters here are being settled amicably, thus saving time and money, TS Bindra added. “We also have a toll free helpline (number 1968) of Punjab Legal Services Authority, which is available 24X7 and can be dialed at the time of necessity,” he said. Insurance firm penalised
Chandigarh, August 30 Savikar Plyboards Limited, SCO 43, Madhya Marg, Sector 7, the complainant company, that deals in export of furniture and handcraft, alleged that it had taken an open insurance cover from the opposite party to secure the risk of all types of furniture and other allied items whilst in transit from anywhere in India to anywhere in the world. The complainant alleged that for one export shipment, a truck was booked for carrying the consignments containing 27 packages from Chandigarh to New Delhi. The consignment was loaded on the truck. Later, at a parking, the truck caught fire due to short-circuit in the electricity wire passing over it and the consignment was burnt. Intimation about the incident was given to the opposite party and the claim was assessed. Allegedly, the insurance company paid the claim to the truck owner equivalent to the loss incurred but lingered on the decision on the actual claim of the complainant. Later, it was repudiated. The opposite party said after the occurrence of the incident, the cause of loss was not established as claimed by the insured. It was further pointed out that the truck was left unattended by the driver and there was a gross negligence on the part of the insured in this regard. “The opposite party illegally and arbitrarily repudiated the claim of the complainant on the basis of the Investigation Report, which was not correct. Repudiation of the claim clearly amounted to deficiency, in rendering service, and indulgence into unfair trade practice,” the commission ruled. |
