HC pulls up UT Administration
Chandigarh, November 7 The strictures of sorts by Chief Justice Sanjay Kishan Kaul and Justice Augustine George Masih assume greater significance as the Division Bench was at the same time appreciative of Punjab and Haryana for ensuring consistent increase in the strength of officers to meet the inflow of cases. “We may need to only emphasise that the optimal strength of officers both for the State of Punjab and the State of Haryana is being reached as there has been consistent increase in the strength of officers to meet the inflow of cases, while this has not been so with the UT Administration and the result is that the judges manning the Courts in Chandigarh are highly overburdened affecting disposal of cases,” the Bench observed. The assertion came after UT senior standing counsel Sanjay Kaushal told the Court that the needful has been done by the Ministry of Law and Justice and the UT Administration. A proposal in this regard has been approved by the Ministry of Law as well as the Internal Finance Committee, consisting of finance division officers. The proposal was stated to be pending before the Ministry of Finance. The proposal includes the creation of a separate court for cheque bouncing cases. It has also been proposed to convert temporary posts into permanent. Also on the cards is the creation of 169 posts of ancillary staff in 20 courts of the Chandigarh sessions division. Before parting with the case, the Bench added: “We expect the approval from the Ministry of Finance by the next date, failing which we will be constrained to call for the personal presence of officers concerned.” The case will now come up for further hearing in the first week of December. The High Court had earlier this year taken cognizance of the vacancies of judges in Chandigarh District and Sessions Court. The development is significant as at present more than 60,000 cases are pending in the district court. The issue of vacancies in the lower judiciary was raised only recently during a conference of judges, attended by Ministers, in New Delhi. appointment of judicial officers Available information suggests 11.51 lakh cases were pending in the district courts of Punjab, Haryana and Chandigarh. But, the disposal was more than the institution of cases. No less than 16.31 lakh cases were disposed of by the district courts of Punjab, Haryana and Chandigarh, while 15.80 lakh new cases were filed. The High Court’s annual report for 2012 indicated that 913 judicial officers were working in the district courts of Punjab and Haryana as on December 31, 2012, compared to 735 on January 1, 2012. |
