No VAT on Motor Vehicle Tax

The state government has decided to levy Motor Vehicle Tax (MVT) without VAT. The plight of people had been highlighted in these columns. Prem Singh Saini, officiating DTO, said the confusion over charging of MVT had been resolved, though he did not get an official letter, it was decided in the Cabinet that the MVT would be charged without VAT.

When asked why people were being fleeced at the DTO’s office, he replied that he did not know that the official work was being handled by private persons. He said as the matter was brought to his notice, he restricted the entry of private persons to the office. He added that the guilty would be dealt with strictly. Employees of the DTO’s office had leased out work and employed private persons, who issued licences, registration numbers and challans.

Manoj Banda, secretary, Hindu Organisation, who launched the campaign against corruption, hailed the government’s decision.

He demanded that section officer should be present in the DTO’s office.

He said the officer had an additional charge of Ropar. He demanded that money be refunded to those who had deposited MVT with VAT.

Funds not released for four months

Most of the government primary schools are finding it hard to implement the midday meal scheme, courtesy shortage of funds. Sources said the schools had not received funds for the past four months. Around 450 schools in Ambala provide midday meal to nearly 25,000 students.

Rajesh Verma, general secretary, Government Primary School Teachers Association, said, “For several months, government primary schools have not received money. Teachers have been spending from their own pockets or buying ration on credit to feed the children. Teachers have now expressed inability to meet expenses since the funds have not been released to the schools after July this year.”

The education department attributed the delay in payment to the non-release of funds by the finance department.

Teachers said they were bearing the expenses as people who sent their children to school were very poor.

However, the District Education Officer admitted that the schools were facing a lot of inconvenience in implementing the midday meal scheme. She added that the matter had already been taken up with the higher authorities.

Two killed in mishaps

Ambala, November 7
Kamal, a resident of Tepla village, Ambala Cantt, died on the way to the PGI Chandigarh. He was hit by a gas tanker near Rajgarh village on the Ambala-Rajpura road.

In another incident, Shahid Husain (25), a resident of Moradabad, fell down from a train. He died on the spot on Chuha Bridge near Ambala Cantt railway station on the Ambala-Saharapur railway tracks.

Sources said the victim was hanging on to the door of an overcrowded compartment when he was hit by a pole and fell down on the tracks. The body was sent to the Civil Hospital, Ambala Cantt, for an autopsy.

Market panel chairman killed in mishap

BANUR: Chairman of the market committee Rajpura Nirmail Singh died in a road accident near Banur last night. He was hit by a Swaraj Mazda tanker on the Rajpura-Chandigarh. 

Nirmail Singh died on the spot. The driver of the tanker fled from the spot. The body was handed over to the family after an autopsy. A case was registered in this connection. — OC

Notice of motion issued
 Brick wall on Burail boundary sought

The Punjab and Haryana High Court today issued notice of motion on a petition filed by the Sector 45-A Residents Welfare Federation, alleging that the powers-that-be had been ignoring their “genuine needs” by not constructing a brick wall on the boundary line of Burail village and removing encroachments.

In its petition against the Chandigarh Housing Board, the UT Administration and other respondents placed before the Bench of acting Chief Justice MM Kumar and Justice Rajiv Narain Raina, the federation asserted that it had been “highlighting problems of residents before the authorities and the difficulties faced by them”.

They had been seeking “the removal of obstructions, such as encroachments on V-5 roads, and the construction of a brick wall in order to protect the residents at large from the daily traffic jams”. “The authorities had kept silent and have not paid any attention to the genuine needs of the public at large”.

The petition, filed through advocate Ashok Sharma Nabhewala, said the Chandigarh Housing Board was allotted land to construct categories of dwelling units and the sector’s layout plan was also prepared.

In the sanctioned plan, a brick wall with barbed-wire fencing was provided on the boundary of Burail village. Instead of constructing the brick wall due to obstruction caused by the villages, a weak grill was installed, which was uprooted by villagers.

HC wants separate account for property tax deposited by schools

The Punjab and Haryana High Court in its orders has stated that property tax, if deposited by schools in Chandigarh, should be kept in a separate account.

In case appeals filed by the municipal corporation are dismissed, the amount shall be refunded to applicants, the Bench of Justice Hemant Gupta and Justice GS Sandhawalia ruled, while dismissing three applications filed by the schools for vacation of an ex-parte order dated April 6.

Vide the order, the appeals against the order passed by a Single Judge on September 24, 2010, were admitted and the operation of the order was stayed.

The Single Judge had quashed a notification fixing property tax on institutional lands.

The order came on a bunch of 23 petitions filed by St John’s High School-26 and other institutions.

The writ petitioner had contended that the municipal corporation’s resolution to levy tax on institutional lands and buildings was absent. Therefore, the notification was without jurisdiction.

The Bench ruled: “The argument that the payment of tax at this stage will amount to undue enrichment is again not tenable. The tax has been levied in terms of the statutory provisions and after complying with the procedure. It is for the writ petitioners to device means of payment of tax.”

“Since the tax is, prima facie, legal, the vacation of the order passed by the court will lead to the stay of levy of tax.”

The Bench also asserted, prima-facie, it did not find any procedural irregularity in imposing tax.

The Bench asserted: “Prima facie, we find that the order of Single Judge may not be sustainable. The resolution specifically excluded the levy of house tax on residential lands and buildings used for residential purposes. Meaning thereby, that except lands and buildings which are being used for residential purposes, there is a resolution of the municipal corporation to levy tax on all lands and buildings.”

The Bench added: “The exemption to schools in Punjab has nothing to do with the tax. Still further, schools are imparting education to children again cannot provide any binding precedent on this Bench. Prima-facie, we do not find that there is any procedural irregularity in imposing tax. The levy and recovery of tax serves public purpose.”

The Bench concluded: “Any observation made in the order, is only for the purpose of deciding the present applications for vacation of stay.

It shall not be taken into consideration while deciding the appeals on merit. The appeals have already been ordered to be heard within a year on April 6. Since the issue is short, we are of the opinion that the interest of justice warrants that the present appeals be posted for final hearing in the month of January, 2012, high-up in the list.”

Accused gets bail

A local court today granted bail to Kamal, an accused in the kidnapping of a student of Carmel Convent School, on October 11. Kamal, who is the mother of a friend of the prime accused, Inderjit Malik, was arrested on October 31. The court granted her bail after furnishing the bail bond of Rs 50,000.

Kamal is a resident of Sector 36 and was accused of facilitating the kidnapping of the girl. Kamal was the mother of Arjan, who was a friend of the prime accused Inderjit Malik. Besides, she was also close to the co-accused Sangeeta, a PGI doctor, who was absconding and had allegedly helped her in the kidnapping.

They are accused of assisting Inderjit Malik in the abduction of 16-year-old ‘princess’. Both Malik and princess were arrested on November 3. The girl is a ‘princess’ of an erstwhile province in Himachal Pradesh.

Prime murder accused held

A day after the arrest of three accused in a murder case, the police claimed to have arrested main accused Sonu here today.

Sonu allegedly thrashed 24-year-old Satwinder Singh, alias Simmu, a resident of Ropar, with his three accomplices near Fun City here on October 18. Satwinder later died at the PGI.

Yesterday, three of the accused, Ravinder, Mayank and Raman, were arrested. On interrogation, they revealed that Satwinder was a close friend of Sonu before certain differences cropped up between them.

“During heated arguments, Satwinder used foul words for Sonu’s wife. Sonu lost his cool and decided to pay him back. He convinced us that he was wronged and we decided to teach Satwinder a lesson,” they said. — TNS

Mastermind surrenders in court

In the fake driving licence scam, mastermind Manish, a resident of Sector 45, surrendered in the court of the Chandigarh Chief Judicial Magistrate (CJM) here this evening.

Inspector Dulip Rattan said the accused used to provide licences by forging the signature of DSP (Traffic) Vijay Kumar. He added that they had got the two-day police remand of the accused and further investigations were on.

The police had earlier arrested six persons, including Jaswinder Singh, alias Jassi, owner of Zamidara driving school, and recovered 28 files based on fake papers that were prepared by the gang from the office of the Registration and Licensing Authority (RLA), Sector 17.

Investigation revealed that the accused had documented more than 200 driving licences by using fake stamps and signatures. During initial investigation, the police had discovered that the accused also used to forge the signatures of sub-inspector Sukhdev Singh, in charge, Chandigarh Traffic Park, as part of the process of completing licence files.

The scrutiny of the recovered files had revealed that the beneficiaries had not appeared for the driving test at the Chandigarh Traffic Park in Sector 23. Their files were found to be having valid serial numbers.

5 held for impersonation

The police has arrested five persons, including a lecturer and four girls, in a case of cheating during the Haryana Teachers Eligibility Test conducted yesterday.

It said lecturer Sanjeev Kumar had hired a qualified girl Sonia for appearing on behalf of his wife Neelam, a resident of Panipat. The accused, Sanjeev, is posted at Government Senior Secondary School (GSSS), Achina in Bhiwani district.

Sonia had appeared in the examination centre at Government Model Senior Secondary School (GMSSS), Sector 22, and Sanjeev was apprehended from outside the school.

The accused were produced in a local court and released later. Sanjeev’s wife was arrested from Panipat today.

Sub-Inspector Rajeev Kumar said, “Sonia had confessed to have appeared for the exam on behalf of Sanjeev’s wife.”

The age-old barter system has came alive, as organisers of the ongoing table tennis tournament at the Table Tennis Hall, Sector 23, have allowed a caterer to install a food stall on the premises in exchange of providing banners at the venue.

tably, as per the rules of the Chandigarh sports department, no one can install any stall at the venue.

“This is a clear violation of rules. The department does not permit any stall to be installed on the premises to make profits or for personal uses. They are only provided with the facilities of the venue, which include playing arena, changing rooms and other facilities. The department was unaware of the step taken by the organisers. The situation will be checked and necessary action will be taken against violator,” said KS Bharti, district sports official, Chandigarh sports department.

Interestingly, the players were been overcharged as compared to the market price at the food stall. The person sitting at the counter was charging Rs 25 for a cold drink, while Rs 50 for a grilled sandwich. Besides this, a domestic cylinder was also seen used to make tea at the stall.

“The food stall is installed to serve the guests coming to watch the ongoing matches. We have asked one of our caterers to put up a food-selling tent, as he provided us banners, but I am not aware of the overcharging aspect,” said Harish Kumar, secretary of the Chandigarh Table Tennis Association.

But when the official was asked that the installation is against the rules, he replied, “We have given this permission after considering one of the officials of the department,” said Harish. Later he revealed that the officials have given the permission after considering the coach appointed on the premises. However, when contacted, Chandigarh Sports Council coach Rajeev Kaushal stated, “The manager of the venue must be aware of the situation. I am related to the coaching department, I cannot consider anything,” said Rajeev.

Roshia went down against Ananya by 3-2 (11-8, 8-11, 11-9, 3-11 and 11-3) while in the semi-finals of same category, Roshia defeated Monit Kaur of New Public School, Sector 18, by 3-0 (11-8,11-9 and 11-1) and Ananya overpowered Chinmayee by 3-0 (11-9,11-8 and 11-4).

In the finals of Boys’ (U-10) category, Ishaan Kapur of DAV Public School, Sector 8, defeated Vansh Mahajn by 3-2 (6-11, 11-3, 9-11, 11-5 and 11-8) and in the finals of cadet Girls (U-12) group Paavan defeated Anushka by 3-0 (11-6, 11-4 and 11-6).

Shaurya of St Anne’s School overcame Sahil Sharma by 3-0 (13-11, 11-6 and 11-2) to win the finals of Cadet Boys (U-12) category.

Gagandeep, Tuba romp home in carrom

Gagandeep Singh and Tuba bagged the men and women’s singles, respectively, during the 13th Raj Kumar Babuta Memorial Carrom Ranking Tournament, which concluded at St Stephen’s School here.

In the men’s final category, Gagandeep defeated Mohd Hassan. The win came in the third game on seventh and eighth board. Earlier in the semifinals, Gagandeep defeated Asit by 22-09, 15-17, 25-00, while Hassan ousted Neeraj Bharti by 21-10, 07-21, 21-15.

Tuba of St Stephen’s School won the women’s titles after defeating her sister, Farheen by 9-8, 13-16, 25-23.

Mohd Hassan, Mohd Shaquib and Farheen made five slams, while Mohd Hassan secured a hat-trick of three slams.

njab cricket team defeated Jharkhand by seven wickets on the third day of the ongoing CK Nayudu Trophy league match held at Kenan Stadium, Jamshedpur.

After resuming from their overnight score of 276 for 9, Punjab team’s tail enders added 21-runs and bundled for 297 in 86.1 overs. Gurinder Singh remained unbeaten on 40-runs.

Jharkhand in their 2nd innings failed to face Punjab pacers Siddharth Kaul (2 for 41) and Jaskaran Singh (3 for 56) and bundled out for 156 in 57.4 overs. KK Gopy (31) and Prashant (26) were the main contributors in team’s total.

While chasing the target of 105-runs, the winners scored 106-runs for the loss of 3-wickets in 22.4 overs.

Jeevanjot (42) and Gurkirat Mann (27) remained unbeaten and guided the team to victory.

After the win, Punjab team stood first with 16 points while Tamil Nadu team is holding second position with 12 points.

UP to lock horns with Chandigarh

The UP cricket Girl’s team moved into the finals of the ongoing Junior National Cricket Championship for Women (U-19) being held at Government Model Senior Secondary School, Sector 26, here today.

The team defeated Gujart by 31-runs in the semi-final match, to face Chandigarh in the finals of the tournament.

Bating first, the winning side scored a total of 140-runs against Gurat team. Sana Khattoon scored an unbeaten 48-run while Roshini (52) was the other scorer for the team. For Gujrat, Shewta took 3 for 21.

In reply, Gujrat team failed to achieve the target in the allotted slot and managed to score 109 for 5.

For Gujrat, Shah Sarvi scored 44-runs.

Cricket academy opens today

Honorary Secreatry of Punjab Cricket Association (PCA) will inaugurate the PCA (U-14) Residential Cricket Academy at Togan on Tuesday.

The academy will be launched in the presence of the Punjab Ranji team at St Stephen’s School, Togan. A total of 19 players in the category have been selected from various cities of Punjab after holding trials.

The players after medical age verification were admitted to St Stephen’s School, Togan, where they would study and will be provided with hostel facility.

A total of seven batsmen, five medium pacers, five spinners and two wicket keepers were admitted to the academy. “The academy will act as a feeder to the talent to the association in future,” said Sushil Kapoor, spokesperson PCA.

In the match of senior category, Khanna United Football Club defeated District Football Association, Ambala by 3-0. Suraj for Khanna United scored the first goal in 38th minute while Harminder Singh doubled the lead in the 56th minute of the game.

On other hand, Saurav of Ambala’s outfit failed to reduce the margin after missing an open net goal but Pawandeep Singh sealed the team’s victory. Suraj of Khanna Club was declared man of the match.

In the junior category, DPS, Sector 40, overcame Durga Public School by 2-0 in the match decided in tie breaker after a 1-1 draw.

Aman of Durga Public School, Solan opeoned the account for the team in 14th minute whereas Ekam levelled the score for DPS.

In the tie breaker, Gagandeep and Sukhmandeep of DPS scored goals while Sumit and Kavit failed in their attempt. Jaswinder from Durga Public School, Solan, was declared man of the match.

Seven-year-old Ranveer Duggal upset 17-year-old Chandan Gulati in junior snooker category during the ongoing 28th Chandigarh State Billiards and Snooker Championship, being held here today.

A student of St Stephens School, Ranveer defeated Chandan Gulati by 2-1 (23-43, 60-48 and 56-46). Ranveer also participated in the snooker nationals held in Ludhiana and six-red national tournaments.

In another match of same category, Aseem defeated Rishab Gupta by 2-1 (42-50, 59-45 and 49-39) while Ashish Nada thrashed Tanurag Gautam by 2-0 (49-19 and 44-33) and Amit Verma defeated Raman Koka by 2-0 (60-40 and 60-53)
