Triple murder case
Consider premature release of convict: HC tells Admn
Saurabh Malik
Tribune News Service

Chandigarh, June 18
Fifteen years after Chandigarh woke up to the rude shock of a triple murder in the serene surroundings of Sector 18, the Punjab and Haryana High Court has asked the Chandigarh Administration to consider premature release of convict Abdul Gaffar, as he has already spent 14 years behind bars.

It was on the intervening night of July 12 and 13, 1997, that Pushpa Rani, her daughter-in-law Uma Rani and granddaughter Milli were done to death by tenant Abdul Gaffar. He along with his friend Matloob Ahmed were later arrested by the police for murder and other offences under Sections 302, 392 and 34 of the IPC. The incident had sent shock waves across the city.

For committing the triple murder in house number 1235, Sector 18-C, Chandigarh, Gaffar was convicted separately. Three separate life sentences, in addition to five years rigorous imprisonment for voluntarily causing hurt in committing robbery under Section 394 of the IPC, were slapped on him.

His case for premature release was considered by Inspector-General of Chandigarh Police. A report from Meerut District Magistrate was also received, stating that Gaffar was “involved in a murder and dacoity case at Chandigarh and there was this possibility of the petitioner indulging in illegal activities if released prematurely”. His prayer was eventually rejected on March 29.

Appearing before Justice Ranjit Singh, counsel for UT Administration said considering the District Magistrate’s report and the fact that the petitioner was accused of committing a heinous crime, it is viewed that he does not deserve the consideration for a premature release.

After hearing the arguments, Justice Ranjit Singh ruled undoubtedly, the petitioner had been convicted for a heinous offence; and accordingly had undergone 14 years of actual sentence and 20 years, including remission.

Justice Ranjit Singh added: “His case is, thus, covered under the policy for premature release”. Though the Meerut District Magistrate had not recommended his release on the ground that he may indulge in illegal activities, there was no basis of saying so. “It is so mentioned only on the basis of some unspecified apprehension. This is without any basis.”

In his detailed order, Justice Ranjit Singh asserted: “Will it be fair to reject the prayer for a premature release only on the ground that convict is accused of committing a heinous offence”.

“The petitioner has already undergone more period of imprisonment, than others imposed life imprisonment would have undergone”.

“A case is made out for issuing direction to the government to release the petitioner prematurely as his case is fully covered by the policy and there is no justification either offered or available on record to deny the order of premature release to the petitioner.

“The impugned order is, therefore, set-aside and the state is directed to reconsider the case of the petitioner for his premature release keeping in view the policy and the law on the subject referred to”.
