HC notice to Administration
PU students had sought quashing of FIR lodged against them for holding protest
Saurabh Malik
Tribune News Service

Chandigarh, September 6
The echo of the protests against the Delhi rape case and the action against the protesters was heard loud and clear in the Punjab and Haryana High Court after Panjab University students knocked at its doors. They were seeking the quashing of the FIR registered after they went in a silent procession to the Governor House to submit a memorandum to the Governor. At that time, they were demanding adequate security arrangements for city girls.

Taking up the petition filed through counsel RS Bajaj, the High Court has issued a notice to the UT Administration. It has also been restrained from presenting a challan in the matter.

In the petition, Divya and five other students are seeking the quashing of FIR number 248 dated December 25, 2012, registered at the Sector 3 police station under Sections 147, 149, and 283 of the IPC.

Describing them as 'honest and law abiding persons', Bajaj said the petitioners were 'all young students of Panjab University'. They were aggrieved by the highhandedness of the Chandigarh Police in registering the 'absolutely false and frivolous FIR against them'.

Going into the background, Bajaj said the nation was shocked at the barbaric act and the 'unfortunate death of the young girl and the manner in which she was attacked' led to resentment among people at large. In Chandigarh also, the public at large had the similar sentiments. In Panjab University also, meetings were held, where the students condemned the incident and demanded adequate security for girl students in the city. It was unanimously decided by the students to hold a peaceful protest march and handover a memorandum to the Governor of Punjab.

Accordingly, on December 25, 2012, about 50 students from Panjab University, including the petitioners, proceeded on a peaceful march towards the Governor House to submit the memorandum.

Caring little for the sentiments of the young students, the Chandigarh Police started 'acting in a barbaric manner'. They manhandled the protesting students and forcibly took them to two different police stations and illegally detained them.

The police also forcibly obtained signatures of the petitioners and 'other similarly situated students' on blank papers and forms. It was learnt that the police officers told them that they were only fulfilling certain formalities and they should not worry. They also assured them that no drastic action would be taken against any of the students

But in the last week of July 2013, the petitioners received calls from the Sector 3 police station, asking them to appear in connection with the FIR registered against them. The petitioners were totally shocked on hearing this because they had never ever been apprised of the registration of any case.
