The Tibetan parliament, on the last day of the session, Penpa Tsering, the speaker of Tibetan parliament in Exile addresses during a session at Dharamsala on Friday. today decided to hold another special session in May to amend the charter (Constitution) for finalising the devolution of the Dalai Lama’s power to the elected leadership.

Special session to amend charter in May

The Tibetan parliament, on the last day of the session, today decided to hold another special session in May to amend the charter (Constitution) for finalising the devolution of the Dalai Lama’s power to the elected leadership.

Karma Yeshi, a member of parliament, said the parliament would take a final decision over amending the charter and devolving the Dalai Lama powers, as per his wish, before the next government takes over in June.

Resolutions

* To form another panel consisting of MPs and members of the cabinet to look into amendments in the Tibetan charter and framing rules

* Committee must submit its report before April 11

* To convene a general body meeting in May to discuss changes to be brought in the Preamble and the charter and to incorporate new clauses

* To convene another extra session of the parliament to discuss and amend the charter

It adopted four resolutions. Sources here said as per the first resolution, the Tibetan parliament had decided to form another committee consisting of members of the cabinet and MPs to look into amendments of the charter and incorporation of rules on the basis of a report submitted earlier by a committee headed by the present prime minister-in-exile.

As per the second resolution, the committee will have to submit its report to the parliament before April 11.

The third resolution seeks to convene a general body meeting in the third week of May. At the general body meeting, all important functionaries of the Tibetan government will discuss about the proposed changes in the preamble and the Tibetan Charter and regarding the incorporation of additional clauses.

The sources said the additional clauses would be required to create provisions for retaining the Dalai Lama as the symbolic head of the Tibetan government. Many Tibetan MPs, while participating in a debate over the issue in the parliament, had called for retaining the Dalai Lama as the symbolic head of the government. A special post of president could be created for the Dalai Lama, the sources said.

In the fourth resolution, the parliament decided to convene another special session to discuss and finally amend the charter for devolving the Dalai Lama’s power to the elected leadership.

The parliament is likely to decide on the issue under directions from the Dalai Lama. Despite reluctance of the Tibetan parliament that fears losing legitimacy, the Dalai Lama has remained firm on devolving his powers to elected leadership.

According to PTI, the Tibetan parliament today gave its formal approval to the Dalai Lama's wish to quit as the political head of the community.

Prime Minister of the Tibetan government Samthong Rimpoche told the Tibetan Parliament that the House had agreed to the desire of the spiritual leader for an amendment to the Tibetan Charter to relieve him of his political duties.

Tainted IPS officer Thind dead

The death of controversial IPS officer BS Thind will bring the curtains down on a number of criminal cases faced by the 1974 batch officer who collapsed in the district courts yesterday where he had come in connection with a case.

Thind (60) died at IGMC this morning after suffering a cardiac arrest. He had felt uneasiness while he was in the courts yesterday and was rushed to the IGMC where he breathed his last today at 9.30 am.

It had become a habit with Thind to court controversy and be in newspaper headlines whether it was the cases filed against him or his levelling serious charges against the Chief Minister and his own colleagues in the police service. In fact, he had even filed a case before the Central Administrative Tribunal (CAT) after he was denied promotion to the rank of DGP while his batchmates were elevated to the rank.

Not only was Thind facing a number of cases but he had also filed a complaint in the Lokayukta against PK Dhumal and former CBI chief and DGP Ashwini Kumar for allegedly misusing their position. He had also levelled serious charges against the present DGP D.S. Manhas and ADGP (Law and Order) SR Mardi.

He had retired in June last year and was here in connection with an alleged financial irregularities case faced by him while he was the MD of Agro India Packaging Ltd (AIPL) in the mid-nineties. Another case of alleged extortion had been registered against him on the complaint of a Parwanoo businessman Ashok Mittal based on an audio CD in which investigations are still on.

Thind’s trouble began after the BJP assumed power in Himachal in December 2008 as his name had prominently figured in the chargesheet prepared by the party while the Congress was in power. During the Congress regime, he wielded great influence owing to his proximity to then Chief Minister Virbhadra Singh.

Thind was facing a CBI inquiry with regard to huge loans raised by him by mortgaging property owned by him in Punjab and Chandigarh. It was after the CBI case was registered against him that he had been placed under suspension by the Himachal government which was not revoked till he finally retired last year.

Uneasy calm in Paonta Sahib

Solan, March 25
An uneasy calm prevailed in Paonta Sahib after a violent clash between two groups had claimed three lives and injured two even as 400-500 policemen marched through the town to prevent any untoward incident.

Members of a community, whose eight shanties had been burnt, were yet to return with their families fearing more attacks from the other community. Though the district administration led by Deputy Commissioner Meera Mohanty visited their jhuggi site and assessed the loss to foster confidence among the residents, the community members seemed to be in panic. The administration was trying to contact these people but the efforts had failed to yield any results.

It was learnt that the about 60 families had hidden themselves in the surroundings areas like Puruwala, Khidrabaad in the neighbouring Uttrakhand.

Several rumours kept the administration on the tenterhooks throughout the day which included a call to shut down business establishments and death of the two injured who were recuperating in the hospitals. The administration had to publicly announce that all was well and shops reopened after a brief closure in the day.

The DC said Section 144 of the CrPC, which prohibited the assembly of more than five people, remained enforced even today and the situation would be reviewed tomorrow. The police was yet to arrest the culprits.

Bhim Sen is CIC

Meanwhile, the government posted Ajay Mittal, principal secretary, Home, as Principal Secretary to the Chief Minister. He will hold the post for the second time. He will also hold the charge of the Excise and Taxation Department.

Narinder Chauhan will be the new principal secretary, Home. He will also hold the additional charge of the Irrigation and Public Health.

Prem Kumar, principal secretary, Food and Civil Supplies, has been given the additional charge of the Tribal Development. — TNS

CM lays community centre’s stone

The Chief Minister laid foundation stones and inaugurated various schemes in the public and private sector worth Rs 26 crore in the Kasauli constituency today.

He laid a foundation stone of Rs 12 crore community centre under the Integrated Housing and Slum Development Programme. He also inaugurated the 7th unit of the Anand Automative Group.

Earlier, the Chief Minister planted a sapling of Rudraksh at the local Municipal Council complex. The staff of the MC, Parwanoo, presented a cheque for Rs 2,100 towards the CM Environment Fund on the occasion.

Two private clinics told to pay damages

In a significant decision on medical negligence, the district consumer grievance redressal forum (DCGRF) today directed Sanjivni polyclinic and a Panchkula-based clinic run by Dr Tarsem Jindal to pay Rs 4.30 lakh compensation along with 9 per cent interest to the complainant, Rita Devi, a resident of Dhaban at Balh in the district.

According to Rita Devi, she was admitted to Sanvini Hospital, Sundernagar, and was diagnosed with gall bladder stone on 17 January, 2008. Dr SP Kaushal at the clinic advised her to undergo surgery. On 26 January, 2008, Dr Jindal performed surgery on her and she was discharged from the hospital on February 1, 2008. But her pain persisted and she was again operated upon after four days at Panchkula by the same surgeon. When her condition did not improve, she was operated for the third time by Dr Jindal at Panchkula on February 26. But her health deteriorated and she was referred to PGI where she was operated to relieve her of the problem.

Approaching the forum, she accused Dr Kaushal and Dr Jindal of medical negligence and sought compensation.

Hearing the parties, the forum found the accused responsible for medical negligence and directed them to pay compensation of Rs 4.30 lakh along with 9 per cent interest to Rita Devi. The accused were also directed to pay Rs 5,000 as cost of litigation.

Govt ignoring Chamba, says RTI activist

The Himachal Pradesh government has meted out a “step-motherly treatment” to the district of Chamba even as huge funds are being spent on the development of other districts of the state, alleged Swami Bhuvneshwar Sharma, chief of RTI Bureau, Chamba, in a press release issued here yesterday.

Himachal Pradesh had been earning 12 per cent royalty and 1 per cent local area development fund amounting to approximately Rs 400 crore towards power generated by the hydropower stations owned by the National Hydroelectric Power Corporation operating in Chamba district, Sharma said. He lamented that not much of this income was spent on the development of Chamba.

Sharma flayed the government for “discrimination” with the district despite the fact that the district is replete with rich natural resources with potential for hydroelectricity, tourism, medicinal herbs and horticulture.

He said the detailed information sought by him through RTI from the Secretary (Power) to the Government of Himachal Pradesh had revealed startling facts about the royalty received by the state government from three hydroelectric projects -- Baira-Siul, Chamera stage-I and II, operating in the district and regretted that not much attention was being paid towards developing the areas in the vicinity of these hydropower projects.

To safeguard the interests of Chamba district, the RTI Bureau, Chamba, would file a public interest litigation against the state government in the Himachal Pradesh High Court, Sharma said.
