Natipora accused seeks bail
Aggrieved family says the accused, if released, could tamper with evidence
Tribune News Service

Srinagar, December 9
In the Natipora murder case, one of the four accused has moved court with a bail application, citing her “deteriorating health condition” in jail.
The complainant family and the locals have objected to the bail application of accused Almas Ara on the ground that the accused, if released on bail, may “tamper with the evidence and influence the witnesses”.

The Natipora murder case involves killing of 65-year-old Ghulam Mohammad Shah of Budshah Nagar, Natipora allegedly by Almas Ara, her husband and two sons in July this year during a fight over dumping of garbage.

In the bail application moved through her counsel, Almas has submitted that she is suffering from many ailments and her health may deteriorate further if she is kept under continued judicial custody.

Following Shah’s killing on July 4 this year, Almas was arrested along with her husband Dr Maqsood Hussain Khan, his two sons - Sadat Hussain Khan and Fahad Hussain Khan, and sent to jail for allegedly murdering Shah.

Almas, who is currently under judicial remand at District Jail Baramulla, in her bail application, has further stated that she has been falsely implicated in the case on the basis of a false and frivolous complaint.

Her bail plea has been opposed by the complainant family and the local welfare committee, saying that granting her bail at this stage may influence the trial.

“Our belief is that if the above mentioned accused is bailed out, she will surely tamper with the evidence of the case as well as influence the witnesses. We have full faith in justice and judiciary of the state and therefore appeal to the courts that she should not be set free on bail,” the local welfare committee has said in statement while objecting to the bail of accused Almas, which is listed for further hearing on December 11.

Following the incident on July 4, the J-K Police had registered a case against the accused family under Section 302 (murder) and produced a chargesheet against the four accused of the family before the Chief Judicial Magistrate Srinagar.

Subsequently, the CJM committed the case for trial to Sessions Court on September 8.

The killing

  • On July 4, a fight over dumping of garbage between neighbours in Budshah Nagar locality of Natipora in Srinagar had turned violent, leaving Ghulam Mohd Shah dead and his three children critically injured.
  • The accused Khan family had barged into neighbour Ghulam Mohd Shah’s house carrying lathis, baseballs and iron roads and assaulted the inhabitants.
  • Shah had succumbed to his injuries at SKIMS Soura on July 6 after he was hit with a baseball bat by the accused family during an argument over garbage dumping.
  • The Khan family, originally hailing from Poonch, were said to have been at loggerheads with the Shahs for a long time over a land dispute.
  • Following the incident, some locals had also ransacked the house of the accused Khan family and set their belongings on fire.

Baramulla, December 9
Property worth crores of rupees was destroyed in a devastating fire last night in Baramulla district of North Kashmir. At least 10 shops and two private offices including office of NGO Human Aid Society were gutted. The fire, reports said, erupted from Nanak Bhawan complex in Baramulla town around 1 am and engulfed many shops housed in the building.

Several furniture shops in the complex added fuel to the fire as the entire complex went up in flames in a few minutes, eyewitnesses said. A computer institute and an office of an NGO were also destroyed in the fire. The cause of the fire could not be ascertained, reports said. The Army soon pressed into service its fire tenders and the fire was brought under control after four hours. The locals hailed the efforts by the Army in dousing the flames.

The fire tenders, the affected shopkeepers alleged, took more time than anticipated in reaching the spot.

“The fire tenders had to cover less than one km but they took at least 40 minutes to reach the spot. The loss could have been minimised had the fire-fighting team reached the affected building in time,” said Habibullah, whose shop was destroyed in the fire.

The incident set off panic in the town during the night hours and locals rushed to the spot. Another shopkeeper Bashir Ahmad said, “The fire could have been brought under control had the fire tenders reached the spot in time. The phone of the main fire station in Baramulla was not working and fire tenders from Delina station, 6 km from Baramulla, reached first.”

The affected shopkeepers said the fire inflicted a loss of around four crore rupees. Meanwhile, in two separate fire incidents, at least five structures were gutted. According to police, timber shop of Mohammed Yousuf Najar at Fruit Mandi, Parimpora on the outskirts of Srinagar was complete damaged in the fire in the wee hours today. The fire was brought under control with the help of fire tenders and local police. Parimpora police has registered a case.

In another incident, fire broke out in a departmental store of Abdul Rashid Sheikh of Seloo in Sopore town this morning. The fire soon engulfed two shops. All the structures were damaged in the fire.

Tribune News Service

Srinagar, December 9
Minimum temperature across the Kashmir region again plunged below the freezing point, with mercury here falling close to the minus two degrees Celsius mark.
Gulmarg resort in north Kashmir received a brief spell of snowfall early morning, with the night temperature there falling to minus 5.5 degrees Celsius, lowest in Kashmir valley overnight, an official of state Meteorological department said. The famous skiing resort of Gulmarg had recorded one inch snowfall on Saturday.

In the city here, the minimum temperature overnight fell to minus 1.7 degrees Celsius, which is a dip of more than three degrees from the low of last night.

The day temperature in the city was recorded at 12.9 degrees Celsius, which is three degrees above the normal for this time of the year.

The weather department forecast suggested the minimum temperature around the city on Monday night will fall further to minus 2.0 degrees Celsius. Most parts of the valley had recorded a warm last night, with mercury remaining above the zero degree mark across the plains.

The minimum temperature in Ladakh region usually hovers many degrees

below the freezing point in winter months, sometimes falling down to as

Meanwhile, the minimum temperature in frontier Kupwara town in North Kashmir was recorded at minus 1.7 degrees Celsius and the minimum temperature in South Kashmir’s Qazigund town was recorded at minus 1.6 degrees Celsius, the official said.

Kashmir University goes for cost-cutting
Contemplates barring private vehicle service of high-ranking officials
Tribune News Service

Srinagar, December 9
Kashmir University is contemplating going for cost-cutting, particularly on transport and fuel charges, which cost the varsity a whopping Rs 50-60 lakh every year.
Kashmir University has a fleet of over 100 private vehicles which is being used by high-rung officials including the Vice-Chancellor, Registrar, Controller Examinations, Deans and Heads of Departments.

Highly placed official sources told The Tribune that at a meeting chaired by the VC, Prof Talat Ahmad, it was decided that the facility of private vehicles would be withdrawn in case of HoDs, Deans and senior faculty members, as the university is reeling under an acute financial crunch.

“Although a formal notification is yet to be issued, the private vehicle services are most likely to be barred from the next week onwards at the varsity. It had become pertinent as the university was unable to pay its employees their salaries on time,” an administrative official, wishing anonymity, said.

After the directive is enforced, the private vehicles would be used only by the trio of VC, Registrar and Controller of Examinations.

The decision, meanwhile, has not gone down well with senior teaching and non-teaching faculty members of Kashmir University.

“Even in Jammu University and other state universities, senior staffers have been allotted the vehicles for private use. The university should come out with a way to tackle the crisis and not bar officials from using the facilities,” a senior faculty member said.

‘Minor’ has been languishing in police stations for 12 days
Despite bail being granted, police has not released him
Tribune News Service

Srinagar, December 9
Lawyers of a Class IX student claimed that the boy was detained for the past 12 days at two police stations. He had not been sent to a juvenile home.
The counsels, Syed Babar Qadri and Gowhar Makhdoomi, said the boy was arrested on November 27. “He was arrested by the Nowhatta police and then shifted to the Parimpora police station where he is lodged at present. The boy’s age is 15 years and 10 months as per the school certificate,” Makhdoomi said.

The boy, a resident of old city’s Gojwara locality, has been detained under seven sections of the RPC. The counsels on Friday moved a bail application at a local court and pleaded that the boy was a juvenile under the law of land and international law.

“He is a law-abiding child. He never committed any offence or involved in any activity prejudicial to the security of the state,” the application stated.

Makhdoomi said the court had granted bail to the boy but ‘when his parents went to the Nowhatta police station, the officer in charge rejected the bail application’.

“This is not the first time the police has violated the law, they should have sent the boy to the juvenile home but instead they had kept him in the lock-up for 10 days where he was beaten and tortured,” Makhdoomi claimed.

No senior police official was immediately available for the comment. A police official at the Parimpora police station confirmed the boy is in their custody but said he has no idea about his age.

The state government has come under criticism from human rights groups, including Amnesty International, for arresting teenaged boys and locking them in facilities which have no special childcare support.

Last week, the Amnesty International issued a statement asking the authorities here to ‘halt the practice of arbitrary detentions in the state, in particular of children’ and reiterated its call to the JK government to amend the Juvenile Justice Act to bring it into a line with the Convention on the Rights of the Child.
