Decide on greenbelt in three months: HC
Tribune News Service

Chandigarh, February 3
The Punjab and Haryana High Court today set a three-month deadline for the UT authorities to decide on the issue of developing a greenbelt at Sector 45-A here.

The directions came on a petition filed by the Residents Welfare Federation against the UT Administration and other respondents.

In the public interest litigation (PIL) placed before the Bench of Chief Justice Ranjan Gogoi and Justice Mahesh Grover, the petitioner, through counsel Ashok Sharma Nabhewal, had sought directions for the development of the greenbelt in front of houses 101 to 113, near Ajit Karam Singh International School.

The Bench asserted, “According to the petitioner, residents of the locality, the area was kept reserved for a greenbelt and funds provided for the purpose of development of a greenbelt in the area by the local Member of Parliament out of government-allocated funds.

“The grievance raised by the petitioner is that notwithstanding the above, no progress has been made and, in fact, the Chief Architect of the UT has, till date, not supplied the layout plan, drawings and blueprint of the proposed development work.

“The petitioner has also stated that it filed a representation to the Mayor on July 11, 2008, which was followed by representations to other authorities. None of the representations having been answered one way or the other, the petitioner was left with no other remedy but to move court under Article 226.”

The Bench ruled, “Having regard to the subject matter involved and the process which will be required to be initiated, it is our considered view that instead of entertaining this PIL at this stage, it will be more appropriate to leave the matter to the wise discretion of the authorities concerned.

“Such authorities will examine the matter, particularly in the light of the facts stated by the petitioner in its representations dated May 25, 2005, December 16, 2006, August 12, 2007, and October 18, 2007, and thereafter, proceed in the matter as may be warranted in the law.

“Necessary action by the respondent authorities will be initiated and completed within three months from the date of receipt of this order or a certified copy thereof. In the event action, as warranted in the law, is not taken by the respondent authorities, the petitioner will be at liberty to avail itself of all legal remedies”.
