Tribune news Service

Mohali, July 26
The state of Punjab has moved court against the Fortis Hospital, Mohali, for allegedly stocking and issuing an expired drug to a patient.

On July 22, Mohali drug inspector Amit Lakhanpal filed a complaint in the court of the Chief Judicial Magistrate alleging that the Fortis Hospital has contravened Rule 65 (17), Rule 110, condition No. 4 of Para 5 of the Schedule K read with Rule 123 of the Drugs and Cosmetics Rules-1945, and Section 18 (a) (vi) of the Drugs and Cosmetics Act 1940/Rules 1945, by stocking and dispensing a drug after its expiry date.

The action has been taken on the directions of the State Drugs Controller, Punjab, and the Food and Drugs Administration, Chandigarh.

The State Drugs Controlling and Licensing Authority, Punjab, has issued the prosecution order against the persons concerned of the hospital, stated the complaint.

The drug inspector stated that the hospital issued injection roles I.V. to a patient, Balbir Kaur, even as the expiry date of the medicine had lapsed.

Notably, Balbir Kaur’s kin Kanwarjit Singh, a resident of Sector 35, Chandigarh, had lodged a complaint against the Fortis Hospital for issuing expired drugs to Balbir Kaur on April 18, 2012.

It has also been mentioned in the complaint that an inquiry in this connection was also conducted by a team constituted by the then Mohali Civil Surgeon, Dr Rajiv Bhalla. “The inquiry report had confirmed that the drug in question had expired a year before the date of issue,” stated the complaint.

When contacted, the Fortis spokesperson said, “This is a two-year-old incident and it was clearly shown at that time that the injection was never administered because the injection was in the complainant’s (Kanwarjit) possession. The patient was discharged in a stable condition. We are not aware of any recent development in the matter and can comment only after getting a copy of the complaint.”

The complaint

Mohali drug inspector Amit Lakhanpal filed a complaint in the court of the Chief Judicial Magistrate alleging that the Fortis Hospital has contravened Rule 65 (17), Rule 110, condition No.
