Man acquitted of killing wife
Had been convicted two years earlier
Saurabh Malik
Tribune News Service

Chandigarh, April 17
For nearly six years, he lived with the stigma of being his wife’s killer. But, just over two years after his conviction in the murder case, city resident Nirmal Singh has been able to shake off the allegations and stands acquitted of the uxoricide charge.

The murder

The cold November morning gave no indication to Inspector Jagir Singh of the heat that a woman’s murder in Sector 32-A was about to generate.

Flipping through the documents at the Industrial Area police station on November 16, 2009, Jagir Singh had no inkling that the father and son duo before him were alleged killers, till one Surinder Singh allegedly spilled out the beans.

The prosecution claimed that at about 6.30 am, Surinder Singh, along with accused Nirmal Singh and Ajit Pal Singh, came to the police station. Surinder Singh stated that he was returning home at about 6.15 am from morning walk, when he saw accused Nirmal Singh of house number 557, Sector 32-A, standing along with his son Ajit Pal Singh.

Both looked perplexed. After Surinder Singh assured them of secrecy, Ajit Pal Singh confided in him that the previous night at about 9.30 pm, he and his father Nirmal Singh had murdered his mother Malkiat Kaur.

The motive allegedly was her behaviour. “The entire family was upset on account of her behaviour; and the accused were feeling ashamed from the neighbours and relatives,” it was claimed.

Nirmal Singh caught hold of Malkiat Kaur, while she was preparing the meal in the
kitchen, and Ajit Pal Singh gave a blow on her head and neck, as a result of which she fell on the floor.

Both accused requested Surinder Singh to produce them before the police. Nirmal Singh then supported the statement made by his son Ajit Pal Singh. Subsequently, the FIR was registered and Malkiat Kaur’s body was recovered from the kitchen, as per the prosecution story.

The Trial & the Appeal

After sifting through the evidence, the Sessions Judge held Nirmal Singh guilty of committing his wife Malkiat Kaur’s murder and sentenced him to undergo life imprisonment. But the Sessions Judge did not find Ajit Pal Singh guilty and acquitted him. No appeal was preferred against his acquittal.

Challenging the conviction, defence counsel RS Cheema and Tanu Bedi asserted that since Ajit Pal Singh had not been found guilty, Nirmal Singh, too, could not be held guilty.

Moreover, he could not be proceeded against “merely because his wife was found murdered in his house”.

Moreover, the appellant and his son were at a jagrata in Mohali at the time of the incident.

The final verdict

The Bench of Justice MM Kumar and Justice Alok Singh ruled: “The weapon of offence and fatal injuries are not attributed to the accused-appellant; there is no eyewitness; extra-judicial confession made to Surinder Singh, taxi driver, does not inspire confidence; Ajit Pal Singh, to whom fatal injuries on the person of Malkiat Kaur and weapon of crime are attributed, has already been acquitted by trial Court; no appeal was even preferred against the acquittal….

In our opinion, prosecution has failed to prove the guilt of the accused beyond reasonable doubt….

“The theory of defence of the accused that he was present in the jagrata cannot be ruled out completely. Therefore, accused-appellant is entitled for benefit of doubt. Consequently, conviction and sentence of the accused is totally unjustified.”
