Maintenance for spouse despite detention: HC
Saurabh Malik
Tribune News Service

Chandigarh, November 29
Prison won’t bar your spouse from getting maintenance, the Punjab and Haryana High Court has made it clear. The ruling came on a petition filed by Gurjant Singh against his wife, Lovepreet Kaur. He claimed that his wife was undergoing sentence in a murder case. As her needs were being taken care of by the state, he was not required to pay maintenance.

Taking up the petition, Justice Ranjan Gogoi asserted, “The conviction and detention of a person in the criminal case does not obliterate the legal rights of a citizen. Apart from the basic needs provided by the state to persons in custody, such persons do have other needs, which they are entitled to satisfy on the basis of the rights conferred to them by law including the provisions of Section 125 of the CrPC.”

Going into the background of the case, Justice Gogoi said, “The petitioner filed this application under Section 482 of the CrPC, against an order dated July 6, 2007, by which the additional sessions judge of Barnala, in exercise of revisional powers, has affirmed the order dated August 10, 2006, granting maintenance in favour of the respondent’s wife by the trial court.”

“By the orders, the respondent’s wife has been granted maintenance at the rate of Rs 1,500 per month along with litigation expenses amounting to Rs 2,000.”

Going into the technicalities, Justice Gogoi asserted, “Section 397(3) of the CrPC bars a second revision by the same party. The petitioner cannot overcome the statutory bar by describing the application to be one under Section 482 of the CrPC.”

On merits, Justice Gogoi asserted, “The only contention on merits, that has advanced, is that in the year 2003 the respondent’s wife was convicted of an offence under Section 302 of the IPC and she is presently in custody. As all her needs are being taken care of by the state, it is submitted that the order of maintenance may be interfered with. The court finds no merit in this application. It is dismissed, however without any order as to cost.

“It is submitted by the counsel, for the petitioner, that the respondent may have remarried while on parole or an interim bail. If that be so, it will always be open for the petitioner to invoke the provisions of Section 127 of the CrPC, if advised.

ASIAN GAMES
Heroes welcome to silver medallist Abhijit
Donald Banerjee

Chandigarh, November 29
Abhijit Chadha is back with a silver medal. The 19-year-old city golfer was part of the India quartet that won the team silver medal at the Guangzhao Asian Games in China.

Abhijit was among the three best scorers on the second and third day of the golf squad. In the team event, the three best scores were counted on each of the four days to determine the winning team.

It was bad luck for Abhijit that he could not compete in the individual competition after he was disqualified for submitting a “wrong card” on the opening day.

Remembering those moments Abhijit said he had handed over the card to the scorer without totaling the scores.

The eight over par card came back to him with the query that the ninth hole had been left blank. "If it was blank how did the scorer write the score of 41 at the turn?” Questioned Abhijit. On a closer look he found a hazy four at the ninth. "But it was no use arguing, I was scrapped from the individual competiton,” added Abhijit.

Playing for the team, he got off to a good start. The city lad appeared to have tamed the Dragon Lake Golf Club greens. He built up a good score and was playing a good three under on the 14th. A couple of bogies on the 15th and 17th saw him finish at one under. On the third day also Abhijit played well to be par till the 16th. But again two bogies on the last two holes saw him at two over in the third round.

His scores were counted in the team score on the second and third day. On the last day he returned a four over 76 card. He was all praises for Rashid Khan of Delhi.

The four-member Indian squad, Rashid, Abhinav Lohan, Abhijit and Rahul Bajaj, finished second with a total of 874.

They finished far behind the South Korean team, who finished at 22 under 842 to retain the top Asian slot. At Doha, the Indian squad had clinched the silver medal. Talking about the playing conditions, Abhijit said the greens were hard and fast and there were swirling winds on the first and third day. “Our team outplayed others on days there was no wind. But then Koreans were masters in swirling winds,” said the golfer.

Abhijit gave credit to Jesse Grewal, who had honed his skills. "This was the first time I came across long bunker shots. This aspect is missing in the golf courses in India,” said Abhijit and coach Jesse agreed. The Chandigarh Golf Association (CGA) rolled out the red carpet for their hero. CGA president JS Cheema honoured him with a silver plaque. Enthusiastic young golf trainees cheered him. Cheema and other office-bearers of the CGA were out in full strength for the ceremony. Jesse Grewal was there to see Abhijit being honoured. After all Abhijit was just 10 when Jesse took him under his guidance. "The 10-year-old has today blossomed into a focussed and determined golfer,” said Jesse.
