Quota for wards of HC employees Saurabh Malik Tribune News Service
Chandigarh, November 24 The direction came on a petition filed by Kanchan Sindhu. In her petition, the student had earlier asserted that she was denied admission to the first year of integrated BA-LLB (hons) course in Kurukshetra University, even though her father was an employee of the Punjab and Haryana High Court. The reason behind the denial was that “she cannot be considered against a quota reserved for the wards of the employees of the State of Haryana,” counsel NC Kinra had told the court. As the case came up for resumed hearing, Justice Surya Kant asserted that the petitioner had been granted admission, rendering this writ petition infructuous. “Nevertheless, it shall not absolve the States of Punjab, Haryana or UT Chandigarh from taking an appropriate policy decision in accordance with the law. At this stage, counsel for the State of Punjab submits that a policy decision has been taken and is likely to be notified soon”. “The writ petition is accordingly disposed of with a direction to the State of Haryana and UT Chandigarh to take the policy decision in accordance with law and notify the same,” Justice Surya Kant asserted, while setting the deadline of a maximum three months for the implementation of the order. The Bench on October 12 had directed: “Let both State counsels have categorical instructions as to how the employees working on the establishment of the Punjab and Haryana High Court are not held entitled to weightage/benefit/reservation being granted to the wards of the employees of the States of the Punjab and Haryana, failing which this court shall be constrained to restrain the state governments from granting such benefits to the wards of their employees”. During the hearing, an affidavit was filed by the State of Haryana “categorically mentioning that the state government has decided to grant equivalence to the High Court employees with the employees of the Government of India posted in Chandigarh or Haryana in connection with the affairs of the Haryana Government for the issuance of a residence certificate”. |
