HC tells FCI to curb malpractices
Saurabh Malik
Tribune News Service

Chandigarh, March 3
The Punjab and Haryana High Court wants the Food Corporation of India (FCI) to take remedial measures to “stop malpractices” by its officials “so that the traders and the farmers are not harassed unnecessarily.”

The assertion by Justice LN Mittal came on an appeal filed by the FCI. Instead of making the full payment to a commission agent after the money was demanded, the FCI officials had taken the plea of shortage in the delivery of wheat.

Taking up the appeal by the FCI’s district manager against commission agent Nathu Ram Rishi Pal and others, Justice Mittal asserted the agent had filed a suit for the recovery of Rs 1,81, 290 for wheat supplied on credit basis. But, defendant FCI and its officials did not pay the whole amount.

Responding to a notice sent by the agent, the defendants “wrongly asserted that there was shortage of 110 quintal of wheat”. Taking up the suit filed by the agent, a civil judge (junior division) at Sunam on August 10, 2006, held the plaintiff entitled to the principal amount, but deducted the amount of 110 quintal. Allowing the appeal, the Sangrur district judge modified the judgment and decreed the suit in the plaintiff agent’s favour, resulting in the filing of the appeal by the defendant FCI.

As the appeal came up, Justice Mittal ruled: “The dispute remains regarding the alleged shortage of 110 quintals of wheat supplied by the plaintiff to the defendant…. Even if the defendant’s version is accepted that they had sent letter dated September 11, 2000, intimating the plaintiff of the short supply, it was after four-five months that the first intimation of the alleged short supply of wheat was given.

“The defendants unilaterally after four-five months could not have burdened the plaintiff with the responsibility of the alleged short supply of wheat, when the defendant while accepting the delivery of wheat from the plaintiff did not raise any such objection.”

Justice Mittal asserted: “It is highhandedness of the defendants that they alleged short supply of wheat after several months, when the plaintiff demanded his balance amount. The defendants cannot be allowed to do so.” Dismissing the appeal in limine, Justice Mittal said: “Copy of the order be sent to the FCI.”

The two have been drumming up support even for the release of Sarabjit Singh, the Indian prisoner in Pakistani jail.

Sanjay Bumbroo
Tribune News Service

Chandigarh, March 3
Sports lovers in the city were in for a shock, as the UT administration has not allocated any funds for an equestrian academy to be set up in Sarangpur village. The UT administration in order to provide better facilities to sports enthusiasts had yesterday decided to launch a multi-discipline drive to speed up sporting infrastructure in the city.

The administration had stated that several key projects in the city had already been completed and it was working on many others, which would be ready by the second half of 2010-11. These include state-of-the-art 10-lane athletics track in Sector 39 and its first outdoor synthetic-surface basketball court. The number of works which have been completed include judo boxing hall in Sector 42 at the cost of Rs 74.3 lakh; swimming pool in Sector 23 into an all-weather facility at the cost of Rs 42.37 lakh; provision of electronic true color LED display board at the Hockey and Cricket Stadia in Sector 16; and additional infrastructure facilities at the CLTA in Sector 10 at the cost of Rs 90 lakh.

Former Secretary of the Equestrian Federation of India Col Sarparatap Singh (retired) talking to The Tribune rued that equestrian, which is one of the Olympic discipline, has been left out by the administration. He said the former Governor, Punjab, and UT Administrator had taken a keen initiative for setting up the equestrian academy in Sarangpur village that would have brought the city on the international map.

Singh said he was surprised to see that the equestrian sport had been left out, which depicted the indifferent attitude of the UT administration towards the game. He urged the Chandigarh Equestrian Society to take up the matter with the administration so that the work on the ambitious project could be started soon.

It is pertinent to mention here that the land for the equestrian academy at Sarangpur village near Chandigarh has been identified and the map for the prestigious project was to be submitted to the engineering wing of the UT administration to know the exact cost of the project.

However, Sanjay Kumar, Finance Secretary, said the setting up of the equestrian academy along with other sports such as skating, shooting range were in the pipeline and would be taken in the next financial year. He said setting up of the academy would be gradually taken after received report about the total cost of the project from the Engineering Department.
