SC stays non-bailable warrant in civil suit
New Delhi, June 3 A vacation Bench, headed by Mr Justice Arijit Pasayat, stayed the high court order issuing an NBW against Jugraj Singh, a resident of Tellewal in Barnala tehsil and at present working with an organisation at Via Localita Pizzi in Italy, while admitting his appeal. The apex court has issued notice to Jugraj’s wife Birpal Kaur and sought her reply to his appeal, raising four important questions of law on the high court’s action. Relations between Jugraj and Birpal Kaur went sour after she got her MBBS degree from Russia in 2002. Prior to her getting admission to a medical college in Russia in 1995, the couple had lived together at Brunei in Darusslame after their marriage in July 1993 and a son was born to them, who could not survive, according to Jugraj’s petition. He had also claimed that he had financially supported his wife in pursuing her MBBS degree. On the other hand, she had accused Jugraj of turning her out of his home at Brunei in Derusslame in
February 1994. She filed a divorce suit on the ground of desertion and cruelty filed before the Faridkot District and Sessions Judge in December 2002. When the matter reached the high court earlier this year after the divorce suit was rejected by the District Courts, it on May 4 issued an NBW against Jugraj to be executed through the Ministry of External Affairs and the Indian Ambassador in Italy or its Consulate-General. But Jugraj’s counsel, senior advocate H.S.Phoolka, raised four important questions of law to be decided by the Supreme Court — whether the high court was justified in issuing the NBW? Had it not exceeded its civil jurisdiction in issuing the warrant when seized of an appeal under the Hindu Marriage Act? Whether it at all had the jurisdiction to issue the NBW seeking appearance of parties in an ordinary civil appeal? Whether personal appearance of a party was mandatory for adjudication of the appeal under Section 28 of the Hindu Marriage Act, 1956? Jugraj’s counsel further contended that he had executed the Special Power of Attorney in the name of his brother to represent him in the court for all issues arising out of the suit as his personal appearance was not possible because his long stay away from work might result in his losing the job with his employer in Italy. |

Mumbai, June 3 With Rahul Mahajan in hospital due to suspected drug overdose, word of his bohemian lifestyle and dalliances with prominent socialites is leaking out. Mahajan regularly turned up at Mumbai's parties though he was careful not to let himself be photographed for the society pages of the local newspapers. With a reputation as a dilettante, Rahul needed Pramod to set him up on some project or another. Pramod, who never fought shy of flaunting his relationship with Jet Airways founder Naresh Goyal, came in for strong criticism after Rahul landed a job with that airline. Airline sources say, Rahul had to quit his job after questions were raised about his professional capability as a pilot. However, word has it that only his father's influence prevented Rahul from losing his flying license. Rahul's next venture into television production coincided with his father's innings as Minister for Information and Broadcasting. The younger Mahajan set up a company, Integral Productions, and bagged a contract from state-owned Doordarshan to produce a programme Truk Dhina Din. However, production was farmed out to another company, Stellar Communications, which failed to provide adequate bank guarantees as mandated by Doordarshan. Again Pramod Mahajan had to step in to bail out his son from another controversy. When Reliance Industries featured in a controversy over the granting of license to operate mobile phone services, Rahul Mahajan's name figured in the matter. Rahul's associate, Ashish Deora, who ran a small Internet company, was given one crore shares free of cost in the then-Mukesh Ambani controlled group. Though Deora was forced to return the shares after the controversy hit the headlines, the company is still facing a probe by the Income Tax Department and has been forced to cough up hefty penalties. In between, Rahul also wangled a consultancy with an American company but returned home shortly after things did not work out. Through all this Rahul managed to maintain a clean image in public and even received kudos from the public for his composure following Pramod Mahajan's killing. The BJP was also keen on promoting Rahul in politics and Pramod's Rajya Sabha seat was to be offered to him. Only opposition by the Maharashtra Congress party prevented Rahul from entering the house of elders though he made a surprise appearance at the party's national executive in the capital recently. The stain of drug abuse will, however, pose a question mark on Rahul's future though. |
BJP distances itself from Rahul
New Delhi, June 3 Seeking to wriggle out of the situation emerging from reports linking the junior Mahajan’s lifestyle with the party’s values, BJP spokesperson Sushma Swaraj said, “It tragedy in the family. The party has nothing to do with it. It can happen in any family.” She was talking to newspersons after a meeting at Leader of Opposition L.K. Advani’s residence which discussed among other things the issue of the President returning the Office of Profit Bill to Parliament. Ms Swaraj claimed that the meeting did not discuss the Rahul Mahajan issue. The manner in which the party does not celebrate the children of its leaders scoring high marks in the examinations, it had nothing to do with their personal lives as well, she said. |

New Delhi, June 3 Speaking to reporters at Apollo Hospital, soon after the report of the toxic screen on Rahul was released, he demanded a high-level probe into the matter. “It looks like a conspiracy and a probe should be done. Somebody may be behind this,” he said. While denying comment on why the two were drinking champagne, Mr Munde said “I don’t know what they were drinking. But water can also be poisoned”. He questioned the motive of Sahil Zaroo, a 22-year-old, who alongwith three others was allegedly present with Rahul and Moitra at Thursday night’s party at the 7, Safdarjang Road residence of late Pramod Mahajan. “He claims to be Rahul’s friend, but which friend would flee to Srinagar after leaving his friend in a serious condition in hospital,” Mr Munde questioned. To a question, he said he had never seen these four men with Rahul before.

New Delhi, June 3 Worse, the first three months of 2006 witnessed an over 200 per cent increase in the number of rape cases inside Indian trains and railway premises. A significant number of these crimes are taking place in Uttar Pradesh, Bihar and Jharkhand, said a senior railway official. “Between January and March, 20 rapes and 38 cases of dacoity were reported to the railway police. During the same period last year, six rapes and 21 cases of dacoity were registered,” said the official. “In all, the railway police registered about 2,700 crime cases in the first three months of 2006,” the official added. India, with one of the world’s largest railway networks, has about 9,000 passenger trains running on the tracks every single day carrying more than 14 million passengers. “Preventing crime and maintaining law and order at railway premises and trains are the tasks of the Government Railway Police (GRP) under state governments,” said A.K. Singh, Deputy Inspector General for Crime at the Indian Railways. “But we are supplementing the efforts of the railway police by deploying the Railway Protection Force (RPF) — which comes under the Ministry of Railways — at vulnerable sections of the network,” Singh told IANS. Singh said the RPF needed more personnel to strengthen the efforts aimed at providing better security in trains and railway premises. “A proposal to increase the strength of the force is in the pipeline.” Data with IANS also showed that around 11,000 cases of crime — murder, dacoity, rape and theft of luggage — were committed in trains or at railway premises. — IANS |
Star Plus to show 'Viraasat' from June 12
New Delhi, June 3 'Viraasat, Nafrat Ke Khel Mein, Do Dilon Ki Chahat' stars budding actors Sangita Ghosh and Rohit Roy who play the lead in a classical drama which is the story of two warring families and of the two young persons who dare to fall in love and get married under massive opposition. Ravi Chopra of B.R. Films says, "What we are trying to say through this production is that hate divides and love brings us together." Chopra further explains that, "This is really a second part to the Romeo-Juliet saga. It begins with the question that if Romeo and Juliet did not die and had got married what would have happened? Would their love help bridge the massive gulf created by hate within the two families?" Chopra says that the serial goes into some 260 episodes and the story idea and original conception of the plot has been his own work. However, it was written by Anand Vardhana and the direction has been worked out by three directors, Siddharth Sengupta, Rajan Sahay and Pabal. "I myself did not handle the direction as I've been busy working on the film 'Babul' and never handle two ventures," says Chopra. The cast includes a galaxy of silver screen actors like Kiran Kumar, Deepak Qazir, Aman Verma, Amarr Upadhyay, Jayati Bhatia and Pooja Rawal Ghai. The serial will start on June 12 and is slotted for 9 pm, running Monday to Thursday at Star Plus. Rohit Roy who plays the lead role of Rahul Lamba says, "This serial is a family drama and I think Sangeeta is the hottest thing happening on it. In this serial I play a typical lover-boy, a role I've never played before. Sangita Ghosh who turned up in a glitzy designed outfit glittering with sequins giggled and added, "My character is that of Priyanka and this girl truly believes in love. Her purpose in getting into that house is not just love, however, it is also to help bring the two families together." |
