HC dismisses plea of deputationists
Chandigarh, April 28 Their contention was that premature increment was given to other Punjab government employees for staying away from the strike in 1978, but they were discriminated against as they were not given the benefit. The order came on a petition filed by Raj Kanwal and other petitioners against the State of Punjab, through its Chief Secretary. At the time of filing the petition, Kanwal was clerk with the office of the “1-Chandigarh Air Squadron NCC (Education Department)”. Taking up the matter, Justice K Kannan asserted, “The petitioners who occupied non-gazetted posts with the Chandigarh Administration on deputation from the Punjab government seek parity in treatment for premature increment, as done to Punjab government employees who did not participate in the general strike called by Punjab government employees on February 8, 1978.” Justice Kannan further said, “The government had extended the premature increment to employees of the Punjab Government who had been sent on deputation to the BBMB. The petitioners’ case is that the discrimination practised by the State of Punjab in excluding persons, like the petitioners, who had been sent on deputation to the Chandigarh Administration, with persons who had been on deputation with the BBMB is bad in the law.” Justice Kannan added, “The government will explain in its reply that the persons who had been sent on deputation to the Chandigarh Administration got all benefits with the orders of the Centre and not with the orders of the Punjab government and that the deputationists had been given the postings on voluntary concurrence and were not entitled to any premature increment, especially when there was no call from non-gazetted employees of the Punjab government who were on deputation to the Chandigarh Administration to go on strike.” Dismissing the petition, Justice Kannan asserted, “In this case, the benefit was to reward persons who had resisted the call of general strike, that was afflicting state services. The persons who had been sent on deputation to the Chandigarh Administration had no such dilemma and it was pointed out by the respondent that there had been no call by non-gazetted employees of the Punjab government on deputation to the Chandigarh Administration to participate in the strike. The benefit of such an incentive cannot be given across the board and to to undeserving classes. The decision not to give the benefit to the deputationists with the Chandigarh Administration was perfectly justified.” |
