HC sets aside order on resumption of house
Chandigarh, February 3 The court ruled the administration was being spared action for contempt of court. The petitioners, Bahadur Singh and his nephew Rattan Singh, had earlier contended that the estate officer had sealed their house in Sector 21 on January 14, 2005. The resumption orders were issued following allegations that the residential house was being used for commercial purposes in violation of the terms of allotment, which had been made for residential purpose. The petitioner said the house had been rented out and the tenant had opened a dairy in the name of Baba Dairy without their permission. The petitioners had filed an eviction petition against his tenant, which was pending before the court. Referring to the litigation pending in the high court, the petitioners said though they had moved an application before the UT estate officer seeking restoration of possession of the
house, it was rejected on June 27, 2005. The petitioners then filed a civil writ petition before the high court, pleading for declaring the UT administration’s act illegal and for quashing the resumption orders passed by the respondents. The petitioners also held the administration adopted a “soft approach” against dairy owners in the city due to “political considerations”. After hearing the rival contention, justice Kannan observed though the tenant’s act of changing the use of the building was indeed in a violation of the terms of its allotment, the landlord had no role in it. The landlord attempted to evict his tenant on the ground of unauthorised change of use of building, the court held. |
