Court issues summons to IGP
Chandigarh, February 23 The Punjab and Haryana High Court has summoned him in the case of a missing 11-year-old, a resident of Nayagaon. Taking up Nayagaon resident Sushila’s petition for directions to the police to track down her minor daughter, Justice TPS Mann has asserted an additional affidavit dated February 18 submitted by the Deputy Superintendent of Police, City-I, Mohali, clearly shows that “the police is taking conventional steps to find out the whereabouts of the minor daughter of the petitioner”. “Keeping in view the age of the petitioner’s daughter, there is every likelihood of the child being taken away to far-off places and not kept in nearby areas. “It has already come on record that the police has also sent the photographs and other details of the missing person to all senior superintendents of police of the country. But till date, no information has been received about her.” “Let the IGP, Patiala Range, be present in person on the next date of hearing so as to apprise the court of what steps can be taken to find out the whereabouts of the minor daughter of the petitioner.” Justice Mann also fixed August 18 as the next date of hearing in the matter. Hailing from Uttar Pradesh, Sushila had earlier claimed that her minor daughter was abducted from her house on August 18, 2008, and the police had done nothing to trace her, except for the recording of a daily diary report. Working as a household maid, Sushila said her husband expired about six years ago. Bringing the role of the police under scanner, she said the DDR falsely stated that the child was not mentally sound, even though she was good at studies. Her counsel, R.S. Bains, added that the Nathari incident “can happen in every village, if the response of the police to a missing girl child was apathetic”. |

Shifting of Liquor Vend
Chandigarh, February 23 Arora said according to the excise policy of the Punjab government, the liquor vend cannot be located within a distance of 50 m from an educational institution or a religious place. However, the liquor vend in Sector 52 is situated at a distance of less than 10 m from the Government Middle School. The vend also has an ahata (enclosure for drinking) on its premises, which is at even lesser distance from the boundary wall of the school. As such, the liquor vend is a nuisance and vitiates the educational environment of the school, the petitioner submitted while alleging that similar instances of liquor vends being in the vicinity of educational institutions were quite common in Punjab. He pleaded that the respondent authorities be directed to devise some procedure so that such things do not take place in future. In this context, the petitioner suggested that the municipal corporation or gram panchayats concerned must be required to give a certificate, before a liquor vend is opened, that the nearest educational institution or religious place is beyond a distance of 50 m from the proposed site of the vend and a similar affidavit must be obtained from the vend owner. Plea allowed
Justice K.Kannan of the Punjab and Haryana High Court has allowed the plea of petitioners Kewal Krishan and Dharam Paul of Grain Market, Chandigarh, and quashed the orders passed by the administration and the estate officer. The allotment of
SCO 42, Sector 31, purchased by them in open auction on December 2, 1975, had been cancelled vide the order and the revision petition against it was dismissed by the Adviser to the Administrator on October 21,1988. The Administration had ordered resumption of the site on July 10,1979 for failing
to pay in time one of the installment. |

Notice issued to VK Janjua
Mohali, February 23 Though the case was listed for tomorrow, it was deferred today. After hearing the prosecution, the court issued the notice. In the petition, filed by Balkar Singh, SP (Vigilance), who is the investigating officer of the case, it had been stated that Janjua had attempted to decide the corruption case against himself and declared his lawful arrest as “abduction”, period spent in custody vide judicial orders as “illegal confinement”, all evidence against him as “false and fabricated”, without even bothering to approach the court for any redressal. By making a complaint to the SHO, Sector 17 Police Station, Chandigarh, for the registration of a case, the accused had practically conveyed to this court that proceedings in the corruption case were irrelevant, since he had already appraised the evidence, ‘judged himself’, pronounced himself as ‘innocent’ and had declared the Vigilance Bureau officers ‘and other unknown persons’ as perpetrators of various offences. Janjua was arrested in a trap case on November 9, 2009, following which the Ilaqa Magistrate remanded him first in police custody and then in judicial custody. Later, Janjua approached the Special Court in Mohali on November 21 for his bail, which was granted on December 2. |
