Compensation denied
Complainant sought relief for hurting his religious sentiments
Tribune News Service

Chandigarh, March 18
In an interesting order, the UT District Consumer Disputes Redressal Forum has ruled that compensation cannot be awarded for religious sentiments. “Expectations against religious sentiments and allegations of deficiency in service and unfair trade practice for non-delivery of vehicle against emotional feelings with regard to religion cannot be an acceptable ground for allowing a complaint,” said Madhu Mutneja, member, District Forum - II, Chandigarh, in an order.

The complainant, LM Dwivedi of Shimla had filed a complaint against Swami Automobiles and Mahindra and Mahindra Ltd, alleging that he had deposited Rs 50,000 with the dealer for booking a Scorpio LXI/red on June 30. The dealer offered delivery of the vehicle in September. As the expected time of delivery was in ‘shraads’ which was an inauspicious time according to Hindu mythology, the complainant did not wish to take the car at that time. The complainant applied for refund and bought a Honda vehicle on October 19. Swami Auto refunded Rs 51,597 to the complainant, including interest.

Complainant contended that the dealer and company must pay compensation, punitive damages and litigation expenses for indulging in unfair trade practice and hurting his religious sentiments.

In reply, Pankaj Chandgothia, advocate for the dealer, stated that the complainant had specified red as his colour choice for the vehicle, which was not regularly available. No commitment regarding time of delivery was made. When the vehicle was offered, the complainant declined to take delivery citing his religious beliefs. Chandgothia contended that the dealer could not be held guilty of deficiency in service.

The forum, comprising its president Lakshman Sharma and member Madhu Mutneja, dismissed the complaint, "finding no merits in the allegations".

The organisers might have left no stone unturned to make the tourney a success but failed to attract the crowd even from the cities like Chandigarh and Jalandhar, where hockey is known to be the backbone of all the sports. The reason is well known to everyone but the question arises, where the ‘politics and profit’ will lead the sport.

These days, a spectator thinks twice for spending Rs 50 for a hockey match while on other hand, Rs 350 is a minimal amount for a cricket T-20 cricket match. On the present status of the sports, The Tribune team has come across some sports lovers, taking their opinion on slowly vanishing craze of an old game like hockey.
