Allahabad HC repeals govt notice for creation of new district

The Lucknow Bench of the Allahabad High Court today repealed the Uttar Pradesh Government's notification for the creation of Chatrapati Sahuji Maharaj Nagar district which has since been renamed as Amethi.

Judiciary's role vital for equitable economic growth: PM, CJI

Prime Minister Manmohan Singh and Chief Justice of India SH Kapadia today said the judiciary had a vital role in making economic growth inclusive and sustainable and acknowledged the need for attracting investments to speed up development.

“Without the rule of law, well-connected people will grab an unfair share of growth, while the poor will suffer,” CJI Kapadia said in his presidential address at a conference on Economic Growth in Asia and Changes in Corporate Environment.

Delivering the inaugural address at the conference minutes later, the PM said, “The evolving economic space has to be addressed by all organs of the government: the executive, legislature and judiciary.”

The conference, organised by the Indian Law Institute (ILI), was attended by legal experts from India and a number of other Asian countries. Among those who addressed the function were Prof Yoohwan Kim, president of the Korea Legislation Research Institute, Attorney General GE Vahanvati, CJI-designate Altamas Kabir, Law Minister Salman Khurshid and SC Judge Swatanter Kumar.

Rejecting a notion that the rule of law was an impediment to economic growth, Justice Kapadia said it was rather the “single largest” stimulating factor. Further, a “minimum standard of fairness” was being ensured only through the rule of law, he explained.

Pointing out that the Constitution had mandated that the government “shall strive for economic democracy”, he said without it, “political democracy will be at peril.”

He said farmers and tribals had a fear that development was nothing but “displacement” and “this needs to be dispelled.”

Citing economic data, the CJI said even eight per cent GDP growth would generate only 12 million jobs a year, while the country required 10 million new jobs every year, going by the fact that 30 per cent of the population would be looking for avenues of earning in the coming years. If the growth slipped to 5.5 per cent for some reasons, the job generation would be a mere 8.25 million a year. Promoting investment was crucial for stimulating growth, he said.

Justice Kapadia suggested that India align its tax, corporate and commercial laws with the models suggested by the United Nations and the Organisation for Economic Cooperation and Development (OECD).

Lawyer creates ruckus

  • A Supreme Court lawyer, Santosh Kumar Suman, tried to disrupt the function by raising slogans against the PM.
  • As the PM walked up to the rostrum, Suman, who was seated among the delegates, stood up on the desk, took off his shirt and raised slogans against corruption and the hike in diesel prices.
  • The Prime Minister delivered his address after security personnel present at the spot whisked away the protester.

The BJP today joined issue with Prime Minister Manmohan Singh accusing him of mismanaging and ruining the economy and described as “deceptive and unconvincing’’ his address to the nation defending the fresh dose of economic reforms.

“You have mismanaged and ruined the economy... its’ wrong economic policies, lack of foresight and unproductive schemes are responsible for the present situation’’, senior party leader M Venkaiah Naidu said responding to the Prime Minister likening the current scenario to the grim 1991-economic situation.

The BJP leader sought to know if Prime Minister was “really serious’’ about the economic situation and reforms, what was he doing for the last eight years? He charged the UPA government suddenly woke up and initiated anti-people reforms only to divert the attention of people after it was “neck deep in corruption’’ and failed on all fronts.

On FDI in multi-brand retailing, he said it will create huge unemployment forcing 25 crore people on to the streets. Stating that the Government wants to favour four multinational corporations, he cited British Labour MP Keith Vaz’s caution against allowing such retail trade in India.

Accusing the PM of insulting Parliament and the people by giving a wrong assurance that there will be no FDI till consensus is arrived at, he said even UPA allies like the TMC, the DMK and the SP said they were not consulted and joined the protest.

“The PM’s response was disappointing and unconvincing. He says that diesel is used by only rich people. Crores of farmers use motor pump sets run by diesel and lakhs of them use tractors, which is run by diesel, to cultivate their lands. Is PM so ignorant that he doesn’t even know all this?” he said.

It’s wait and watch for Mamata

Mamata Banerjee does not want to take any hasty decision on the TMC’s future equation with other political parties at the national level in their fight against the Congress and the BJP.

Instead, she will prefer to wait and watch the future moves of some parties.

Incidentally, the state Congress today formally severed its ties with the TMC after resignation of the Congress ministers from Mamata Banerjee’s government, which had been taken as a retaliatory measures against yesterday’s resignation of the TMC ministers from the UPA-II government. Both the Congress and the TMC will now move separately with their respective political identities, ideologies, plans and programme.

The chief minister today met some of the former TMC ministers of the Manmohan Singh Cabinet along with other senior party leaders at the Writers Buildings and exchanged views with them on the current political situation vis-ŕ-vis the party’s future strategy to be followed towards the Congress and other like-minded parties, both at the national and state levels.

During the meeting, these ministers had briefed Mamata about their experiences gathered during the meeting with the Prime Minister and President Pranab Mukherjee.

Allahabad HC repeals govt notice for creation of new district

The Lucknow Bench of the Allahabad High Court today repealed the Uttar Pradesh Government's notification for the creation of Chatrapati Sahuji Maharaj Nagar district which has since been renamed as Amethi.

Accepting the petition of Manoj Kumar Rastogi and others challenging the government notification of July 1, 2010, the Bench comprising Justices Devi Prasad Singh, Shabibul Hasnain and DK Arora said, "The issuance of the impugned notification though administrative in nature but is violative of directives issued by the Central government under Rule 8(4) of the Census Rules, 1990, as such barred by Article 246(1) of the Constitution, hence invalid."

The petitioners had challenged the creation of a new district before December 31, 2011 on the ground that the census work was underway.

Assam, Arunachal reel under flood fury; rescue work on

The flood situation in Assam and four districts of the neighbouring Arunachal Pradesh remained grim for the second day today. Official sources said almost all districts of eastern Assam were facing flood fury while the situation in four districts of Arunachal remained unchanged with major rivers and their tributaries flowing above the danger mark.

Six columns of the Army and four units of the National Disaster Response Force (NDRF) teams were deployed in eastern Assam’s Tinsukia and Dhemaji districts yesterday to rescue marooned people. The fourth wave of flood in Assam has been triggered by incessant rain in upstream areas and eastern Assam for more than a week.

Over 4 lakh people in 13 of Assam districts have been affected in the current wave of floods. The affected districts included Baksa, Barpeta, Dhemaji, Dibrugarh, Golaghat, Jorhat, Kamrup, Lakhimpur, Nalbari, Sivasagar, Tinsukia, Udalguri and Sonitpur. More than 817 villages have been deluged. The government has set up about 50 relief camps where over 50,000 persons have taken shelter.

The situation at Dibru-Saikhowa National Park has also turned grim. The Kaziranga National Park in central Assam has also been partially submerged.

Army and NDRF rescue boats have to negotiate very strong currents of flood waters in eastern Assam.

Flood water has submerged vast areas in Lohit, Dibang Valley, Changlang and East Siang districts. One person was killed in the flood in the hill state.

In the worst-affected Lohit district, the local administration has sent an SOS to the state headquarters to arrange for evacuation of marooned persons from Tezu and Namsai sub-division. In all, 411.1 mm rainfall has been recorded in the district since Friday.

Many villages like Mabira, Morapat, Mazgaon, Alubari, Tekelibam, Tengapani of Namsai subdivision were cut off due to flood. Tezu township has been in the darkness for two days as floods damaged electricity supply system at Alubari, which also supplies power to Anjaw and Lower Dibang Valley districts, besides Sadiya subdivision in neighbouring Assam.

Dibang Valley district has been lashed by heavy rain for the past six days and the flood situation is likely to worsen if the showers do not subside in the coming days, district officials said.

Special status for Bihar a matter of right: Nitish

In a forceful message to the Centre, Bihar Chief Minister Nitish Kumar today said that the special category status was a matter of "right" for Bihar and its people and not "begging for alms".

"The special category status demand is the right of people.....We are pursuing our rightful demand and not seeking the same as alms," he said at a public meeting here. In a stern warning to the UPA government, Kumar said that the people will teach those, who are opposed to the special status demand, a lesson in the 2014 general elections.

The CM, who is undertaking nearly a month-long 'Adhikar Yatra' since September 19, said the next government at the Centre would be formed by only that party which would grant special status to Bihar.

Stating that the grant of special right was a must for allround development of Bihar, Kumar said that the measure will fast track development activities.

"Whatever development has taken place in Bihar has taken place with the state funds," he claimed. Once the special category status was accorded, then there would be additional funds at its disposal for pumping in development activities, he said. "The private investors will also come to Bihar in a big way as they will stand to get various tax benefits after grant of special status to the state," he said. PTI

UGC declares NET result first, posts qualifying criteria later

Lakhs of candidates who appeared for the refurbished, MCQ-based National Eligibility Test (NET) this year are asking the same question-why did the UGC declare the result first and post the final qualifying criteria later.

Close to 5.70lakh candidates appeared for NET conducted on June 24 this year to certify students’ eligibility for the posts of lecturer in colleges and universities; only around 7.26 pc passed. Courtesy objective format introduced for the first time this year for all three papers of NET, numbers of applicants doubled from 2.5 lakh in 2011 when the pass percentage was just 5.

However, none of these candidates knew until a day after their result had been declared on September 18 as to what formula the UGC followed to rule them out.

The NET notification issued around March this year stated two things clearly-the minimum cut-off marks which every candidate would have to score in each of the three NET papers separately to be considered for the preparation of final results and final qualifying criteria for NET to be intimated by the UGC before the declaration of results.

But the final criterion was uploaded by the UGC on its website only after the declaration of the result. Consequently, candidates were clueless about their status until September 19 when the UGC suddenly disclosed new qualifying criterion saying every general category candidate would have to score aggregate 65 pc marks (out of 350 marks) in all three NET papers to be successful.

UGC officials say they introduced the concept of aggregate marks to sift meritorious students.

Yeddy loyalists relieved of party assignment

In a feeble attempt to discipline former Karnataka chief minister B S Yedyurappa, the state BJP today removed his loyalist Ayanur Manjunath from the post of the spokesperson of the Karnataka unit of the party.

Former MP Dhananjay Kumar, who too is close to Yeddyurappa, also has been removed from his post as Karnataka BJP’s special representative in Delhi

“Manjunath has been relieved from his post”, Prakash, a BJP functionary who handles the media in Bangalore, told the TNS.

Dhananjay Kumar, when contacted, said, “Apparently, the tenure of the other Delhi-based special representative by the name of Nagesh has been extended but my tenure has not been extended. This is being interpreted as my removal from the post of special representative. I have not received any formal communication from the party so far”.

Manjunath confirmed that his office in Shimoga had received a fax copy of the decision to remove him from spokesperson's post. “I don't know the reason for this. I will discuss the issue with the state BJP president Eshwarappa”, he said.

Yeddyurappa, who has been sulking ever since he was asked by the BJP to quit the chief minister’s post in the wake of the Lokayukta’s charge against him of receiving cash from a mining company, is increasingly becoming rebellious heaping embarrassment on the party.

After he successfully engineered the revolt against the then chief minister Sadananda Gowda and had him replaced by Jagadish Shettar, Yeddyurappa resorted to acting like an opposition leader in the Assembly session held in July much to the merriment of the opposition Congress and the JD(S).

Recently, Yeddyurappa said he did not require the BJP to become the CM of Karnataka again and announced that he would not attend the party’s national executive meet at Suraj Kund in Haryana on September 26.

‘Barfi!’ to represent India at Oscars

Ranbir Kapoor starrer 'Barfi!', a love story of a deaf and mute boy set in the fairy-tale world of 1970s Darjeeling, has been nominated as Indian's entry to the Oscars next year in the foreign film category.

The film, released only last week, has been directed by Anurag Basu.

The story revolves around Barfi, a poor but lovable deaf and mute boy, who lives a happy life despite his disability.

He soon meets and falls in love with a pretty Bengali girl Shruti but heartbreak follows. He then develops a bond with his autistic childhood friend, which is played by Priyanka.

The film also marks the debut of Southern star Ileana D'Cruz.

'Barfi!' beat 19 other films to represent India at the Oscars. "Barfi is the Indian entry to the Oscars. We selected it to represent the country out of 20 films," Supran Sen, Secretory General of Film Federation of India told PTI.

Basu, whose last film 'Kites' was a big disappointment at the box office, has been lauded for the sensitive handling of the subject.

Ranbir, who has managed to impress critics and his fans with his acting despite having no dialogues, said he took inspiration to portray the character from Hollywood legend Charlie Chaplin and his grandfather Raj Kapoor.

Disney UTV's managing director Siddharth Roy Kapoor, the producers behind the film, also hailed its selection from India to represent Oscars. — PTI
