No set formula for compensation: HC
Chandigarh, September 10 Justice Jitendra Chauhan has also ruled that the Courts can go beyond the pre-set limit of Rs 15,000 for medical expenses, in injury cases. The case The significant ruling came on an appeal filed by Oriental Insurance Company Ltd. against Gurdev Singh and other respondents. The company had challenged the award dated November 20, 2008, passed by the Motor Accident Claims Tribunal, Panchkula. Allowing Gurdev Singh’s claim petition, the Tribunal had awarded a compensation of Rs 4, 63,400 to him, resulting in the filing of an appeal by the insurance company for reduction in the compensation amount. On April 20, 2000, Gurdev Singh was travelling on a scooter, when it was hit by a truck near the Saket Hospital in Chandimandir. He suffered permanent disability as his leg had to be amputated due to injuries. Counsel for the insurance company argued that the compensation amount, awarded under Section 163-A of the Motor Vehicle Act, had to be assessed as per a structured formula The verdict Justice Chauhan ruled the awarded compensation “appears to be little more than what could have been as per the structured formula”. But is not so, “in view of totality of facts and circumstances of the case”. “The structured formula is not a cast iron straight jacket formula. It is one of the efficacious modes to provide relief to the victim of accidents. The facts of each case need to be examined in the light of surrounding circumstances. “Formula is meant only to assess fair and adequate compensation and, if it appears to the court from the peculiar facts and circumstances of the case that an additional amount of compensation is to be awarded, the same cannot be denied for the reason that the relief sought in the claim petition is not provided in the formula. Such an approach will be contrary to purpose and object of this Welfare Act”. Enhancing the compensation by Rs 40,000, Justice Chauhan added even in injury cases filed under Section 163-A, the Courts can go beyond the pre-set limit of Rs 15,000 for medical expenses. “Medical expenses would not only be restricted to immediate and urgent medical attention…. It must include, keeping in mind the nature of injury suffered, provision for all such expenses as have to be reasonably incurred or can be expected to be incurred to enable the injured claimant to stand back on his feet and lead a normal life…” |

Dust, fumes leave Kiwis fuming
Chandigarh, September 10 The renovation work at the CLTA courts in Sector 10 is being given top priority by the UT Administration and CLTA officials as the international tennis tournament is scheduled to start from September 14. But the makeover, which includes re-carpeting of roads and painting walls, has been quite difficult for the players to cope with. “After landing in the city, we decided to have a morning training session. But after reaching the match venue, we found that construction work was going on. The fumes from these road-levelling machines have left us with throat problems. Also, the venue is full of dust because of cleaning and everything,” said non-playing Captain Marcel Vos. When asked about the problem faced by them during court practice sessions, he said, “The game requires us to have concentration, but these drill machines, sheet cutter equipments are a huge problem for us. I am just hoping that the work will get over before the final day of the tournament,” said Vos. On the local weather conditions, he said, “It is quite hot over here, but we have a few days left to get acclimatised to the conditions. The boys are confident and will perform well in these conditions,” said Vos. The New Zealand team, headed by their non-playing captain, arrived yesterday. Talking about the team, Vos said, “The team is quite experienced. Moreover, the lads know how to react during pressure games. The absence of senior players from the Indian squad could be an advantage for us.” The New Zealand squad includes Jose (Rubin) Statham, Michael Venus, Artem Sitak and Daniel King Turner. Both the teams attended morning and evening training sessions at the match venue. Ace tennis player and top seed Yuki Bhambri is expected to join the Indian squad tomorrow. The Indian and Kiwi contingent are yet to decide their final team combinations. |
