High Court rejects PGI chemist’s plea
Chandigarh, September 16 The misconduct attributed to Gupta, Aditya Medicos licensee, was that he had sold “a repacked plasma sterilised paediatric-size aortic cannula to a patient meant to be used during surgery”. Taking up the petition filed against the Post-Graduate Institute of Medical Education and Research (PGIMER), Justice K Kannan asserted: “In the days where adverse media publicity brings serious disrepute for integrity of the organisation, the fact that there were media reports that used surgical items were being circulated in the hospital and offered by sale in PGI could not have been taken lightly by the administration. “Therefore, if the respondent had taken a serious action for cancelling the contract itself, I cannot fault the same…. It involved not merely lack of integrity with the contracting party, namely, the respondent, but it attempted to cheat an ailing patient. “It was serious enough for the respondent to take the decision that it did. I find no reason for interference. The writ petition is dismissed.” Justice Kannan further asserted: “On the facts brought before the court with statements recorded from three doctors and a nurse, it is a clear fact that the product supplied by the petitioner was a repacked sterilised cannula. “The issue can never be whether the act had caused any untoward incident. If the evidence brought through the inquiry secured proof of misconduct, it means a much more serious act of peddling a used product as an unused one and pricing an expensive product of over Rs 1,000 to a patient as though it was new. “The petitioner denies that there was any admission, but I am convinced that there was enough and weighty evidence to support the finding that the petitioner was guilty.” |

HC notice to Haryana
Panchkula, September 16 The PIL filed by advocate Vijay Bansal stated that the landfill site had to be away from habitation clusters and forest areas, but the dumping ground was situated amidst a thickly populated area. The High Court dismissed the application regarding relocating the proposed site for the construction of a solid waste management plant, which was going to be set up at Jhuriwala village in Panchkula. The order read, “The matter is yet at the stage of meeting the approval of the Ministry of Environment and Forests of Union Government. The objection raised by the petitioner is also incorporated. It is obvious that the claim of the petitioner at this stage will be wholly premature.” The whole town’s garbage was being dumped at Sector 23, but the proposal of the Haryana Urban Development Authority to set up a treatment plant at Jhuriwala had raised hopes as it would treat the garbage generated by Panchkula, Pinjore and Kalka. |
